PCR2007008 ./PCR2007008_files/filelist.xml RESOLUTION #PC 008-2007 Print BestFit 6 pt 6 pt 0 AMENDED RESOLUTION #P.C.008-2007 APPROVAL OF AN AMENDMENT TO THE BUILDING SITE AND OPERATION PLAN FOR THE MEINEN AND SWAN PROPERTIES LOCATED IN THE NE ¼ OF SECTION 17 (TAX KEY NOS. 2225.999.008 & 2225.999.011 / S82 W19362-80 APOLLO DRIVE) WHEREAS, On December 20, 2006 plans were submitted by Earl Meinen for an amendment to the Building, Site and Operation Plan for the Meinen & Swan properties located in the NE ¼ of Section 17 (S82 W19362-80 Apollo Drive  / Tax Key Nos. 2225.999.008 & 2225.999.011), and WHEREAS, Said properties are zoned I-1 Industrial Park District, and said use is a permitted use by right subject to Building Site and Operation Plan approvals, and   WHEREAS, The petitioner is proposing to install a gravel storage area and a concrete parking area, and   WHEREAS, The gravel storage area will be for outdoor storage for E.M. Construction (Earl Meinen) and G & G Specialized Carriers (Robbie Swan) and it will be enclosed from the Apollo Drive side with an eight (8) foot high chain link fence with privacy slats, and   WHEREAS, Tan and white alternating privacy slats are being proposed, and   WHEREAS, The concrete parking area will be located in front of the fenced storage area and it will be for E.M. Construction employee parking and a walkway will also be constructed leading to their building located to the east of the new lot, and   WHEREAS, There is an Ingress & Egress Easement shown along the new shared lot line that measures 80’ deep by 30’ wide, and   WHEREAS, The new gravel storage area on the G & G property will extend further north than shown on the plans to as far back as within three (3) feet of the rear lot line as on the current G & G property, and   WHEREAS, All outdoor storage that currently is on the G & G property will only be stored on truck beds and all free standing storage/items must be stored within the new gravel area, and   WHEREAS, Landscaping is being shown to be added in front of the fenced area and in front of the new parking area, and   WHEREAS, No new landscaping/screening has been proposed for the rear of the properties, and   WHEREAS, No new lighting has been submitted and/or approved for these properties.   THEREFORE BE IT RESOLVED, That the Plan Commission approves of an amended Building, Site and Operation Plan for the Meinen & Swan properties located in the NE ¼ of Section 17 (S82 W19362-80 Apollo Drive  / Tax Key Nos. 2225.999.008 & 2225.999.011).   BE IT FURTHER RESOLVED, That a recorded copy of the deed that is transferring the land from Mr. Meinen to Mr. Swan must be submitted to the Planning Department before any work can be done on the properties.   BE IT FURTHER RESOLVED, That the portion of land that is being purchased by Mr. Swan must be combined with his existing parcel to create one larger lot since the new lot is non-conforming on its own.   BE IT FURTHER RESOLVED, That the Ingress & Egress Easement must extend the entire depth of the properties.   BE IT FURTHER RESOLVED, A copy of the final Ingress & Egress Easement document and agreement must be submitted to the Planning Department before recording can occur and this must happen before any work can be started on the properties.   BE IT FURTHER RESOLVED, The fencing must extend all of the way from the G & G Specialized Carrier’s building to E.M. Construction’s building so that the entire gravel storage area is screened from any Apollo Drive view.   BE IT FURTHER RESOLVED, That the entire entry driveway, the parking area, and the walkway must be entirely concrete or asphalt.   BE IT FURTHER RESOLVED, That all parking stalls must measure at least 10’ x 20’ in size and they must be striped.   BE IT FURTHER RESOLVED, That there must be parking stops or curbing applied in the parking area.   BE IT FURTHER RESOLVED, That the approved parking diagram must be followed or a revised parking plan must be submitted for staff review and approval.   BE IT FURTHER RESOLVED, That all privacy slats within the fencing must all be one single earth tone color.   BE IT FURTHER RESOLVED, That a formal landscape plan needs to be submitted to illustrate the landscape details that will be occurring on site.   BE IT FURTHER RESOLVED, That there must be additional landscaping along the entire rear lot line to match the landscaping along the rear of the current G & G property and no existing vegetation can be removed along the rear lot line.   BE IT FURTHER RESOLVED, That all other conditions of all previous resolutions and all conditions of the issued Building Permits are still in effect. BE IT FURTHER RESOLVED, That a copy of said plans be kept on file in the Building Department and that all aspect of this plan shall be maintained in perpetuity unless otherwise authorized by the Plan Commission.   BE IT FURTHER RESOLVED, That failure to comply with the approval contained in this resolution shall result in the imposition of fines of $100 per day, the initiation of legal action, or both.   BE IT FURTHER RESOLVED, An 8-foot high slatted fence, made of similar materials to the fence in front, will be installed along the rear lot line of the Swan property where the outdoor storage is to be and landscaping shall be included on the landscape plan along the rear of the Meinen property.
