PCR2007092 PCR2007092_filelist.xml RESOLUTION #PC 092-2007 Print BestFit RESOLUTION #P.C. 092-2007 APPROVAL OF A PORTION OF LAKE ACCESS 19 (SALE OF CITY PROPERTY) TO THE DOMBROWSKI PROPERTY LOCATED IN THE NW ¼ OF SECTION 3   WHEREAS, On August 13, 2007, the Dombrowski property owners (Tax key # 2174.130) requested a piece of lake access property be sold to them in order to make a non-conforming garage more conforming, and   WHEREAS, The Park Board heard the issue at their Monday August 13, 2007 meeting and was receptive to the Dombrowski’s plans to negotiate for an area not to exceed 12 feet from the edge of the garage, following the property line, up to Ruby Drive, and   WHEREAS, Before any City land can be sold privately, the Planning Commission must first make a determination, and   WHEREAS, The Dombrowski garage is located over the City property line and is non conforming, and   WHEREAS, A sale of 12 feet of land would not make the structure conforming as it is still in violation of the front setbacks, and   WHEREAS, There is a sewer force main that goes thru the center of Lake Access #19 that is one of the deepest in the City (30+ feet), and   WHEREAS, There are many other instances in the City where the City owns property or right-of-way and a neighboring parcel has a structure over the property line.   THEREFORE BE IT RESOLVED, That the Plan Commission approves sale of a portion of Lake Access #19 to the Dombrowski property located in the NW ¼ of Section 3.     Plan Commission City of Muskego   Adopted:    Defeated:  September 4, 2007     Deferred:           Introduced:  September 4, 2007 ATTEST:  Kellie Renk, Recording Secretary
