DEDICATION OF PUBLIC IMPROVEMENTS WITHIN CANDLEWOOD VILLAGE
PLANNED DEVELOPMENT LOCATED WEST & EAST OF MOORLAND ROAD AND
SOUTH OF JANESVILLE ROAD
WHEREAS, Candlewood Village, LLC hereafter called “DEVELOPER” has constructed
the following public improvements: sanitary sewer, water main, storm sewer , concrete curb and
gutter and asphalt pavement in Princeton Drive, Sandalwood Drive, Rosewood Drive and
Honeysuckle Drive at the following development:
Lots One (1), and Two (2) of Certified Survey Map No. 9463, being a part of Lot One(1) of Certified
Survey Map No. 9332 located in the SW ¼ of the SW ¼ of Section 2, T5N R20E, City of Muskego,
Waukesha County, Wisconsin, recorded in the Register of Deeds for Waukesha County on November
15, 2002 in Volume 86 of Certified Survey Maps at Pages 210-214, inclusive, as Document No.
2879711, and Lots One (1), Two (2), and Three (3) of Certified Survey Map No. 9464, being a part of
Lot Two (2) of Certified Survey Map No. 9332 located in the SW ¼ of the SW ¼ of Section 2, T5N
R20E, City of Muskego, Waukesha County, Wisconsin, recorded in the Register of Deeds for
Waukesha County on November 15, 2002 in Volume 86 of Certified Survey Maps at Pages 215-220,
inclusive, as Document No. 2879712 (hereafter ”Commercial Parcels”), and
Lot One (1) and Lot Two (2) of Certified Survey Map No. 9578, being a redivision of All of Lot 1 (1)
of Certified Survey Map No. 9462, being a part of Lot Two (2) of Certified Survey Map No. 9332
located in the SW ¼ of the SW ¼ of Section 2, and the NW ¼ of the NW ¼ of Section 11, T5N R20E,
City of Muskego, Waukesha County, Wisconsin, recorded in the Register of Deeds for Waukesha
County on May 30, 2003 in Volume 88 of Certified Survey Maps at Pages 38-45, inclusive, as
Document No. 2997571, and Lot Two (2) of Certified Survey Map No. 9462, being a part of Lot Two
(2) of Certified Survey Map No. 9332 located in the SW ¼ of the SW ¼ of Section 2, and the NW ¼ of
the NW ¼ of Section 11, T5N R20E, City of Muskego, Waukesha County, Wisconsin, recorded in the
Register of Deeds for Waukesha County on November 15, 2002 in Volume 86 of Certified Survey
Maps at Pages 204-209, inclusive, as Document No. 2879710, and Lot Three (3) of Certified Survey
Map No. 9463, being a part of Lot One (1) of Certified Survey Map No. 9332 located in the SW ¼ of
the SW ¼ of Section 2, T5N R20E, City of Muskego, Waukesha County, Wisconsin, recorded in the
Register of Deeds for Waukesha County on November 15, 2002 in Volume 86 of Certified Survey
Maps at Pages 210-214, inclusive, as Document No. 2879711. , (hereafter “Condominium Parcels”).

WHEREAS, the DEVELOPER has completed the construction and installation of the
following improvements:
Princeton Drive – From 437’ west of Moorland Road to Moorland Road, a centerline distance of
436.77 feet
Princeton Drive – From Moorland Road to Janesville Road, a centerline distance of 1375.69 feet
Sandalwood Drive – From 617’ west of Moorland Road to Moorland Road, a centerline distance
of 616.85 feet
Sandalwood Drive – From Moorland Road to Rosewood Drive, a centerline distance of 226.50

and appurtenances (collectively called “IMPROVEMENTS”) in accordance with the provision
of Chapter 18 of the Municipal Code of the City of Muskego, hereafter called the “CITY” and
the City Engineer has certified the systems’ acceptability; and
WHEREAS, it is the Developer’s intent to, without charge to the CITY, unconditionally
give, grant, convey and fully dedicate the IMPROVEMENTS to the CITY, free and clear of all
encumbrances, and together with mains, conduits, pipes, plants, machinery, equipment and
appurtenances which relate directly to the utilization of such utilities; and

WHEREAS, the DEVELOPER shall guarantee the public improvements to be dedicated
against any defects due to faulty materials or workmanship which appear within a period of one
(1) year from the date of dedication and shall pay for any damages resulting therefrom to the
CITY property and shall indemnify the CITY against any claims, suits, or liabilities brought
against the CITY at any time arising out of the alleged defects or other failure of this guarantee.
NOW, THEREFORE, BE IT RESOLVED That the Common Council of the City of
Muskego, upon the recommendation of the Finance Committee, does hereby accept dedication of
the public improvements within Candlewood Village Planned Development.
