PCR2007094 ./PCR2007094_files/filelist.xml RESOLUTION #P.C. 094-2007 Print BestFit 6 pt 6 pt 0 RESOLUTION #PC 094-2007 APPROVAL OF A RUSTIC STRUCTURE CONDITIONAL USE GRANT FOR THE RICCO PROPERTY LOCATED IN THE SW ¼ OF SECTION 26 (W151 S10178 THODE DRIVE / TAX KEY NO. 2263.998.003)   WHEREAS, A petition was received on September 4, 2007 for a Rustic Structure Conditional Use Grant designation for an outbuilding located on the Ricco property at W151 S10178 Thode Drive, and   WHEREAS, The property is zoned A-1 Agricultural District, and the Plan Commission needs to determine if the barn should receive Rustic Structure as permitted by Conditional Use Grant, and   WHEREAS, The property contains the barn in question, along with a guest house and a main residence, and   WHEREAS, The designation of the barn as a Rustic Structure would exempt it from the required setbacks and offsets if they proceed with their possible land division, and   WHEREAS, A Public Hearing was held on October 2, 2007 in front of the Plan Commission, and   WHEREAS, There were only positive comments at the Public Hearing relating to the granting of the Conditional Use Grant for a Rustic Structure, and   WHEREAS, The Conservation Commission reviewed this request at it October 8, 2007 meeting and recommended approval of the Rustic Structure Conditional Use Grant.   THEREFORE BE IT RESOLVED, That the Plan Commission approves of a Conditional Use Grant for the barn on the Ricco property at W151 S10178 Thode Drive.   BE IT FURTHER RESOLVED, That at the call of the Planning Department, the operations subject to this Conditional Use Grant may be subject to further review by the Plan Commission if the building is not properly maintained and kept up, and any future operations which are deemed to be inconsistent with this approving resolution may be subject to further conditions by the Plan Commission.   BE IT FURTHER RESOLVED, That a copy of said plans be kept on file in the Building Department and that all aspect of this plan shall be maintained in perpetuity unless otherwise authorized by the Plan Commission.   BE IT FURTHER RESOLVED, That failure to comply with the approval contained in this resolution shall result in the imposition of fines of $100 per day, the initiation of legal action, or both.                                                                             Plan Commission                                                                         City of Muskego   Adopted:            October 16, 2007 Defeated: Deferred:           Introduced:             October 16, 2007 ATTEST:            Kellie Renk, Recording Secretary
