PCR2007042 ./PCR2007042_files/filelist.xml RESOLUTION #PC 042-2007 Print BestFit 6 pt 6 pt 0 RESOLUTION #P.C. 042-2007 RECOMMENDATION OF RE-APPROVAL OF A PRELIMINARY PLAT FOR THE BELLE CHASSE SUBDIVISION LOCATED IN THE SE ¼ & SW ¼ OF SECTION 11 (DURHAM DRIVE / TAX KEY NOS. 2203.990, 2203.990.001, & 2204.996) WHEREAS, On March 21, 2007 a re-submittal of a preliminary plat was submitted by Bill Carity for the Belle Chasse Subdivision located in the SE ¼ & SW ¼ of Section 11, and   WHEREAS, A preliminary plat was previously approved by the Planning Commission on May 2, 2006 and by the Common Council on May 9, 2006, and   WHEREAS, Due to changes made to the original preliminary plat, a new plat has been submitted, and   WHEREAS, Said plat proposes 132 lots for single-family use and 10 outlots for wetland preservation, stormwater management, a well site, open space preservation, and right-of-way reservation for a possible future dedication, and   WHEREAS, A rezoning to PD-47 (Belle Chase Planned Development) was previously granted for this development, and   WHEREAS, The zoning allows minimum lot sizes of 18,000 square feet and minimum widths of 100 feet and said plat meets the zoning requirements, and   WHEREAS, The Planned Development was allowed reduction in lot density for open space preservation; Further, the Planned Development has not reduced the offsets/setbacks for the lots with the exception of one reduced setback for corner lots (40 feet to 30 feet), which is typical, and   WHEREAS, The 2010 Comprehensive Plan currently depicts the property for medium-density residential uses consistent with the RS-2 and RS-3 Districts (1.6 – 2.99 units an acre), and this proposal is consistent with this goal, and   WHEREAS, The plat does contain high acquisition priority conservation lands in the platted area and the Conservation Commission has addressed the plat and these vital environmental areas, and   WHEREAS, The Conservation Commission reviewed the proposed grading plans and tree surveys for the development at their April 24, 2006 meeting and found that some of the lots invaded the environmental areas excessively and the Commission recommended that many lots be scaled back or removed, and   WHEREAS, The developer has removed and scaled back many lots on the west side of Durham Drive while also including extensive Preservation Easements in order to meet the Conservation Commission recommendations, and   WHEREAS, The developer has noted to staff that an arborist will be a part of the development of the subdivision during construction to make sure all trees within the preservation easements have the least amount of impact, and   WHEREAS, The developer has noted to staff that an arborist will also be a part of the construction of any new home in the subdivision that abuts a Preservation Easement to make sure all trees within the preservation easements have the least amount of impact, and   WHEREAS, The 2003-2007 Plan does identify a trail need along Durham Drive and the Park Board voted to have the developer include a trail along the west side of Durham Drive throughout the development, and   WHEREAS, The main access points to the subdivision are found along Mystic Drive, Durham Drive, and McShane Drive, and   WHEREAS, The Plan Commission has found that the plat is consistent with the adopted 2010 Comprehensive Plan and the 2010 Street System Plan, and   WHEREAS, The City is in the process of reviewing and possibly removing the formerly proposed Durham Drive realignment alternative due to DNR concerns regarding wetland crossings that would be required, and   WHEREAS, Due to the pending removal of the Durham Drive Realignment, one street has been extend to the southeast and 6 additional lots have been proposed within this area, and   WHEREAS, There is still an area adjacent to Durham Drive south of the wetland area (within Outlot 6) that will still be reserved for a possible different future Durham Drive realignment, and   WHEREAS, The DNR wetland concurrence letter has been received and the identified wetland setbacks will need to be shown on the plat, and WHEREAS, Said parcels will be serviced by City sewer and water, and   WHEREAS, Outlot 9 will be used by the City for a future well site, and WHEREAS, Stormwater management will be accommodated within the outlots depicted. THEREFORE BE IT RESOLVED, That the Plan Commission recommends approval to the Common Council of a re-submitted Preliminary Plat for the Belle Chasse Subdivision, located in the SE ¼ & SW ¼ of Section 17 and will be receptive to the submittal of a final plat, subject to resolution of technical discrepancies as identified by the City Planning Department and City Engineers, and payment of all applicable fees in Section 18.14 of the Land Division Ordinance and outstanding assessments if applicable.   BE IT FURTHER RESOLVED, A trail shall be installed along the west side of Durham Drive throughout the development as per the 2003-2007 Park Plan and Park Board recommendations, and   BE IT FURTHER RESOLVED, All Conservation Commission recommendations in regards to Preservation Easements and the scaling back or removal of lots has been addressed.   BE IT FURTHER RESOLVED, That the existing Durham Drive realignment alternative will have to be reviewed and formally removed from the maps before Final Plat approvals.   BE IT FURTHER RESOLVED, That depending on the outcome of the Durham Drive realignment alternative review, a road and some lots may need to be eliminated or reconfigured.   BE IT FURTHER RESOLVED, That a portion of Outlot 6, south of the large wetland area directly east of Durham Drive, is reserved for the possible future area that the City may need for some type of Durham Drive realignment if necessary; The developer must reserve this portion of land to dedicate to the City if the City moves forward with a realignment; Further, the restrictions of this outlot will be found in the future developer’s agreement approved with the final plat.   BE IT FURTHER RESOLVED, That the soil boring study be delivered to the Planning Department before Final Plat approvals.   BE IT FURTHER RESOLVED, That an updated tree survey showing all trees that are to be disturbed be delivered to the Planning Department before Final Plat approvals.   BE IT FURTHER RESOLVED, That the Conservation Committee must review the Final Plat before final approvals and that a tree survey should be delivered to the City Forester for all disturbed wooded areas on the plat so the Conservation Commission can make final determinations on all lots.   BE IT FURTHER RESOLVED, That Preservation Easements should cover as much of the plat as possible and easements shall be defined with restrictions.   BE IT FURTHER RESOLVED, That all lots abutting the existing outer roadways need to show no access except to the new roadways being created.   BE IT FURTHER RESOLVED, The final plat must illustrate the applicable wetland setbacks per the DNR wetland concurrence letter dated May 1, 2006 and this may cause the removal or alteration of some lots within the plat.   BE IT FURTHER RESOLVED, That all technical corrections must be addressed before Final Plat submittal and approval.   BE IT FURTHER RESOLVED, That all State and County requirements be addressed before final approvals.   BE IT FURTHER RESOLVED, That a digital file of this Plat shall be submitted to the City in accordance with Common Council Ordinance No. 1118 and Resolution 196-2002.    Plan Commission City of Muskego   Adopted:    Defeated: Deferred:    April 3, 2007 Introduced: April 3, 2007 ATTEST: Kellie Renk, Recording Secretary
