PCR2006121 ./PCR2006121_files/filelist.xml RESOLUTION #PC 121-2006 Print BestFit 6 pt 6 pt 0 RESOLUTION #P.C.121-2006 APPROVAL OF A BUILDING SITE AND OPERATION PLAN FOR MUG-Z’S PUB & GRILL LOCATED IN THE SE ¼ OF SECTION 5 (TAX KEY NO. 2180.971 / W194 S7060 HILLENDALE DRIVE) WHEREAS, On October 2, 2006 plans were submitted by Edward A. Rupp for an amendment to a Building, Site and Operation Plan for Mug-Z’s Pub & Grill located in the SE ¼ of Section 5 (Tax Key No. 2180.971 / W194 S7060 Hillendale Drive), and   WHEREAS, The petitioner is proposing to add a paved parking lot, repave the existing asphalt areas, add some new landscaping, and add a dumpster enclosure, and   WHEREAS, The site currently consists of a large gravel parking lot with no marked stalls and some limited asphalt areas that are in poor condition, and WHEREAS, Said property is zoned RS-3/OED Suburban Residence District with an Existing Development Overlay, although it is currently used commercially, the use is allowed per a Conditional Use Grant (CUG #12) that was previously granted, and   WHEREAS, The asphalted areas will have 10’ x 20’ marked stalls per the submitted site plan, and   WHEREAS, A total of 26 marked parking stalls are proposed on site, and   WHEREAS, All parking stalls appear to have the appropriate area needed for easy use and there also appears to be at least 24 feet of access around the entire lot, which will allow for two-way traffic around the parking lot, and   WHEREAS, The parking stalls will be at least ten (10) feet from the right-of-way lines, and   WHEREAS, The General Design Guide states that there should be no vehicle on a commercial lot permitted closer than 10 feet to an abutting residential lot line, and any off-street parking area should be screened with plantings and/or have a landscaped fence line at least 4 feet in height abutting the residential lot, and   WHEREAS, A letter has been submitted by the owner to the north stating that they are okay with the parking lot being closer than ten (10) feet to their adjoining lot line, and   WHEREAS, The proposal shows the parking lot being no closer than five (5) feet to the northern lot line at the front of the property, angling back to twenty-seven (27) feet from the property line towards the rear of the property, and   WHEREAS, There is existing landscaping along the northern lot line, and   WHEREAS, The parking lot will be twelve (12) feet away from the eastern lot line, and   WHEREAS, Five (5) new coniferous trees are going to be added to the eastern end of the parking lot to help screen the neighboring property, and   WHEREAS, A dumpster enclosure is being proposed along the eastern side of the parking lot that will be constructed out of wood or a composite material and painter/colored an earth tone color, and   WHEREAS, A “No Parking” marking is going to be placed on the asphalt in front of the building (west side), and   WHEREAS, Stormwater management is not needed since there is less than half an acre of impervious surfaces being added.   THEREFORE BE IT RESOLVED, That the Plan Commission approves of an amended Building, Site and Operation Plan for Mug-Z’s Pub & Grill located in the SE ¼ of Section 5 (Tax Key No. 2180.971 / W194 S7060 Hillendale Drive).   BE IT FURTHER RESOLVED, No outdoor storage of materials is allowed unless first approved by Plan Commission.   BE IT FURTHER RESOLVED, That all dumpsters must be kept within an enclosure.   BE IT FURTHER RESOLVED, Any other exterior modifications to the site or structure require Plan Commission approval.   BE IT FURTHER RESOLVED, That any asphalt that is being replaced must be replaced in the exact same location and no asphalt expansion, other than shown on the submitted plans, is allowed.   BE IT FURTHER RESOLVED, That once the asphalt work is done, all areas of the site that formerly were gravel or are disturbed, must be neatly restored with grass or vegetation   BE IT FURTHER RESOLVED, That a copy of said plans be kept on file in the Building Department and that all aspect of this plan shall be maintained in perpetuity unless otherwise authorized by the Plan Commission.   BE IT FURTHER RESOLVED, That failure to comply with the approval contained in this resolution shall result in the imposition of fines of $100 per day, the initiation of legal action, or both.   Plan Commission City of Muskego   Adopted:    October 17, 2006 Defeated: Deferred:     Introduced: October 17, 2006 ATTEST: Sandi Asti, Recording Secretary
