APPROVAL OF AN ANNUAL REVIEW FOR THE RUSDAHL PROPERTY FOR A RUSTIC STRUCTURE AT THE PROPERTY LOCATED AT W135 S8266 DURHAM DRIVE
WHEREAS, The Plan Commission approved a rustic structure Conditional Use Grant for the Rusdahl property barn at the property located at W135 S8266 Durham Drive on January 4, 2005,
and
WHEREAS, Conditions of approval included the following:
1. That a rustic structure designation be allowed for the property as long as an annual review is held by the City’s Planning Commission and Conservation Commission yearly and
that the annual review is to make certain the barn stays in good repair, and
WHEREAS, The Conservation Commission reviewed the structure at their March 12, 2007 meeting and recommended the continuation of the Rustic Structure designation as long as the new
updates are painted the “red” barn color by April 30, 2007, and
WHEREAS, A Planning Department March 12, 2007 site inspection revealed the barn to be repaired from the year previous, however, the landowners never finished the job and painted the
new updates.
THEREFORE BE IT RESOLVED, That the Plan Commission approves of the Annual Review of the Rusdahl property barn as a rustic structure at the property located at W135 S8266 Durham Drive.
BE IT FURTHER RESOLVED, That the landowners paint the repaired areas the “red” barn color by April 3015, 2007. Citations could be issued after this date or the loss of the rustic
structure determination could will be brought back to Plan Commission.
BE IT FURTHER RESOLVED, That the yearly review be held no later than the second meeting in March of every calendar year.
BE IT FURTHER RESOLVED, That failure to comply with the conditions of this Building, Site and Operation Plan shall result in the imposition of fines of $100 per day per violation,
the initiation of legal action, or both.
