PCR2006137 ./PCR2006137_files/filelist.xml RESOLUTION #P.C. 137-2006 Print BestFit 6 pt 8.15 pt 2 2 RESOLUTION #P.C. 137-2006 APPROVAL OF CONCEPTUAL SUBDIVISION PLAT FOR CRYSTAL LAKE ADDITION 1 LOCATED IN THE SE ¼ OF SECTION 32 (TAX KEY NO. 2287.999 / MUSKEGO DAM ROAD) WHEREAS, On November 20, 2006 a conceptual subdivision plat was submitted by Kalvin Klimeck and Tracy Weber for Crystal Lake Addition 1 located in the SE ¼ of Section 32 (Tax Key No. 2287.999 / Muskego Dam Road), and WHEREAS, The plan consists of 98 single-family parcels and a few outlots, and WHEREAS, The property to the north is currently zoned RS-2 – Suburban Residence District while the property to the south is zoned EA Exclusive Agricultural, and WHEREAS, The development is proposed to be developed as an unsewered subdivision, and WHEREAS, The requirements for an unsewered RS-2 development are 40,000 square foot lots with minimum widths of 220 feet and the requirements for an EA development are 35 acres a parcel, and WHEREAS, The 2010 Plan depicts the northern parcel as rural density residential and the southern parcel to be Agriculture and Open Lands and would require a comprehensive plan amendment to change both parcels to low density residential, and   WHEREAS, It is yet to be determined if the majority of the parcels will be serviced by public or private sewerage systems at this time, however, City Utility staff would like to see the parcels be serviced by public sewer due to the location in relation to Lake Denoon, and   WHEREAS, Sewer determination will ultimately have to be made by the Norway Sewer District before Preliminary Plat approvals, and   WHEREAS, A development of this size will require a private community water trust, and   WHEREAS, Access is depicted to derive from Muskego Dam Road/Kelsey Drive and possibly from a connection to the Crystal Lake Subdivision to the southwest of this development and the Public Works Committee may require improvements to the intersection of Muskego Dam Road/Kelsey Drive as part of the proposed development, and   WHEREAS, Muskego Dam Road is shown to meander thru the development and not create a direct route for Muskego Dam Road to Racine Avenue, and   WHEREAS, The Park and Open Space Plan depicts no recommendations for this piece of property, and   WHEREAS, The Conservation Plan depicts a small area of Medium Management Priority area on the northeastern portion of this site and a High Acquisition Priority area located near Crystal Lake at the southwest corner of the plat, and   WHEREAS, The Plat is required to provide on-site stormwater management as required by Chapter 34, and stormwater is depicted to be handled in detention facilities within the outlot. THEREFORE BE IT RESOLVED, That the Plan Commission approves of a sketch preliminary plat as proposed by Kalvin Klimeck and Tracy Weber for Crystal Lake Addition 1 located in the SE ¼ of Section 32 and will be receptive to the submittal of a preliminary plat. BE IT FURTHER RESOLVED, That an amendment to the Comprehensive Plan from rural density residential to low density residential would be required in order to approve a future preliminary plat for this proposal. BE IT FURTHER RESOLVED, A rezoning for the southern parcel would be required in order to approve a future preliminary plat for this proposal. BE IT FURTHER RESOLVED, That improvements to Muskego Dam Road/Kelsey Drive intersection may be required since this intersection will contain the main entry to the proposed subdivision and Public Works Committee will have to review the plan to determine if any upgrades will be necessary.   BE IT FURTHER RESOLVED, That the determination of whether Muskego Dam Road should have a direct route to Racine Avenue shall be made before Preliminary Plat time and may need consideration from the Public Works Committee.   BE IT FURTHER RESOLVED, That Sewer determination will ultimately have to be made by the Norway Sewer District before Preliminary Plat approvals.   BE IT FURTHER RESOLVED, That a development of this density will require a private community water trust.   BE IT FURTHER RESOLVED, The Preliminary Plat should show all environmentally delineated areas within Preservation Easements.  Further, all wetlands shall be in outlots and those wetlands unable to be put into outlots shall show innovative ways of further protecting them (Fencing installed by developer around the wetlands that is maintained by homeowner or other methods).   BE IT FURTHER RESOLVED, That DNR concurrence on the delineation of all wetlands and navigable waterways within the platted area must be delivered to the Planning Department before approvals of the Preliminary Plat.   BE IT FURTHER RESOLVED, That if a connection is achieved to Crystal Lake Subdivision, there cannot be a right-of-way immediately along side of Lot 5 of Crystal Lake Subdivision because this would create a front yard setback along this parcel.   BE IT FURTHER RESOLVED, The Park and Conservation Boards will review the proposal at the time of Preliminary Plat to determine preservation plan and easement needs.   BE IT FURTHER RESOLVED, All environmental features will need to be delineated before Preliminary Plat time including high water marks of navigable streams, any wetlands, floodplains, and forested areas.   BE IT FURTHER RESOLVED, That this approval is granted in concept only and final action is only an indication of the current intent of the Plan Commission; Final submittals are subject to future review and consideration by the Plan Commission, municipal committees of jurisdiction, and other agencies, and approval of final plans is not guaranteed by this action of the Plan Commission.   Plan Commission City of Muskego   Adopted:    Defeated:   December 5, 2006 Deferred:  Introduced: December 5, 2006 ATTEST: Sandi Asti, Recording Secretary
