PCR2007062 ./PCR2007062_files/filelist.xml RESOLUTION #PC 062-2007 Print BestFit 6 pt 6 pt 0   RESOLUTION #P.C. 062-2007 RECOMMENDATION TO REZONE PROPERTIES FROM EA EXCLUSIVE AGRICULTURAL DISTRICT TO RSE SUBURBAN ESTATE DISTRICT AND SW SHORELAND WETLAND DISTRICT LOCATED IN THE NE ¼ OF SECTION 21 (TAX KEY NO. 2241.999 / RACINE AVENUE).   WHEREAS, On May 10, 2007 a petition for rezoning was submitted by Alesci Enterprises Inc. to rezone a property from EA Exclusive Agricultural District to RSE Suburban Estate District and SW Shoreland Wetland District located on North Cape Road (Tax Key No. 2241.999), and   WHEREAS, A Public Hearing for the rezoning has been scheduled before the Common Council on June 12, 2007, and WHEREAS, The RSE Suburban Estate District allows parcels of a minimum 40,000 square feet and 150 feet in width and the rezoning is requested for a future subdivision known as Edgewater Heights, and   WHEREAS, The proposed concept plat shows 33 lots mostly meeting the RSE zoning requirements, however, a few lots may need to be widened at preliminary plat time, and   WHEREAS, The Conservation Plan shows the parcel within the Big Muskego Lake Wildlife Area and shows an area of Medium Acquisition Priorities and the wetlands delineated appear to be where the acquisition priorities are, and   WHEREAS, Wetlands have been delineated and concurred by the WDNR and the DNR has requested that the higher susceptible wetlands be incorporated into the SW Shoreland Wetland District that abuts this parcel to the east, and   WHEREAS, The rezoning includes rezoning all high susceptible wetlands to SW Shoreland Wetland District, and   WHEREAS, The 2010 Comprehensive Plan currently depicts the property for low-density residential uses (.5 – 1.49 units an acre), and this proposal is consistent with this goal, and   WHEREAS, The developer previously brought a proposal in 2006 and was directed to come back with a rezoning and concept that met the low-density requirements of the Comprehensive Plan consistent with the RSE zoning district.   THEREFORE BE IT RESOLVED, That the Plan Commission does hereby recommend approval to the Common Council for the rezoning from the EA Exclusive Agricultural District to RSE Suburban Estate District and SW Shoreland Wetland District for a property located on Racine Avenue (Tax Key No. 2241.999).   BE IT FURTHER RESOLVED, That a future preliminary plat must be reviewed by the Conservation Commission and the possibility of wetland dedication and a buffer to the wetlands may be appropriate due to the Big Muskego Lake Wildlife Area and the Acquisition Priority found here.   BE IT FURTHER RESOLVED, That a future preliminary plat must show the wetland setbacks as set forth by the DNR and a letter of concurrence of the wetland setbacks will be required.   BE IT FURTHER RESOLVED, That a future preliminary plat must adhere to the concept presented at the rezoning.     Plan Commission City of Muskego Adopted:     June 19, 2007 Defeated:   Deferred:     Introduced:  June 19, 2007 ATTEST: Kellie Renk, Recording Secretary
