RECOMMENDATION TO COMMON COUNCIL FOR APPROVAL OF A 2010 COMPREHENSIVE MAP AMENDMENT FROM RURAL DENSITY RESIDENTIAL TO MEDIUM DENSITY RESIDENTIAL AND A PRELIMINARY PLAT FOR THE FENWICK
ESTATES SUBDIVISION LOCATED IN THE SW ¼ OF SECTION 31 (TAX KEY Nos. 2283.999.002 and 2283.999.001) / CROWBAR DRIVE)
WHEREAS, On August 15, 2006 a preliminary plat was submitted by Kaestner-Kinert Properties, LLC for the Fenwick Estates Subdivision located in the SW ¼ of Section 31, and
WHEREAS, Said plat proposes 40 lots for single-family use and a number of outlots for wetland preservation, stormwater management, and open space preservation, and
WHEREAS, The area of the proposed development is currently zoned predominantly RS-2 Suburban Residential District and SW Shoreland Wetland District (Along the lakeside frontage), and
WHEREAS, The RS-2 Suburban Residential Zoning District allows lots sizes of a minimum 20,000 square feet in size and a minimum 110 feet in width, and
WHEREAS, The RS-2 Suburban Residential Zoning District does not have a maximum requirement for lot sizes and widths, and
WHEREAS, The proposal is dependent on receiving a 2010 Plan Map Amendment from Rural Density Residential to Medium Density Residential as WI State Statute 236.13 states that an approval
of a preliminary or final plat shall be conditioned upon meeting the City’s Comprehensive Plan and the City’s Land Division Ordinance 18.20(2) also states that land divisions must
comply with the Comprehensive Plan for the City, and
WHEREAS, Parcels are shown to be serviced by City sewer and a private community well water system, and
WHEREAS, Stormwater management would be accommodated within the outlots depicted.
THEREFORE BE IT RESOLVED, That the Plan Commission recommends approval to the Common Council of a 2010 Comprehensive Map Amendment from Rural Density Residential to Medium Density
residential Uses and a Preliminary Plat for the Fenwick Estates Subdivision, located in the SW ¼ of Section 31 and will be receptive to the submittal of a final plat, subject to resolution
of technical discrepancies as identified by the City Planning Department and City Engineers, and payment of all applicable fees in Section 18.14 of the Land Division Ordinance and
outstanding assessments if applicable.
BE IT FURTHER RESOLVED, That all Planning and Engineering comments must be addressed before the submittal of a formal Final Plat.
BE IT FURTHER RESOLVED, That the construction plans should show engineering of the stormwater for the development to flow away from the lake if possible.
BE IT FURTHER RESOLVED, That Conservation Commission recommendations of dedicating the lake frontage lands to the City must be accomplished before the submittal of a formal Final Plat.
BE IT FURTHER RESOLVED, That a digital file of this Plat shall be submitted to the City in accordance with Common Council Ordinance No. 1118 and Resolution 196-2002.
