APPROVAL OF AN AMENDMENT TO A BUILDING SITE AND OPERATION PLAN FOR THE WILLOW PONDS APARTMENTS LOCATED IN THE SW ¼ OF SECTION 9 (TAX KEY NOs. 2195.981.002, 2195.981.004, & 2195.981.006
/ LIONS PARK DRIVE)
WHEREAS, On May 19, 2006 plans were submitted by Phillips, Milewski & Associates, Inc. for a Building, Site and Operation Plan amendment for the Willow Pond Apartments located in
the SW ¼ of Section 9 (Tax Key Nos. 2195.981.002, 2195.981.004, & 2195.981.006 / Lions Park Drive), and
WHEREAS, Update plans were submitted on June 19, 2006 plans by Phillips, Milewski & Associates, Inc., and
WHEREAS, The amendment is to add four (4) new garage structures and add onto an existing garage structure within to the existing multi-family site, and
WHEREAS, Said use is a permitted use in the RSM, Multi-Family Residential District by right with the approval of a Building, Site and Operation Plan, and
WHEREAS, The petitioner proposes a four (4) and an eight (8) car garage on parcel number 2195.981.006, a ten (10) car garage and a 2 car addition on parcel number 2195.981.002, and
a twelve (12) six (6) car garage on parcel number 2195.981.004, and
WHEREAS, All structures will match the existing materials and style of the garages that currently exist on the site consisting of vinyl siding and trim, asphalt shingles, aluminum
overhead doors, and aluminum soffits and trim, and
WHEREAS, The proposal meets the setbacks and offsets of the RSM zoning District although some environmental lands may need to be accounted for, and
WHEREAS, The proposal meets the setbacks and offsets of the RSM Zoning District with the exception of the 12-car structure (Doesn’t meet the 40 foot front setback requirement) and
the 8-car garage (Doesn’t meet the side yard offset), and
WHEREAS, The 12-car structure completely blocks the principal structure along Lions Park Drive, and
WHEREAS, Some environmental lands may need to be accounted for, and
WHEREAS, The site has exposed dumpster enclosures at this time, and
WHEREAS, No stormwater facilities will be needed since there are no added impervious surfaces.
THEREFORE BE IT RESOLVED, That the Plan Commission approves of an amended Building, Site and Operation Plan submitted by Phillips, Milewski & Associates, Inc. for Willow Ponds Apartments
located in the SW ¼ of Section 9 (Tax Key No. Tax Key Nos. 2195.981.002, 2195.981.004, & 2195.981.006 / Lions Park Drive).
BE IT FURTHER RESOLVED, That building permit applications will have to show wetlands and floodplains on a survey to make sure no environmental features are being impacted by the proposed
garages.
BE IT FURTHER RESOLVED, That the overall properties are kept up nicely, however, no dumpster enclosures exist. The developer should deliver plans as to how the dumpster areas will
be screened before building permits can be issued for the garages.
BE IT FURTHER RESOLVED, That The buildings proposed on the southwest lot has environmental features near and building permit applications will have to show wetlands and floodplain
in this area to make sure no environmental feature is being impeded.
BE IT FURTHER RESOLVED, That the proposed 10-car garage and addition to a garage on the northwest parcel will need a grading plan and possible additional landscaping during the time
of building permits as steeper slopes exist toward the northern end of the area.
BE IT FURTHER RESOLVED, That the 8-car structure proposed on the southwest lot doesn’t meet the offset requirement of 20 feet. The petitioner will have to petition the Board of Appeals
or Quit Claim Deed more property (Since they own the adjacent lot) before building permits can be issued for this structure.
BE IT FURTHER RESOLVED, That the 12-car garage structure proposed on the northeast central lot doesn’t meet the setback requirement of 40 feet. Further, the placement of this garage
structure is not conducive to the aesthetics of the rest of the site. The 12 car garage is not approved as part of this resolution, however a 6 car garage, off to the side of the
principal structure and meeting the setbacks/offsets (As shown in a previous submittal) is approved.
BE IT FURTHER RESOLVED, That building permit applications will have to show wetlands and floodplains on a survey to make sure no environmental features are being impacted by the proposed
garages.
BE IT FURTHER RESOLVED, That a copy of said plans be kept on file in the Building Department and that all aspect of this plan shall be maintained in perpetuity unless otherwise authorized
by the Plan Commission.
BE IT FURTHER RESOLVED, That failure to comply with the approval contained in this resolution shall result in the imposition of fines of $100 per day, the initiation of legal action,
or both.
