PCR2006106 ./PCR2006106_files/filelist.xml RESOLUTION #PC 106-2006 Print 86 6 pt 6 pt 0 AMENDED RESOLUTION #P.C.106-2006 APPROVAL OF AN AMENDMENT TO A BUILDING SITE AND OPERATION PLAN FOR J & O TRUCKING LOCATED IN THE SE ¼ OF SECTION 17 (TAX KEY NO. 2228.999.016 / S83 W19021 SATURN DRIVE) WHEREAS, On July 14, 2006 plans were originally submitted by John & Susan Jewell for a Building, Site and Operation Plan amendment for J & O Trucking for a property located in the SE ¼ of Section 17 (Tax Key No. 2228.999.016 / S83 W19021 Saturn Drive), and   WHEREAS, On October 2, 2006 a revised site plan and a letter was submitted, and   WHEREAS, Said use is a permitted use in the I-1, Industrial Park District by right with the approval of a Building, Site and Operation Plan, and   WHEREAS, In the past the site was used by G & G Trucking and the site contained undefined parking and random unenclosed outdoor storage, and   WHEREAS, Olson’s Outdoor Power Equipment received approvals in 2005 to use this site for their sales and service of lawn equipment, but they ended up choosing a different location for their business, and   WHEREAS, J & O Trucking has recently been using the site for the operation of their grading and trucking business, which includes the storage of their grading and trucking equipment unscreened on site, and   WHEREAS, No exterior building alterations are proposed at this time, and   WHEREAS, Most of the site is gravel with a limited asphalt area at the entry of the site and for some parking, but the site plan does not indicate which areas of the site are comprised of each material, and   WHEREAS, The site plan shows eight (8) employee parking stalls on site that are on asphalt, located at least ten (10) feet from the right-of-way, some of which are within the public right-of-way, and   WHEREAS, The General Design Guide and the Zoning Code state that any parking areas on commercial/industrial parcels need to be at least 10 feet away from the public right-of-way, and   WHEREAS, The parking stalls shown on the site plan do not all meet the 10’ x 20’ required size, and   WHEREAS, The plan of the petitioner is to store their vehicles and equipment within a partially fenced area, unscreened, but within designated parking locations on site, and   WHEREAS, No fencing or screening is proposed Screening for the storage of the vehicles and equipment on site is as typically required by the Planning Commission and the General Design Guide, and   WHEREAS, A six (6) foot tall chain link (steel cyclone) fence with green privacy slats is being proposed along the western, southern, eastern, and part of the northern lot lines, and   WHEREAS, There is an existing berm with dense coniferous vegetation along a portion of the front lot line, and   WHEREAS, The grass area next to the berm will be expanded to the west to narrow the view into the screened storage area, and   WHEREAS, The only portion of the storage area that will be visible will be the 45 foot wide entry to the storage area, and   WHEREAS, Said parcel will be serviced by municipal sanitary sewer and municipal water, and   WHEREAS, No signage is being proposed at this time, and   WHEREAS, No outdoor product sales are being proposed at this time, and   WHEREAS, No stormwater facilities will be needed since the added impervious surface will be less than half an acre, per the City Engineering Department.   THEREFORE BE IT RESOLVED, That the Plan Commission approves of an amended Building, Site and Operation Plan for J & O Trucking located in the SE ¼ of Section 17 (Tax Key No. 2228.999.016 / S83 W19021 Saturn Drive).   BE IT FURTHER RESOLVED, That any new signage will require Plan Department and/or Plan Commission approval.   BE IT FURTHER RESOLVED, That all of the outdoor storage should be fenced with a solid type fencing (i.e. cedar fencing or chain-link fencing with privacy slats).   BE IT FURTHER RESOLVED, That due to the unscreened entry area, the items within the storage area should be neatly placed in an organized fashion per the submitted site plan.   BE IT FURTHER RESOLVED, The expanded vegetation area to the west of the existing berm should include a few additional conifer trees to help further screen the storage area from the front and narrow/limit the view into the storage area.   BE IT FURTHER RESOLVED, That all employee/customer parking stalls must be on an asphalt/concrete surface, located at least 10 feet away from the public right-of-way, and striped at 10’ x 20’ in size.   BE IT FURTHER RESOLVED, That other ancillary signage on the property is expressly prohibited unless specifically regulated by Section 17:6.09 of the Municipal Code.   BE IT FURTHER RESOLVED, No unscreened outdoor storage shall be allowed on site.   BE IT FURTHER RESOLVED, That a copy of said plans be kept on file in the Building Department and that all aspect of this plan shall be maintained in perpetuity unless otherwise authorized by the Plan Commission.   BE IT FURTHER RESOLVED, That failure to comply with the approval contained in this resolution shall result in the imposition of fines of $100 per day, the
