PCR2006096 ./PCR2006096_files/filelist.xml RESOLUTION #PC 096-2006 Print BestFit 6 pt 6 pt 0 RESOLUTION #P.C.132-2006 APPROVAL OF AN AMENDMENT TO THE BUILDING SITE AND OPERATION PLAN FOR C.I. BANKER WIRE AND IRON WORKS LOCATED IN THE SE ¼ OF SECTION 17 (TAX KEY NO. 2228.999.005 / S84 W19120 ENTERPRISE DRIVE) WHEREAS, On June 29, 2006 plans were submitted by the Anderson Ashton, Inc. for C.I. Banker Wire and Iron Works for an amendment to the Building, Site and Operation Plan for property located in the SE ¼ of Section 17 (S84 W19120 Enterprise Drive  / Tax Key No. 2228.999.005), and WHEREAS, Said property is zoned I-1 Industrial Park District, and said use is a permitted use by right subject to Building Site and Operation Plan approvals, and   WHEREAS, Petitioner was approved to construct a 12,000 square-foot addition to the front of the existing building under #P.C. 029-2006, and   WHEREAS, The currently approved fire street is along the west side of the building, and   WHEREAS, The petitioner is now requesting to relocate the fire street along the front of the building which will require them to shift their front parking lot five (5) feet away from the right-of-way line, and   WHEREAS, The General Design Guide and the Zoning Code both require a ten (10) foot setback from any right-of-way lines for any commercial or industrial parking, and   WHEREAS, The Planning Department has received a letter from the Fire Department stating that they are in favor of the fire street being along the front of the building, rather than on the side of the building, and   WHEREAS, The Fire Department has also stated that the fire streets location in front of the building is the safest condition that can occur since it provides multiple access points to the building along the entire length of the building, and   WHEREAS, The Zoning Board of Appeals would need to grant a variance allowing the five (5) foot setback from the right-of-way line, and   WHEREAS, The most recent BSO amendment approved under #P.C. 029-2006 did not allow any unscreened outdoor storage, and   WHEREAS, During the Building Permit process the petitioner agreed to install an eight (8) foot high chain link fence with privacy slats as a condition of their building permit, and   WHEREAS, All outside storage including, but not limited to, pallets, lugger boxes, wire stems, and dumpster bins were required to be stored within the screened area, and   WHEREAS, The petitioner is requesting to remove the screening stating that snow removal could be difficult if the fencing was in place and also stating that the fencing would not provide any additional screening than what the natural screening does already, and   WHEREAS, Typically, the Planning Commission does not allow unscreened outdoor storage on new or updated BSO’s per the General Design Guide, and WHEREAS, The existing landscaping to the south of the storage area screens only from a few select views and leaves a lot of outdoor storage being visible, especially from the driveway leading to the outdoor storage area, and   WHEREAS, The trees along the western lot line do provide screening but are deciduous and may loose their screening potential during the fall and winter months.   THEREFORE BE IT RESOLVED, That the Plan Commission approves of an amended Building, Site and Operation Plan for C.I. Banker Wire and Iron Works located in the SE ¼ of Section 17 (S84 W19120 Enterprise Drive  / Tax Key No. 2228.999.005).   BE IT FURTHER RESOLVED, That all of the required fire street/lane signage and pavement markings must be in place before occupancy can be granted for the use of the addition.   BE IT FURTHER RESOLVED, That the Zoning Board of Appeals must grant a variance to allow the five (5) foot setback from the right-of-way in order for the parking lot to be able to be shifted/relocated.   BE IT FURTHER RESOLVED, The fencing must remain in order to screen the outdoor storage and refuse containers.   BE IT FURTHER RESOLVED, Slight modifications may be allowed to be made to the location of the fencing to allow for snow storage if updated plans are submitted to and approved by the Planning Department.   BE IT FURTHER RESOLVED, All outside storage including, but not limited to, pallets, lugger boxes, wire stems, and dumpster bins must be stored within the screened fence area.   BE IT FURTHER RESOLVED, That all other conditions of #P.C. 029-2006 and all conditions of the issued Building Permit are still in effect. BE IT FURTHER RESOLVED, That a copy of said plans be kept on file in the Building Department and that all aspect of this plan shall be maintained in perpetuity unless otherwise authorized by the Plan Commission.   BE IT FURTHER RESOLVED, That failure to comply with the approval contained in this resolution shall result in the imposition of fines of $100 per day, the initiation of legal action, or both.   BE IT FURTHER RESOLVED, That petitioner will submit a detailed landscape plan to be approved by the City Forester and Plan Commission.   BE IT FURTHER RESOLVED, That a detailed landscape plan under separate resolution will be submitted for approval by the first Plan Commission meeting in September, 2006.  Plan Commission City of Muskego Adopted:    Defeated: Deferred: Introduced: December 5, 2006 ATTEST: Sandi Asti, Recording Secretary
