RESOLUTION #P.C. 013-2007
APPROVAL OF CONCEPTUAL SUBDIVISION PLAT FOR A FUTURE SUBDIVISION KNOWN AS THE FARM LOCATED IN THE NE ¼ OF SECTION 24 (TAX KEY NOS. 2253.998 & 2253.998.003 / NORTH CAPE ROAD)
WHEREAS, On January 23, 2007 a sketch preliminary plat was submitted by Mariner Land Corporation for a property located in the NE ¼ of Section 24 (Tax Key Nos. 2253.998 & 2253.998.003
/ North Cape Road), and
WHEREAS, The plan consists of approximately 63 acres, proposes 64 single-family parcels and a variety of outlots for conservation and stormwater purposes, and
WHEREAS, The plan shows an average lot size of 21,622 square feet and the overall open space total is approximately 24 acres or 35% of the development, and
WHEREAS, The land currently consists of open farm land and some wetlands, and
WHEREAS, The proposed lots would all be internal with no lots having direct North Cape Road access, and
WHEREAS, Many of the proposed lots would abut open space and landscaped areas, and
WHEREAS, Said properties are currently zoned RC-2 and RC-3 Rural Country Estate Districts and the plat would require a rezoning to a PD Planned Development District under the auspices
of the RS-2 Suburban Residence District regulations of min. 20,000 square foot lots with widths of 110 feet, and
WHEREAS, A PD Planned Development District is proposed as the developers would then retain a majority of the land as open space to the west to connect to the other State and City owned
conservation lands, and
WHEREAS, The parcel is within the Big Muskego Wildlife Area in the City’s Conservation Plan, and
WHEREAS, Usually, the City wants to find some benefit to the area for approving density distributions in Planned Developments and the Conservation Commission has recommended approval
of the plat seeing that the area to the west was preserved as part of the Big Muskego Lake Wildlife Area and that DNR/City conservation lands already exist adjoining to the south/southwest,
and the DNR is working with the City to buy the conservation rights to the parcel adjoining the west boundary line of the proposed platted area, and
WHEREAS, The Conservation Commission recommended that the City shall have access to the open space lands for maintenance and prescribed burning as necessary, the Homeowner’s Association
shall be responsible for maintenance costs, and the outlot shall be planted with a seed mix per City of Muskego requirements for conversion to prairie, and
WHEREAS, The property is currently split zoned RC-2 and RC-3 Rural Country Estate Districts. RC-2 allows min. lot sizes of 60,000 square feet and min. widths of 175 feet. RC-3 allows
min. lot sizes of 40,000 square feet and min. widths of 150 feet, and
WHEREAS, The proposed development would meet the 2010 Comprehensive Plan intentions for “Low-Density Residential” of .5-1.49 units an acre as the development shows 1.02 units an acre
under a PD Planned Development zoning scenario, and
WHEREAS, Said parcels will be serviced by City sanitary sewer and water, and
WHEREAS, Access is depicted to derive from Priegel Drive to the north and the stub off of Boxhorn Reserve Subdivision to the south, and
WHEREAS, Priegel Drive may require street enhancements, and
WHEREAS, The Park and Open Space Plan depicts no recommendations for this piece of property, and
WHEREAS, The Plat is required to provide on-site stormwater management as required by Chapter 34, and stormwater is depicted to be handled in detention facilities within the outlots.
THEREFORE BE IT RESOLVED, That the Plan Commission approves of a sketch preliminary plat as proposed by Mariner Land Corporation for the future subdivision known as The Farm located
in the NE ¼ of Section 24 and will be receptive to the submittal of a preliminary plat.
BE IT FURTHER RESOLVED, That a conceptual rezoning to a PD Planned Development District under the RS-2 Suburban Residence District requirements is looked upon fondly at this time due
to the benefits to the Big Muskego Lake Wildlife Area, although a future public hearing could bring out further details that the Planning Commission may review.
BE IT FURTHER RESOLVED, That the City shall have access to the open space lands for maintenance and prescribed burning as necessary, the Homeowner’s Association shall be responsible
for maintenance costs, and the outlot shall be planted with a seed mix per City of Muskego requirements for conversion to prairie.
BE IT FURTHER RESOLVED, Preigel Drive may require street enhancements known at the time of Preliminary Plat
BE IT FURTHER RESOLVED, The Park and Conservation Boards will re-review the proposal at the time of Preliminary Plat to determine preservation plan and easement needs.
BE IT FURTHER RESOLVED, Larger lot sizes and square footage added to the conservation area will be required upon formal submittals.
BE IT FURTHER RESOLVED, That this approval is granted in concept only and final action is only an indication of the current intent of the Plan Commission; Final submittals are subject
to future review and consideration by the Plan Commission, municipal committees of jurisdiction, and other agencies, and approval of final plans is not guaranteed by this action of
the Plan Commission.
