PCR2006126 ./PCR2006126_files/filelist.xml RESOLUTION #PC 126-2006 Print 104 6 pt 6 pt 0 RESOLUTION #P.C.126-2006 APPROVAL OF AN AMENDMENT TO A BUILDING SITE AND OPERATION PLAN FOR A PROPERTY LOCATED IN THE NE ¼ OF SECTION 25 (TAX KEY NO. 2257.973.001 / S98 W12540 LOOMIS COURT) WHEREAS, On October 24, 2006 plans were submitted by Timothy Ziegler for a Building, Site and Operation Plan amendment for the operations of an auto body shop located in the NE ¼ of Section 25 (Tax Key No. 2257.973.001 / S98 W12540 Loomis Court), and   WHEREAS, The existing site consists of two commercial/storage buildings along with parking areas and a fenced storage area, and   WHEREAS, The petitioner is proposing to relocate their business into S98 W12540 Loomis Court, which is at the rear of the newer existing building, and   WHEREAS, The petitioner is proposing to operate their auto body repair, refinishing, and painting business that does not involve any vehicle sales, and   WHEREAS, Said use is a permitted use in the B-4, Highway Business District with a CUG and with the approval of a Building, Site and Operation Plan, and   WHEREAS, There is an existing CUG in place for Auto Service on this property, which includes body shops, and   WHEREAS, The proposed use appears to be within the allowance of the existing CUG and no formal CUG amendment should be required, and   WHEREAS, No exterior building alterations are being proposed at this time, and   WHEREAS, The petitioner is going to utilize the eight (8) existing marked parking stalls on site that are next to the proposed leased area, and   WHEREAS, No stormwater facilities will be needed since there are no added impervious surfaces, and   WHEREAS, Upon a site inspection there were three (3) U-Haul trucks parked on site near the mini-storage units along North Cape Road that are specifically not allowed, and   WHEREAS, Upon a site inspection there also were numerous vehicles that were not parked within the approved and marked stalls, which is not allowed, and   WHEREAS, All conditions and requirements of all of the prior approvals for this site still apply.   THEREFORE BE IT RESOLVED, That the Plan Commission approves of an amended Building, Site and Operation Plan submitted by Timothy Ziegler for the property located in the NE ¼ of Section 25 (Tax Key No. 2257.973.001 / S98 W12540 Loomis Court).   BE IT FURTHER RESOLVED, That any new signage will require Plan Department and/or Plan Commission approval.   BE IT FURTHER RESOLVED, That no vehicle sales can be conducted as part of the operations of this business at this site.   BE IT FURTHER RESOLVED, The all employee and customer vehicles must be parked in approved, marked parking stalls at all times.   BE IT FURTHER RESOLVED, That if all vehicles are not parked only within approved and marked parking stalls by November 13, 2006, citations will be issued.   BE IT FURTHER RESOLVED, That all U-Hauls, rental vehicles, and/or storage must still be kept within the fenced area at all times.   BE IT FURTHER RESOLVED, That if all U-Hauls are not permanently relocated to the fenced area along Loomis Court by November 13, 2006, citations will be issued.   BE IT FURTHER RESOLVED, That no outdoor storage/display of any kind shall be allowed other than what has been permitted by previous resolutions.   BE IT FURTHER RESOLVED, That if any dumpsters or refuse containers are needed on site, they must be placed and screened with an enclosure as previously approved by a prior BSO for this property.   BE IT FURTHER RESOLVED, That any ancillary signage on the property is expressly prohibited unless specifically regulated by Section 17:6.09 of the Municipal Code.   BE IT FURTHER RESOLVED, That all previous approvals for this site still apply.   BE IT FURTHER RESOLVED, That a copy of said plans be kept on file in the Building Department and that all aspect of this plan shall be maintained in perpetuity unless otherwise authorized by the Plan Commission.   BE IT FURTHER RESOLVED, That failure to comply with the approval contained in this resolution shall result in the imposition of fines of $100 per day, the initiation of legal action, or both.   Plan Commission City of Muskego Adopted:    November 7, 2006 Denied:  Deferred:    Introduced: November 7, 2006 ATTEST: Sandi Asti, Recording Secretary
