PCR2007073 ./PCR2007073_files/filelist.xml RESOLUTION #PC 073-2007 Print BestFit 6 pt 6 pt 0 RESOLUTION #P.C. 073-2007 APPROVAL FOR SALE OF FIREWORKS FOR VINCE AND HEATHER SIEGEL AT THE PROPERTY LOCATED IN THE NE ¼ OF SECTION 25  (W125 S9782 NORTH CAPE ROAD / TAX KEY NO. 2257.978.005)   WHEREAS, A request was submitted on June 4, 2007 by Vince and Heather Siegel to locate a temporary sales tent, a storage bin, and signs advertising the sale of fireworks at a vacant property located at W125 S9782 North Cape Road, and   WHEREAS, Fireworks have not been sold from this site in the past, and   WHEREAS, The tent canopy will be flame retardant and 30’ x 40’ in size, and   WHEREAS, Signage has been noted on the proposal as one 2.5’ x 10’, one 5’ x 25’, and two 4’ x 20’ temporary banners that will be hung from the tent, one 4’ x 20’ free standing banner on fence stakes along Loomis Road, and small directional signs at the entrances of the parking lot, and   WHEREAS, The petitioner is proposing a 9 foot helium balloon connected to the storage container about 75 feet in the air, and   WHEREAS, A site plan has been filed for Staff review and sanitary facilities are shown to be accommodated with a portable toilet for employees and customers to use on site, and   WHEREAS, The petitioner is proposing to define the parking lot with signage, flagging, and gravel.  The proposed layout meets the basic spacing and size requirements for parking within the City, and   WHEREAS, An electrical permit and inspection may be required by the Building Inspection Department for the electricity hookup, and   WHEREAS, A Transient Merchant License will be required to be obtained from the City Clerks Office before any sales occur.   THEREFORE BE IT RESOLVED, That the Plan Commission approves the request for a temporary stand at W125 S9782 North Cape Road for fireworks sales for Vince and Heather Siegel subject to the following conditions:   1.       Dates of operation approved from June 22nd, 2007 to July 6th, 2007 and    2.       Hours of operation permitted only from 8 am to 9 pm, and 3.       A letter of approval from the property owner has been submitted to the Planning Department approving rental space for Mr. and Mrs. Siegel, and 4.       Applicable permits / licensing must be obtained from the Building Inspection department prior to any site work on the property. 5.       Petitioner to obtain a Transient Merchants License from the Clerk-Treasurer’s Office prior to any sales occurring.   BE IT FURTHER RESOLVED, That the State reviews the access for the temporary use and allows the ingress/egress “as shown” or if temporary no parking or another contingency is required.   BE IT FURTHER RESOLVED, Due to all of the other proposed signage as well as possible site conditions (highway location, utilities, etc.) the helium balloon is not approved.   BE IT FURTHER RESOLVED, That Plan Commission finds this use to be of a temporary nature and will permit the use for a temporary basis.   BE IT FURTHER RESOLVED, That no signage can be within any right-of-ways or vision corners and they can only be placed on the actual property.   Plan Commission City of Muskego   Adopted:            June 19, 2007 Defeated:          Deferred:           Introduced:             June 19, 2007 ATTEST:            Kellie Renk, Recording Secretary
