PCR2007036 ./PCR2007036_files/filelist.xml RESOLUTION #P.C. 036-2007 Print BestFit 6 pt 8.15 pt 2 2 MicrosoftInternetExplorer4 RESOLUTION #P.C. 036-2007 APPROVAL OF AN ANNUAL REVIEW FOR G AND G SPECIALIZED CARRIERS LOCATED IN THE NE ¼ OF SECTION 17 (TAX KEY NO. 2225.999.011 / APOLLO DRIVE)   WHEREAS, The Plan Commission approved a Building, Site, and Operation Plan for G and G Specialized Carriers at the property in the Muskego Industrial Park located on Apollo Drive (Tax Key Number 2225.999.011) on June 21, 2005, by Resolution #P.C. 067a-2005, and   WHEREAS, The property is zoned M-2, Industrial District, and said use is allowed by Plan Commission approval, and   WHEREAS, Plan Commission stipulated in Resolution #P.C. 067a-2005 that due to the added concerns of having residential uses abut this property, Plan Commission would like an annual review to take place at least two times after the site has been given occupancy within the month of March, and   WHEREAS, A site inspection was completed on February 19, 2007 and found outdoor storage out of compliance with the approved BSO, and   WHEREAS, G and G received a BSO amendment as per Resolution #008-2007 to allow for the construction of a new outdoor storage area complete with fencing and landscaping, and   WHEREAS, A neighbor has voiced concerns within the past year regarding dust, hours of operation, and viewsheds, and   WHEREAS, The out of compliance outdoor storage will be housed in the new outdoor storage facility by spring 2007.   THEREFORE BE IT RESOLVED, The Plan Commission approves of the annual review for G and G Specialized Carriers, subject to compliance with all conditions of approval.   BE IT FURTHER RESOLVED, That the Planning Department will conduct a re-inspection on May 14, 2007 and the Planning Commission will re-review the site operations at their May 15, 2007 meeting to make sure that the out of compliance outdoor storage is housed in the new outdoor storage facility and to make sure that the operation times have remained constant.  If these items are not met at that time, citations could be issued.   BE IT FURTHER RESOLVED, That if complaints are found to be legitimate for hours of operation, citations will be issued immediately.  The landowner should stick to the 8 am – 5 pm Monday thru Saturday (Sundays off and possible emergency operations taking place at times) hours of operation stipulated in their previously approved BSO or come back before Planning Commission for an amendment if desired.   BE IT FURTHER RESOLVED, That stipulations from Resolution #008-2007 from earlier this year still apply and the conditions of that resolution must be met before development takes place.   BE IT FURTHER RESOLVED, That previously approved plans are kept on file in an address file in the Building Department and all aspect of this plan shall be maintained in perpetuity unless otherwise authorized by the Plan Commission.   BE IT FURTHER RESOLVED, That failure to comply with the approval contained in this resolution shall result in the imposition of fines of $100 per day, the initiation of legal action, or both.   Plan Department City of Muskego   Adopted:    March 20, 2007 Defeated: Deferred: Introduced: March 6, 2007 ATTEST: Kellie Renk, Recording Secretary
