PCR2007067 ./PCR2007067_files/filelist.xml RESOLUTION #PC 067-2007 Print 90 6 pt 6 pt 0 RESOLUTION #P.C.067-2007 APPROVAL OF AN AMENDED BUILDING SITE AND OPERATION PLAN FOR DURHAM HILL AUTO AT THE PROPERTY LOCATED IN THE NE ¼ OF SECTION 25 (S98 W12578 LOOMIS DRIVE / TAX KEY NO. 2257.982.002) WHEREAS, On May 21, 2007 plans were submitted by Brian Holtz for an amended Building, Site and Operation Plan for Durham Hill Auto located in the NE ¼ of Section 25 (Tax Key No. 2257.982.002 / S98 W12578 Loomis Drive), and   WHEREAS, The property is zoned B-4, Highway Business, and is subject to a Conditional Use Grant allowing the operation of auto sales and service which was previously approved as per #P.C. 039-2005, and   WHEREAS, The petitioner is requesting to alter the past approvals of the site plan to allow:   1.      Add a vehicle display rack 2.      Relocate previously approved “customer parking” 3.      Add five additional cars for sale to the front of the site 4.      Allow an area for a tow truck to be parked at times 5.      Add two additional cars for sale to the middle of the site, and   WHEREAS, The petitioner’s have fulfilled the previous conditions of their site (defining the egress/ingress driveway and landscaping) and now have found extra room on the site for the requests above.   THEREFORE BE IT RESOLVED, That the Plan Commission approves the amended Building, Site and Operation for Durham Hill Auto located in the NE ¼ of Section 25 (Tax Key No. 2257.982.002 / S98 W12578 Loomis Drive).   BE IT FURTHER RESOLVED, The display rack is allowed subject to removal if the building and “for sale” vehicles in the right-of-way should ever cease.   BE IT FURTHER RESOLVED, Reconfiguration of the parking is allowed as long as the stalls are defined by painting/signs before their actual use.   BE IT FURTHER RESOLVED, All other aspects of past approvals are still in affect.   BE IT FURTHER RESOLVED, The Planning Department must be notified for an inspection when the aspects of this approval are completed.  Only when the approvals pass inspection of the Planning Department may the proposed uses of this proposal be allowed.   BE IT FURTHER RESOLVED, That a copy of said plans be kept on file in the Building Department and that all aspect of this plan shall be maintained in perpetuity unless otherwise authorized by the Plan Commission.   BE IT FURTHER RESOLVED, That failure to comply with the approval contained in this resolution shall result in the imposition of fines of $100 per day, the initiation of legal action, or both.     Plan Commission City of Muskego Adopted:    June 5, 2007 Denied:  Deferred:    Introduced: June 5, 2007 ATTEST: Kellie Renk, Recording Secretary
