PCR2007017 ./PCR2007017_files/filelist.xml RESOLUTION #PC 017-2007 Print BestFit 6 pt 6 pt 0 RESOLUTION #P.C. 017-2007 APPROVAL OF AN AMENDMENT TO A BUILDING SITE AND OPERATION PLAN FOR DINGERS LOCATED IN THE NE ¼ OF SECTION 17 (TAX KEY NO. 2221.020 / W189 S8224 MERCURY DRIVE) WHEREAS, On January 22, 2007 plans were submitted by Dena Hunt and Vince Breider for a Building, Site and Operation Plan amendment for Dingers located in the NE ¼ of Section 17 (Tax Key No. 2221.020 / W189 S8224 Mercury Drive), and   WHEREAS, The petitioners are proposing to change the use of their property to a baseball recreation facility containing indoor batting cages, a snack bar, a lounge, an arcade, and a retail shop, and   WHEREAS, The former business that was run from this property was a pattern shop, named Accurate Cad/Cam, and   WHEREAS, The proposed use is a permitted use in the M-2, General Industrial District by right with the approval of a Building, Site and Operation Plan, and   WHEREAS, Any outdoor recreational activities will require a separate Conditional Use Grant (CUG) and BSO Amendment, and   WHEREAS, An outdoor batting cage and recreation area is proposed and may be pursued at a later date since a CUG is required, and   WHEREAS, Currently the site contains an industrial type building, an asphalt parking area, and a gravel parking/storage area, and   WHEREAS, Numerous interior alterations are proposed to make the building more feasible for the proposed use, and   WHEREAS, Five (5) windows and a service counter with a roll up door are proposed to be added to the exterior of the east facade of the building, and   WHEREAS, The site plan shows sixteen (16) existing parking stalls on site that are on asphalt and the proposal includes the re-paving of the existing lot along with an expansion of the asphalt parking area with twenty-one (21) new parking stalls measuring 9’ x 18’, totaling thirty-seven (37) parking stalls, and   WHEREAS, The General Design Guide requires all new parking stalls to be 10’ x 20’ in size, and   WHEREAS, A new patio and some sidewalks are being proposed to allow easy transitions to the outside and for an outdoor seating area, and   WHEREAS, A new six (6) foot high wood dumpster enclosure is being proposed at the rear of the parking lot, and   WHEREAS, The submitted proposal states that lights will be added to the parking area, but no specific details have been given, and   WHEREAS, No landscaping details have been provided at this time, and   WHEREAS, A six (6) foot tall wood fence is being proposed along the northern and eastern lot lines and a four (4) foot tall wood fence is being proposed between the new parking area and the future outdoor batting cages, and   WHEREAS, A storage shed is proposed along the rear of the building, and   WHEREAS, Said parcel is serviced by municipal sanitary sewer and municipal water, and   WHEREAS, No specific signage details have been submitted at this time, and   WHEREAS, No stormwater facilities will be required since the added impervious surface will be less than half an acre.   THEREFORE BE IT RESOLVED, That the Plan Commission approves of an amended Building, Site and Operation Plan for Dingers located in the NE ¼ of Section 17 (Tax Key No. 2221.020 / W189 S8224 Mercury Drive).   BE IT FURTHER RESOLVED, That any outdoor lighting will require detailed plans to be submitted to the Planning Department along with photometric plans for review and approval before being installed on site.   BE IT FURTHER RESOLVED, That the shed must be placed at least ten (10) feet away from the building and match the colors of the main building or it must be permanently attached to the main building, per Building Code requirements, and the materials of the shed must match the materials of the main building as to make the two structures look like one.   BE IT FURTHER RESOLVED, That a detailed landscape plan must be submitted and approved by the Planning Department before the new business can open.   BE IT FURTHER RESOLVED, That all new parking stalls must be on an asphalt/concrete surface and striped at 10’ x 20’ in size, which may require the removal of 1-2 new stalls.   BE IT FURTHER RESOLVED, That since signage specifics were not included in this submittal, any signage will require a separate permit through the Plan Department.   BE IT FURTHER RESOLVED, That other ancillary signage on the property is expressly prohibited unless specifically regulated by Section 16 of the Municipal Zoning Code.   BE IT FURTHER RESOLVED, No unscreened outdoor storage shall be allowed on site.   BE IT FURTHER RESOLVED, That no outdoor product displays are allowed on site.   BE IT FURTHER RESOLVED, That a copy of said plans be kept on file in the Building Department and that all aspects of this plan shall be maintained in perpetuity unless otherwise authorized by the Plan Commission.   BE IT FURTHER RESOLVED, That failure to comply with the
