APPROVAL OF A CONCEPTUAL REZONING FROM RS-2 SUBURBAN RESIDENCE TO RM-2 MULTIPLE FAMILY RESIDENCE FOR A PROPERTY LOCATED IN THE SOUTH ½ OF SECTION 16
(TAX KEY NOS. 2223.998 & 2223.989 / RACINE AVENUE)
WHEREAS, On January 22, 2007 a Conceptual Rezoning from RS-2 to RM-2 was submitted by Hoffmann Management for the eastern ten (10) acres of a property located in the South ½ of Section
16, (Tax Key Nos. 2223.998 & 2223.989 / Racine Avenue), and
WHEREAS, The eastern portion of this property is zoned RS-2 Suburban Residence District (single-family) requiring a minimum lot size of 20,000 square feet and an average minimum width
of 110 feet if served with municipal sanitary sewer, and
WHEREAS, The petitioner is requesting conceptual approval to rezone this area of the parcel to RM-2 Multiple Family Residence District (requiring 10,000 square feet of land per unit),
and
WHEREAS, The 2010 Comprehensive Plan depicts this area as being set aside for medium density residential and this proposal does not match this goal, and
WHEREAS, A conceptual site layout has also been included as part of the submittal, and
WHEREAS, The submittal indicates that the development is proposed to contain eleven (11) – four (4) unit buildings, totaling 44 units plus a potential commons building, and
WHEREAS, Said parcels will need to be serviced by municipal sanitary sewer and municipal water, and
WHEREAS, The Conservation Plan identifies a small portion of the northwest area of this parcel as a low management priority area, and
WHEREAS, A Certified Survey Map (CSM) will be required to separate this proposed condo parcel from the existing apartment buildings parcel, and
WHEREAS, There is an existing vacant public right-of-way stub along the eastern lot line of this property that leads to Clearbrook Drive within the Country Brook Estates Subdivision,
and
WHEREAS, The proposal states that this public right-of-way stub would not connect as part of this proposal, and
WHEREAS, There is a 60’ road reservation stemming off of Racine Avenue that provides access to this site that will need to be dedicated and possibly improved as part of any division/development.
THEREFORE BE IT RESOLVED, That the Plan Commission approves of a Conceptual Rezoning from RS-2 to RM-2 submitted by Hoffmann Management for a property located in the South ½ of Section
16, (Tax Key Nos. 2223.998 & 2223.989 / Racine Avenue).
BE IT FURTHER RESOLVED, That an amendment to the 2010 Comprehensive Plan from Medium Density Residential to High Density Residential would also be required as part of a formal Rezoning
request.
BE IT FURTHER RESOLVED, That the Public Works Committee would need to review any further plans to determine if the stub to the east needs to be connected and to determine what type
of improvements may be required for the access road leading into this development.
BE IT FURTHER RESOLVED, That a determination needs to be made as to how to connect the Municipal sewer and water.
BE IT FURTHER RESOLVED, That all environmental features will need to be delineated as part of any future divisions or plats.
BE IT FURTHER RESOLVED, That this approval is granted in concept only and final action is only an indication of the current intent of the Plan Commission; Final submittals are subject
to future review and consideration by the Plan Commission, municipal committees of jurisdiction, and other agencies, and approval of final plans is not guaranteed by this action of
the Plan Commission.
