PCR2007045 ./PCR2007045_files/filelist.xml RESOLUTION #PC 045-2007 Print 89 6 pt 6 pt 0 AMENDED RESOLUTION #P.C.045-2007 APPROVAL OF A BUILDING SITE AND OPERATION PLAN AND CERTIFIED SURVEY MAP FOR WALGREENS LOCATED IN THE SE ¼ OF SECTION 3 (SE CORNER OF SANDALWOOD DRIVE AND JANESVILLE ROAD / PART OF TAX KEY NO. 2172.030) WHEREAS, On February 19, 2007 plans were submitted by The Redmond Company for a Building, Site and Operation Plan and Certified Survey Map for Walgreen’s located in the SE ¼ of Section 3 (Part of Tax Key No. 2172.030), and WHEREAS, An updated site plan was delivered on March 2, 2007, and WHEREAS, Said property is currently zoned B-2 Local Service Center District and said use is a permitted use, and WHEREAS, Said parcel will be serviced by public sewer and water facilities, and WHEREAS, A Certified Survey Map is part of the submittal for approvals and the CSM will make a new lot for Walgreen’s while also create another new commercial lot to the east and all lots meet the B-2 zoning requirements, and WHEREAS, Said property is subject to the design standards outlined in the City of Muskego’s Moorland South Design Guide, and WHEREAS, The petitioner requests approval for a 14,820 square foot structure on the SE corner of Sandalwood Drive and Janesville Road, and said structure appears to meet the requirements of the zoning ordinance in accords to the setbacks, offsets, open space, and floor area ratios of the site, and   WHEREAS, The business anticipates 35 employees with store hours Monday to Sunday, 5 am to midnight with the option of 24 hour operation in near future, and   WHEREAS, The height of the structure is limited to 30 feet by the current zoning and the structure meets this requirement, and WHEREAS, The Moorland South Design Guide promotes structures to utilize Craftsman or Prairie Style influences and the proposed appears to meet the intent of the guide, and WHEREAS, The structure is proposed to be constructed with exterior materials, which include face brick, rock face limestone, smooth faced limestone, cast stone accents, and prefinished metal fascia, and WHEREAS, The structure also includes architectural elements such as prefinished aluminum sunshades, brick column corners, false beams, decorative light fixtures, altering rooflines, and a diverse use of materials throughout the stages and facades of the structure and all the elements appear to meet the intent of the Moorland South Design Guide for prairie style architecture, and WHEREAS, The building elevations shows colors that will compliment each other, consistent with the Moorland South Design Guide, and WHEREAS, All Building mechanicals, including HVAC units, are not shown but will be screened, and WHEREAS, 76 parking stalls are shown with four being handicap, and said parking stalls meet the requirements for the new structure proposed of at least 1 stall per 200 square feet of customer floor area, and WHEREAS, The parking lot will be curbed throughout and the parking stalls all are shown as 10 feet by 20 feet, and WHEREAS, Pedestrian access areas are found throughout the site and a connection is found to the existing recreation trail along Janesville Road and this element is promoted in the Moorland South Design Guide, and WHEREAS, Vehicular access is depicted off of Sandalwood Drive and one off of Princeton Drive, and WHEREAS, The Princeton Drive access is to be shared with the future commercial lot to the east and a cross access easement will be part of the Certified Survey Map which is promoted in the Moorland South Design Guide, and WHEREAS, All driving lanes are illustrated at 25 feet in width or larger and proper markings are shown throughout the site and fire access lanes are found all along the south and east portions of the structure which meets code of having a fire access along at least 50% of one façade of the structure, and WHEREAS, Signage is depicted as a monument sign and wall signs on the north and west facades, and WHEREAS, The monument sign is shown as conforming at 61 square feet in size with materials that match the principal structure and an LED reader board is part of the design and is no more than 25% of the sign, which is what code allows, and WHEREAS, The reader board will have to follow current zoning ordinances of three messages a day changing every 5 seconds without animation, scrolling, etc, and WHEREAS, The wall signage shows the Walgreen’s name in cursive along with two smaller signs noting “Photo” and “Pharmacy, “ and WHEREAS, The wall sign calculations show that the signage is well within the 5% requirement totaling 80 sq. ft. (3.2% of the facades), and WHEREAS, A photometric plan and lighting specifics have been submitted as part of the BSO and they show conformity to the City’s design guidelines, and WHEREAS, The pole lights are to match the ones found at M and I Bank and they are shown at 20 feet in height, which is allowed, as the structure is an average of 23 feet in height, and WHEREAS, The concrete base of the pole lights is shown as no more than 6 inches above grade and the bulbs are shown to be high-pressure sodium, and WHEREAS, High pressure sodium wall pack and accent lights are found on the structure itself and for architectural purposes, Planning Commission has usually allowed metal halide to enhance architectural elements at night, and WHEREAS, A landscape plan is part of the submittal and has been reviewed by the City Forester, and WHEREAS, Stormwater will be utilized off-site at an existing pond that is sufficient for the development, and WHEREAS, A dumpster enclosure is proposed to house all refuse containers on the southeast corner of the structure and the enclosure is built into the building mimicking the same architecture. THEREFORE BE IT RESOLVED, That the Plan Commission approves of the Building, Site and Operation Plan and Certified Survey Map submitted May 23by The Redmond Company for Walgreen’s located in the SE ¼ of Section 3. BE IT FURTHER RESOLVED, The Certified Survey Map shall show all cross-access easements between the lots. BE IT FURTHER RESOLVED, The site plan dated March 2, 2007 is part of the approval. BE IT FURTHER RESOLVED, That all roof top and ground mechanicals shall be screened from view and/or incorporated into the design of the site/structure (painting, screening, etc.). BE IT FURTHER RESOLVED, Metal Halide lights are allowed to be used for the wall pack and accent lights on the structure to enhance architectural elements at night if the developer desires. BE IT FURTHER RESOLVED, An electrical transformer is shown to be on the south side of the site and this transformer must be painted to adapt to the surrounding area and densely landscaped or fenced in for screening. BE IT FURTHER RESOLVED, That any additional signage will require Plan Department approval. BE IT FURTHER RESOLVED, That all bollards be painted to match the colors of the principal structure. BE IT FURTHER RESOLVED, That all handicap signs be incorporated into bored bollards. BE IT FURTHER RESOLVED, That a fence will be needed along any retaining wall exceeding 4 feet in height as per the Engineering Department and this fence should be an aluminum ornamental fence if needed. BE IT FURTHER RESOLVED, The LED sign is to be moved to the bottom of the monument sign and that it could be allowed on top if demonstrated to staff that visibility would be greatly affected. BE IT FURTHER RESOLVED, That the landscape plan be formally approved by the City Forester before the release of building permits. Further, the landscape plan should note that the previously approved Northfield Green landscaping for the parcel shall be installed at the same time the Walgreen’s landscaping is installed. BE IT FURTHER RESOLVED, That all technical corrections derived from the Planning and Engineering Departments will need to be addressed before the CSM can be signed and recorded. BE IT FURTHER RESOLVED, That a digital file of this CSM shall be submitted to the City in accordance with Common Council Ordinance No. 1118 and Resolution 196-2002.  BE IT FURTHER RESOLVED, That a copy of said plans be kept on file in the Building Department and that all aspects of this plan as they relate to landscape areas and drainage shall be maintained in perpetuity unless otherwise authorized by the Plan Commission. BE IT FURTHER RESOLVED, That if occupancy is requested prior to the completion of landscaping and/or asphalting, a bond, letter of credit or cashiers check equal to twice the value of said costs must be submitted to the Planning Department. BE IT FURTHER RESOLVED, That failure to comply with the approval contained in this resolution shall result in the imposition of fines of $100 per day, the initiation of legal action, or both.
