PCR2007043 ./PCR2007043_files/filelist.xml Resolution P.C. 043-2007 Print 86 RESOLUTION #P.C. 043-2007 APPROVAL OF A CONCEPTUAL TWO (2) LOT LAND DIVISION FOR A PROPERTY LOCATED IN THE NE ¼ OF SECTION 15 (TAX KEY NO. 2217.994.002 / S82 W15900 BASS BAY LANE) WHEREAS, On February 16, 2007 a Conceptual Plat Map was submitted by Jean Lafratta for a two (2) lot land division located in the NE ¼ of Section 15, (Tax Key No. 2217.994.002 / S82 W15900 Bass Bay Lane), and WHEREAS, Said property is zoned RS-2 Suburban Residence District requiring minimum lot size of 40,000 square feet and an average minimum width of 220 feet when unsewered, and WHEREAS, The petitioner is requesting conceptual approval to split the current 9.93 acre parcel into one 2.67 acre parcel and one 7.26 acre parcel, and WHEREAS, The existing property currently has a principal dwelling and a guest house and the proposed land split would make the principal dwelling and the guest house each a principal dwelling on two separate lots, and WHEREAS, The property was originally split by Certified Survey Map as per PC Resolution #055-1990, and WHEREAS, The existing properties front only a roadway easement and not a public right-of-way, which was allowed by the Zoning Code in the 1990s as long as Planning Commission agreed, the parcels being split were at least 2 acres in size, and as long as the land division does not conflict with future development of streets in the area, and WHEREAS, The new zoning code does not allow the provision of land divisions on private road easements as the City has wanted any new land division to abut a public right-of-way for safety and maintenance purposes, and WHEREAS, Every new lot must abut a public street as stipulated in Section 18.42(3) of the Land Division Ordinance, and WHEREAS, The conditional use grant for a guesthouse on the lot was approved as Per PC Resolution #168-2001under the assumption that the guesthouse was used for family and not rented or leased, and   WHEREAS, The Public Works Committee determined on October 23, 2000 that the roadway servicing the lots within this area did not have to be brought up to City standards when the guest house was added because the current property owner at that time discussed that it was only a guest house being added and no more lots would be divided in the future due to deed restrictions, and   WHEREAS, Said parcels will be serviced by private sanitary sewer systems and private water.   THEREFORE BE IT RESOLVED, That the Plan Commission approves of a Conceptual Plat Map submitted by Jean Lafratta for a two (2) lot land division for a property located in the NE ¼ of Section 15, (Tax Key No. 2217.994.002 / S82 W15900 Bass Bay Lane).   BE IT FURTHER RESOLVED, That this approval is granted in concept only and final action is only an indication of the current intent of the Plan Commission; Final submittals are subject to future review and consideration by the Plan Commission, municipal committees of jurisdiction, and other agencies, and approval of final plans is not guaranteed by this action of the Plan Commission.                                                              Plan Commission                                                              City of Muskego   Adopted:     Defeated:   March 6, 2007 Deferred: Introduced: March 6, 2007 ATTEST:  Kellie Renk, Recording Secretary
