PCR2007110 ./PCR2007110_files/filelist.xml RESOLUTION #P.C. 110-2007 Print BestFit 6 pt 6 pt 0 AMENDED RESOLUTION #PC 110-2007 APPROVAL OF A CONDITIONAL USE GRANT TO ALLOW SHORT TERM VACATION RENTAL OF HOUSE ON THE SAUER PROPERTY LOCATED IN THE NW ¼ OF SECTION 9 AND THE SW ¼ OF SECTION 4 (W187 S7160 GOLD DRIVE / TAX KEY NO. 2175.996)   WHEREAS, A petition was received on October 23, 2007 for a short-tern vacation rental Conditional Use Grant designation for an existing home located on the Thomas and Jennifer Sauer property at W187 S7160 Gold Drive (Tax Key No. 2175.996), and   WHEREAS, The property is zoned RL-3 Lakeshore Residence District and SW Shoreland Wetland District, and the short-term vacation rental use requires a Conditional Use Grant (CUG) that must receive approval through the Plan Commission, and   WHEREAS, Vacation home rentals such as this also require a permit/license through the State and/or County and the property owners are in the process of getting the required permit/license, and   WHEREAS, The property currently only contains the house in question, and   WHEREAS, The use of this property for short-term vacation rentals has been going on for over a year, and   WHEREAS, Due to some concerns regarding these types of rentals on Little Muskego Lake that have been brought up to Alderman Borgman’s attention, a letter was sent to the property owner requiring they seek the required approvals, and   WHEREAS, A Public Hearing was held on November 20, 2007 in front of the Plan Commission, and   WHEREAS, The petitioner’s submittal included five signed letters from neighbors stating that they have not had any problems with this rental type use on this property over the past year and a half.   THEREFORE BE IT RESOLVED, That the Plan Commission approves of a Conditional Use Grant for the Short Tern Vacation Rental of the home on the Thomas and Jennifer Sauer property at W187 S7160 Gold Drive (Tax Key No. 2175.996).   BE IT FURTHER RESOLVED, That all required permits/licenses through the State and/or County must be provided to the City before the Conditional Use Grant can be recorded and before the use can legally be allowed and all required permits/licenses must stay current and active.   BE IT FURTHER RESOLVED, That at the call of the Planning Department, the operations subject to this Conditional Use Grant may be subject to further review or re-review by the Plan Commission if the property and/or the uses do not remain is accordance with the grounds of this approval, and any future operations which are deemed to be inconsistent with this approving resolution may be subject to further conditions by the Plan Commission and possible revocation of the Conditional Use Grant.   BE IT FURTHER RESOLVED, That an annual review will be held every year at the end of summer.   BE IT FURTHER RESOLVED, That failure to comply with the approval contained in this resolution shall result in the imposition of fines of $100 per day, the initiation of legal action, or both.   Plan Commission City of Muskego   Adopted:            November 20, 2007 Defeated: Deferred:           Introduced:             November 20, 2007 ATTEST:            Kellie Renk, Recording Secretary
