APPROVAL OF A BUILDING SITE AND OPERATION PLAN
FOR ATONEMENT LUTHERAN CHURCH LOCATED IN THE SE ¼ OF SECTION 3
(MARTIN DRIVE / TAX KEY NO. 2172.095)
WHEREAS, On July 2, 2007 plans were submitted by Vanman Architects and Builders for a Building, Site and Operation Plan for Atonement Lutheran Church located in the SE ¼ of Section
3 (Tax Key No. 2172.095 / Martin Drive), and
WHEREAS, Said property is currently zoned I-1 Government, Institutional, and Public Service District and said use is a permitted use, and
WHEREAS, Said parcel will be serviced by public sewer and public water facilities, and
WHEREAS, This site is Outlot 3 from the Oak Ridge Glen Subdivision Plat, and
WHEREAS, Said property is subject to the design standards outlined in the City of Muskego’s General Design Guide, and
WHEREAS, The petitioner requests approval for a 14,715 square foot church on the Northeast corner of Martin Drive and Oakridge Lane, and said structure appears to meet the requirements
of the zoning ordinance in accords to the setbacks, offsets, open space, and floor area ratios of the site, and
WHEREAS, The site plan shows two (2) possible parking lot expansion areas and three (3) possible building expansion areas which will require a separate BSO amendment through the Planning
Commission, and
WHEREAS, The church anticipates Sunday occupancy to be 415 people for all services with lower occupancy on weekdays and Saturdays, and
WHEREAS, The hours are listed from 8 am to 8pm typically, but depending on the event and day of the week the hours will vary, and
WHEREAS, The height of the main structure is limited to 30 (as measured by code) feet by the current zoning and the structure meets this requirement at a 30 foot height (as measured
by code), excluding the tower and cross, and
WHEREAS, The tower and cross exceed the 30 foot height restriction, but the Zoning Code states that “ornamental towers” or “spires” are exempt from the height requirement, subject
to approval from the Planning Commission, and
WHEREAS, The structure is proposed to be constructed with exterior materials, which include brick, 8” fiber cement siding, prefinished metal fascia, and asphalt shingles, and
WHEREAS, The facades show the approximate calculations of brick usage: south façade: 57% brick, west façade: 35% brick, northwest façade: 58% brick, north façade: 41% brick, northeast
façade: 47% brick, east façade: 17% brick, southeast façade: 58% brick, and
WHEREAS, When the Council approved the zoning for the church a couple years ago, they stressed that the building would be up to par with the design guides and the 50% masonry requirement,
and
WHEREAS, Total brick equals approximately 45% of structure and the General Design Guide states that structures shall have at least 50% masonry product, and
WHEREAS, The colors of the structure are earth tones with the rendering showing a redish colored brick with tan colored siding, and
WHEREAS, All Building mechanicals, including HVAC units and electrical transformers, are not shown but will be required to be screened from surrounding view, and
WHEREAS, There is a “Scouts Garage” shown the on the site plan on the southeastern area of the site but no details relating to its design or use have been provided, and
WHEREAS, The access path to the Scouts Garage is currently shown as gravel, but it should be asphalted to help keep the cohesiveness of the site, and
WHEREAS, There is some type of outdoor area shown near the Scouts Garage, but this area is not shown in detail and will require separate approvals/permits if anything is going to
be placed/designed there, and
WHEREAS, 115 parking stalls are shown with eight being handicap, and said parking stalls are short of the requirements for new church structures that state that at least 1 stall per
ever three (3) seats, and
WHEREAS, The parking meets the City requirements seeing that the max occupancy of the worship space is 323 people, and
WHEREAS, The parking lot is currently shown with curbing throughout most of the site, with some exceptions, and the parking stalls all are shown as 10 feet by 20 feet, and
WHEREAS, The access path to the Scout Garage and to the trash enclosure are not shown to be curbed, and
WHEREAS, Vehicular access is depicted off of Martin Drive and no access is off of Oakridge Lane, and
WHEREAS, All driving lanes are illustrated at least 24 feet in width or larger and proper markings are shown throughout the site and a fire access lane is found along the south façade
of the structure, and
WHEREAS, Signage details have not been provided at this time except for a basic monument sign location near the entry on Martin Drive and sign permits will be required before any
signs are installed, and
WHEREAS, A photometric plan and parking lot lighting specifics have been submitted as part of the BSO and some changes are required, and
WHEREAS, The pole lights are shown at 20 feet in height, which is allowed, as the structure is greater than 20 feet in height, and
WHEREAS, The concrete bases of the pole lights are shown as 2 feet above grade and the bulbs are shown to be metal halide, and
WHEREAS, The Zoning Code and General Design Guide require that the concrete bases not exceed six (6) inches above grade, and
WHEREAS, The Zoning Code and General Design Guide require that all lighting fixtures be high-pressure sodium and the Planning Commission has usually only allowed metal halide when
the lighting is used as an architectural feature to enhance architectural elements of the building, and
WHEREAS, A landscape plan is part of the submittal and is being reviewed by the City Forester, and
WHEREAS, Stormwater will be utilized within an on-site pond that is being designed for this development, and
WHEREAS, A 5’ x 8’ cedar trash enclosure is proposed to house all refuse containers on the northwest corner of the structure and details of the structure will need to be submitted
for review.
THEREFORE BE IT RESOLVED, That the Plan Commission approves of the Building, Site and Operation Plan submitted May 23by Vanman Architects and Builders for Atonement Lutheran Church
located in the SE ¼ of Section 3.
BE IT FURTHER RESOLVED, That updated building elevations and updated masonry calculations showing that all sides at least meet the 50% requirement and the total brick on the structure
meets the 50% requirement be delivered to the Planning Department by building permit time or before the next Plan meeting if Plan Commission desires.
BE IT FURTHER RESOLVED, That the north building façade may be allowed to be below the 50% at 41% of the masonry requirement where the worship center is located, as this will most likely
be added onto in the future. However, some masonry should be added along the worship center north facade with possibly increasing the masonry on the front entryway on the tower.
BE IT FURTHER RESOLVED, When the Council approved the zoning for the church a couple years ago, they stressed that the building would be up to par with the design guides, thus the
entire structure must meet the 50% masonry requirement.
BE IT FURTHER RESOLVED, That the entire site must have curbing throughout, even for the access to the future parking expansion areas to ensure cohesiveness through the site and since
it is unknown to us how far in the future these expansions will occur. The curbing can always be removed for expansions.
BE IT FURTHER RESOLVED, That the Scouts Garage access path needs to be asphalted.
BE IT FURTHER RESOLVED, That detailed plans of the Scouts Garage will need to be submitted for approval and the building must match the architecture, colors, and materials of the main
church building.
BE IT FURTHER RESOLVED, That the specific colors of the church must be submitted to the Planning Department for review and approval before the building permits can be issued.
BE IT FURTHER RESOLVED, That the design of the roof could allow exposed roof top mechanicals. All roof top and ground mechanicals shall be screened from view and/or incorporated
into the design of the site/structure (painting, screening, etc.). This includes, but is not limited to, HVAC equipment, electrical transformers, etc. A ground level area enclosed
by the building materials or fencing may be appropriate.
BE IT FURTHER RESOLVED, That the outdoor area shown next to the Scouts Garage will require separate approvals with details relating to its use and design.
BE IT FURTHER RESOLVED, That revised light details and a revised photometric plan are required since the concrete parking lot light pole bases must be six (6) inches above grade or
less in height and the fixtures must be high-pressure sodium.
BE IT FURTHER RESOLVED, That any additional lighting, other than that included in this submittal, will require separate approvals from the Planning Commission and/or the Planning
Department.
BE IT FURTHER RESOLVED, That all signage details (including temporary signage) will need to be submitted for Planning Commission and/or Planning Department review and approval.
BE IT FURTHER RESOLVED, That details of the trash enclosures will need to be submitted before building permits can be issued, all recycle/refuse containers must be completely enclosed
by an enclosure, and the enclosure may need to be expanded to facilitate the actual number/size of the refuse bins.
BE IT FURTHER RESOLVED, That all bollards be painted to match the colors of the principal structure.
BE IT FURTHER RESOLVED, That all handicap signs be incorporated into bored bollards.
BE IT FURTHER RESOLVED, That the landscape plan must be formally approved by the City Forester before the release of building permits.
BE IT FURTHER RESOLVED, That all technical corrections derived from the Engineering/Civil review, provided by the City’s Engineering Consultant, will need to be addressed before the
BSO can be approved due to possible site layout alterations.
BE IT FURTHER RESOLVED, The site plan shows two (2) possible parking lot expansion areas and three (3) possible building expansion areas, which will require a separate BSO amendment
through the Planning Commission at a later date.
BE IT FURTHER RESOLVED, That a copy of said plans be kept on file in the Building Department and that all aspects of this plan as they relate to landscape areas and drainage shall
be maintained in perpetuity unless otherwise authorized by the Plan Commission.
BE IT FURTHER RESOLVED, That failure to comply with the approval contained in this resolution shall result in the imposition of fines of $100 per day, the initiation of legal action,
or both.
