RESOLUTION #P.C.133-2006
APPROVAL OF AN AMENDMENT TO THE BUILDING, SITE, AND OPERATION PLAN
FOR M & I BANK LOCATED IN THE SW ¼ OF SECTION 2
(TAX KEY NO. 2167.995.015 / S69 W15563 JANESVILLE ROAD)
WHEREAS, On November 20, 2006 plans were submitted by Zimmerman Architectural Studios, Inc. for an amendment to the Building, Site, and Operation Plan for M & I Bank located in the
SW ¼ of Section 2 (S69 W15563 Janesville Road / Tax Key No. 2167.995.015), and
WHEREAS, Said property is zoned B-3/OPD General Business District with a Planned Development Overlay, and said use is a permitted use by right subject to Building, Site, and Operation
Plan approvals, and
WHEREAS, The petitioner was approved to construct a banking facility under #P.C. 071-2005, and
WHEREAS, One of the conditions of their BSO approval was that a revised landscape plan was required, and
WHEREAS, Due to the electrical transformer changing locations, further landscape changes were required to screen the transformer, and
WHEREAS, An updated landscape plan was approved by the City Forester, which included six (6) Arborvitae and two (2) Viburnum surrounding the transformer, and
WHEREAS, The petitioner is now requesting to be able to remove the six (6) Arborvitae to resolve potential safety concerns, and
WHEREAS, The petitioner has stated in their submittal that they feel the landscaping causes a safety concern because of the potential ability of a criminal to hide behind the shrubs
and attack or rob a bank employee, and
WHEREAS, There are potential options to resolve the issues such as a camera with a monitor inside the door and/or a solid screening wall that matches the materials of the building.
THEREFORE BE IT RESOLVED, That the Plan Commission approves of an amended Building, Site and Operation Plan for M & I Bank located in the SW ¼ of Section 2 (S69 W15563 Janesville Road
/ Tax Key No. 2167.995.015).
BE IT FURTHER RESOLVED, That all other conditions of all previous resolutions and all conditions of the issued Building Permit are still in effect.
BE IT FURTHER RESOLVED, That a copy of said plans be kept on file in the Building Department and that all aspect of this plan shall be maintained in perpetuity unless otherwise authorized
by the Plan Commission.
BE IT FURTHER RESOLVED, That failure to comply with the approval contained in this resolution shall result in the imposition of fines of $100 per day, the initiation of legal action,
or both.
