DEDICATION OF PUBLIC IMPROVEMENTS WITHIN STONEBRIDGE
SUBDIVISION DEVELOPMENT LOCATED NORTH OF LOOMIS ROAD (STH 36)
AND WEST OF CHAMPIONS DRIVE
WHEREAS, Harmony Homes, Inc., hereafter called “DEVELOPER” has constructed the
following public improvements: sanitary sewer, water main, storm sewer, curb and gutter and
asphalt pavement in Stonebridge Way, Rockridge Court, and Kramer Court at the following
development:
Being a redivision of Parcel A of CSM No. 98 and CSM No. 421 and a part of the SW and SEY.
of the NW Y. of Section 25, Township 5 North, Range 20 East, in the City of Muskego,
Waukesha County, Wisconsin bounded and described as follows: Commencing at the Southwest
corner of said Northwest Y.; thence N 0°30'02"W along the West line of said Northwest Y.
Section 25, 228.05 feet to the point of beginning of the lands to be described; thence continue N
0°30'02" W along said West line, 1108.49 feet; thence N 87°21'25" E, 1335.56 feet; thence S
0°44'27" E, 7.88 feet; thence S 37°20'25" W, 1358.51 feet; thence southeast 132.74 feet along
the arc of a curve whose center is to the East, whose radius is150.00 feet, whose cord bearing is
S 11 °59'20" E and a chord distance of 128.45 feet; thence S 37°20'25" E, 85.49 feet; thence S
63°28'55" W, 15.22 feet; thence S 87°09'21" W along the South line of said Northwest Y.
Section 25, 872.76 feet; thence N 0°44'27" W, 227.26 feet; thence S 87°11'17" W, 1340.35 feet
to the place of beginning. Said lands contains 48.26 acres more or less, more or less and
hereinafter referred to as the "Subdivision", and the Final Plat(s) of which will be recorded with
the Register of Deeds for Waukesha County and a copy of which is on file in the Office of the
City Clerk; and
WHEREAS, the DEVELOPER has completed the construction and installation of the

and appurtenances (collectively called “IMPROVEMENTS”) in accordance with the provision
of Chapter 18 of the Municipal Code of the City of Muskego, hereafter called the “CITY” and
the City Engineer has certified the systems’ acceptability; and
WHEREAS, it is the Developer’s intent to, without charge to the CITY, unconditionally
give, grant, convey and fully dedicate the IMPROVEMENTS to the CITY, free and clear of all
encumbrances, and together with mains, conduits, pipes, plants, machinery, equipment and
appurtenances which relate directly to the utilization of such utilities; and
WHEREAS, the DEVELOPER shall guarantee the public improvements to be dedicated
against any defects due to faulty materials or workmanship which appear within a period of one
(1) year from the date of dedication and shall pay for any damages resulting therefrom to the
CITY property and shall indemnify the CITY against any claims, suits, or liabilities brought
against the CITY at any time arising out of the alleged defects or other failure of this guarantee.

NOW, THEREFORE, BE IT RESOLVED That the Common Council of the City of
Muskego, upon the recommendation of the Finance Committee, does hereby accept dedication of
the public improvements within the Stonebridge Subdivision.
