PCR2006108 ./PCR2006108_files/filelist.xml RESOLUTION #PC 108-2006 Print 89 6 pt 6 pt 0 RESOLUTION #P.C.108-2006 APPROVAL OF A BUILDING SITE AND OPERATION PLAN FOR THE GINGERBREAD HOUSE LOCATED IN THE NE ¼ OF SECTION 3 (TAX KEY NO. 2169.986) WHEREAS, On July 31, 2006 plans were submitted by Tracy Bohrer for a Building, Site and Operation Plan for The Gingerbread House located in the NE ¼ of Section 3, and WHEREAS, The proposed property currently has been used as single-family residence and has a principal dwelling and miscellaneous accessory structures located upon it all located on the southwest corner College Avenue and Moorland Road, and WHEREAS, The property currently has farm chickens, allowed as a legal non-conforming use, on the rear of the property, and WHEREAS, The proposal is to utilize the existing principal structure converting it to a commercial operation including a Coffee House, Bakery, and Boutique (1600 square feet of customer floor area), and WHEREAS, Said property is currently zoned BP-1 Business Park and Office Park Support District and said use is a permitted use, and WHEREAS, Said building does not meet the front setback for the BP-1 district as the district calls for buildings to have 40-foot setbacks and 20 foot offsets and the building depicted shows a 25.32-foot setback from Moorland Road making the building non-conforming, and WHEREAS, The structure is subject to only being allowed structural modifications of 50% of the structures current value during building permit applications, and WHEREAS, Said parcel will be serviced by a sewer holding tank (Approved by Waukesha County) and the existing well water facilities, and WHEREAS, Said property is within the Design Standard area of the future business park and commercial zone along Moorland Road, which promotes the use of the existing property and topography and the proposal appears to meet the intent of the guide, and WHEREAS, The principal building is an existing colonial style single-family structure and the proposal is to utilize the existing structure “as is” in order to promote Muskego’s rural heritage and “Gingerbread House” feel, and WHEREAS, The petitioner will be repainting the structure to generally match the existing colors of regal red with black and white trim, and  WHEREAS, The petitioner is adding extensive decking around the main structure and the decking will be white and will be made out of composite, and WHEREAS, Accessory structures currently exist on the lot and those are being rehabbed to match the materials and colors of the main structure, and WHEREAS, The “Existing Garage” shown on the original plat of survey is being moved to the rear southwest portion of the site and is proposed that this structure be rehabbed to be white and red like the principal dwelling, although that it be made of steel, and WHEREAS, Decorative fencing is shown on the corners of the site and around the main structure.  The fencing is to be of a vinyl material for longevity purposes. WHEREAS, All Building mechanicals, including HVAC units, are not shown but will be screened, and WHEREAS, Twelve (12) parking stalls are shown with one (1) being handicap, and said parking stalls meet the requirements for the new structure proposed of at least 1 stall per 150 square feet of customer floor area (Building has 1600 square feet of Customer Floor Area proposed which would require 10.6 parking stalls), and WHEREAS, The parking lot will be curbed throughout and the parking stalls all are shown as 20 feet by 10 feet, and WHEREAS, Pedestrian access areas are found throughout the site and a connection is found to the existing recreation trail along Moorland Road, and WHEREAS, Signage specifics have been submitted as part of the BSO and show two (2) monument signs and a proposed menu board sign, and WHEREAS, The monument signs are shown to be treated timber sandblasted signs measuring 30” x 55” in size (11.25 square feet) and Code allows up to 30 square feet per sign, and WHEREAS, The narrative pictures show that a drive thru menu sign will be located south of the main structure along the drive thru lane, and  WHEREAS, Pole lights are shown on the site plan although no photometric plans and lighting specifics have been submitted as part of the BSO, and WHEREAS, Landscaping is shown on the site plan although landscaping throughout is not shown, and  WHEREAS, No additional stormwater is required for the area as less than a half acre of surface is being added to the site, and WHEREAS, A dumpster enclosure is proposed to house all refuse containers on the southwest corner of the site and said enclosure is proposed to be constructed with materials and colors compatible with the design of the building. THEREFORE BE IT RESOLVED, That the Plan Commission approves of the Building, Site and Operation Plan submitted May 23by Tracy Bohrer for The Gingerbread House located in the NE ¼ of Section 3. BE IT FURTHER RESOLVED, That outdoor sales or storage is restricted to what is approved per the resolution and further outdoor sales must receive Plan Commission approval. BE IT FURTHER RESOLVED, That all accessory structures should utilize similar materials (Wood, vinyl) and have the same color scheme as the principal structure.  Any new steel structure is prohibited in order to preserve the cohesiveness of the site. BE IT FURTHER RESOLVED, Delivery of photometric plans and lighting specifics meeting current Muskego design guidelines are required before building permits can be released. BE IT FURTHER RESOLVED, That the legal non-conforming use of having farm chickens on the rear of the property is allowed as long as the use is not expanded and kept in a reasonable condition, and BE IT FURTHER RESOLVED, The resolution is subject to Planning Department review and approval of the actual menu board before building permit release in order to make sure the sign is cohesive with the rest of the development. BE IT FURTHER RESOLVED, That the resolution is subject to a full landscaping plan being delivered to the Planning Department for City Forester approval before final development of the site is complete and plantings around the asphalt areas and around the sign bases should be shown. BE IT FURTHER RESOLVED, That all rooftop and ground mechanicals shall be screened from view. BE IT FURTHER RESOLVED, That any additional signage will require Plan Department approval. BE IT FURTHER RESOLVED, All handicap signage shall be bored into the curb and any bollards supporting the signs shall be painted to match the structure. BE IT FURTHER RESOLVED, That all bollards or other miscellaneous equipment on the site shall be painted to match the structure. BE IT FURTHER RESOLVED, That a copy of said plans be kept on file in the Building Department and that all aspect of this plan as they relate to landscape areas and drainage shall be maintained in perpetuity unless otherwise authorized by the Plan Commission. BE IT FURTHER RESOLVED, That if occupancy is requested prior to the completion of landscaping and/or asphalting, a bond, letter of credit or cashiers check equal to twice the value of said costs must be submitted to the Planning Department. BE IT FURTHER RESOLVED, That failure to comply with the approval contained in this resolution shall result in the imposition of fines of $100 per day, the initiation of legal action, or both.
