PCR2006135 ./PCR2006135_files/filelist.xml RESOLUTION #PC 070-2006 Print BestFit 6 pt 6 pt 0 RESOLUTION #P.C.135-2006 RECOMMENDATION TO COMON COUNCIL TO REZONE PROPERTIES FROM B-4/OPD/OWP (Highway Business District with a Planned Development Overlay with a Wellhead Protection Overlay) AND RS-2/OIP/OWP (Suburban Residence District with a Institution and Public Service Overlay with a Wellhead Protection Overlay) TO B-4/OPD/OWP (Highway Business District with a Planned Development Overlay with a Wellhead Protection Overlay) FOR PARKLAND VIEW DEVELOPMENT LOCATED IN THE NW ¼ OF SECTION 10 (Tax Key Nos. 2198.991.002, 2198.991.003, & 2198.992 / Janesville Road).   WHEREAS, On November 16, 2006 plans were submitted by Ener-Con Companies LLC for a mixed use development along Janesville Road which include the need for a rezoning for the Parkland View Development located in the SW ¼ of Section 10, and WHEREAS, The BSO and supporting approvals are part of PC Resolution #135-2006, and WHEREAS, The property is zoned B-4/OPD/OWP (Highway Business District with a Planned Development Overlay with a Wellhead Protection Overlay) and RS-2/OIP/OWP (Suburban Residence District with a Institution and Public Service Overlay with a Wellhead Protection Overlay) and a rezoning for a new planned development is required to B-4/OPD/OWP zoning (Highway Business District with a Planned Development Overlay with a Wellhead Protection Overlay), and WHEREAS, The new Planned Development Zoning is requested to allow the following, which is above and beyond the normal requirements of the general zoning districts: 1.      Spreading the density of the proposed 31 units of residential over the entire zoning district area.  The Planned Development zoning area covers over 6.5 acres of land resulting in allowing approximately 60 units (Under the RSM zoning density of at least 5,000 of land area per unit).   Only 31 units are proposed to allow good site planning for the given developable area. 2.      Allowing the height of the structure as measured by code (Midpoint of the highest gable between the peak of the roof to the trough line) to be 34 feet.  This is 4 feet above the B-4 code requirement of 30 feet. 3.       Allowing the structure to have a 10-foot setback along Janesville Road, which is 30 feet closer than the B-4 code requirement of 40 feet.  The smaller setback is encouraged by the City Redevelopment District guide to promote Traditional Neighborhood Development of putting buildings closer to the roadway and hiding traffic and parking behind, and WHEREAS, A public hearing was heard on December 12, 2006 regarding the proposal. THEREFORE BE IT RESOLVED, That the Plan Commission recommends approval to the Common Council for a rezoning for the Parkland View Development located in the SW ¼ of Section 10 from B-4/OPD/OWP (Highway Business District with a Planned Development Overlay with a Wellhead Protection Overlay) and RS-2/OIP/OWP (Suburban Residence District with a Institution and Public Service Overlay with a Wellhead Protection Overlay) and a rezoning for a new planned development is required to B-4/OPD/OWP zoning (Highway Business District with a Planned Development Overlay with a Wellhead Protection Overlay) (Tax Key Nos. 2198.991.002, 2198.991.003, & 2198.992 / Janesville Road).
