PCR2006131 ./PCR2006131_files/filelist.xml RESOLUTION #P.C. 131-2006 Print BestFit 6 pt 8.15 pt 2 2 RESOLUTION #P.C. 131-2006 APPROVAL OF CONCEPTUAL LAND DIVISION FOR WAYNE SALENTINE LOCATED IN THE NW ¼ OF SECTION 7 (TAX KEY NO. 2186.998 / W219 S7198 CROWBAR DRIVE) WHEREAS, On January 23, 2006 a conceptual land division was submitted by Wayne Salentine for a property located in the NW ¼ of Section 7 (Tax Key No. 2186.998 / W219 S7198 Crowbar Drive), and WHEREAS, The land division consists of 1 parcel being divided into 5 parcels and a roadway for access, and WHEREAS, Said property is zoned RCE Country Estate Residence and will be developed as an unsewered land division, and WHEREAS, The RCE Country Estate Residence District requires lots to have a minimum of 2.75 acres and a minimum of 250 feet in width and the parcels depicted appear to meet these requirements, and WHEREAS, The 2010 Comprehensive Plan depicts this area for rural density residential development consistent with RCE zoning and the parcels depicted appear to meet these requirements, and   WHEREAS, Said parcels will be serviced with private on-site sewage systems and private individual wells, and   WHEREAS, Access is depicted to derive from Crowbar Drive via a new “Court” and the petitioner will have to improve the roadway to City standards, and   WHEREAS, The Park and Open Space Plan depicts no recommendations for this piece of property, and   WHEREAS, The Conservation Plan depicts an area of Acquisition area along the eastern portion of the parcel (Where the forested area is located) and determinations of easements or dedications must be made by the Conservation Commission, and   WHEREAS, Lots to the south and east of the proposed land division access off the parcel via an easement, and   WHEREAS, The land division may require on-site stormwater management for the roadway and that will have to be accommodated before final approval documents. THEREFORE BE IT RESOLVED, That the Plan Commission approves of a conceptual land division as proposed by Wayne Salentine for a property located in the NW ¼ of Section 7 (Tax Key No. 2186.998 / W219 S7198 Crowbar Drive). BE IT FURTHER RESOLVED, That determination of the type of improved roadway must be made by Public Works Committee before final document approvals. BE IT FURTHER RESOLVED, That Conservation Commission review must be made  before final document approvals and all recommendations, including any easements, building pad locations, and dedications, must be incorporated into the final approval documents. BE IT FURTHER RESOLVED, That building pads should be limited in forested areas and all areas outside of building pads should be incorporated into a Preservation Easement. BE IT FURTHER RESOLVED, That all easements be shown on the future-approving document so existing parcels maintain their access rights.
