RESOLUTION #P.C.077-2006
APPROVAL OF AN AMENDMENT TO A BUILDING SITE AND OPERATION PLAN FOR A PROPERTY LOCATED IN THE NW ¼ OF SECTION 10
(TAX KEY NO. 2198.984.001 / JANESVILLE ROAD)
WHEREAS, On May 5, 2006 plans were submitted by Muskego Partners LLC for a Building, Site and Operation Plan amendment for the retail/office structure located in the NW ¼ of Section
10 (Tax Key No. 2198.984.001 / Janesville Road), and
WHEREAS, The existing site consists of a retail/commercial building along with parking areas, and
WHEREAS, The petitioner is proposing to remodel/alter the northwestern corner of their existing building, and
WHEREAS, Two new tenant spaces for retail/office uses are being requested to be constructed within the interior of the existing building, and
WHEREAS, Said use is a permitted use in the B-4/OPD/OWP, Highway Business District with a Planned Development Overlay with a Wellhead Protection Overlay by right with the approval
of a Building, Site and Operation Plan, and
WHEREAS, The building currently houses the Muskego Post Office, Sherwin Williams, and Blockbuster, and
WHEREAS, The petitioner is going to add a new entry door and full length storefront windows to the western facade of the building along with an overhead canopy, and
WHEREAS, An overhead door will be removed from the northern facade of the building and a new storefront window unit will be added along with two (2) new hollow metal doors, and
WHEREAS, The area under the new window unit on the northern facade will be filled in brick to match the existing building, and
WHEREAS, There are nine (9) parking stalls shown on the plans for the proposed units, and
WHEREAS, All of the existing parking markings in this area as worn out and extremely hard to see, and
WHEREAS, There currently are two dumpsters and a smaller refuse bin unscreened on the west side of the building and there are three dumpsters unscreened on the north side of the building,
and
WHEREAS, Said parcel will be serviced by municipal sanitary sewer and municipal water, and
WHEREAS, No stormwater facilities will be needed since there are no added impervious surfaces.
THEREFORE BE IT RESOLVED, That the Plan Commission approves of an amended Building, Site and Operation Plan submitted by Muskego Partners LLC for the property located in the NW ¼ of
Section 10 (Tax Key No. 2198.984.001 / Janesville Road).
BE IT FURTHER RESOLVED, That any new signage will require Plan Department and/or Plan Commission approval.
BE IT FURTHER RESOLVED, That the parking area for the new units must be re-striped before occupancy can be granted for the units.
BE IT FURTHER RESOLVED, That all of the dumpsters on the site must be screened within an enclosure and details for the enclosure, including exact location and materials, must be submitted
to and approved by the Planning Department.
BE IT FURTHER RESOLVED, That the construction of the enclosure must be completed before occupancy can be granted for the new units.
BE IT FURTHER RESOLVED, That the new metal door on the north side of the building must be painted to match the building color.
BE IT FURTHER RESOLVED, That any ancillary signage on the property is expressly prohibited unless specifically regulated by Section 17:6.09 of the Municipal Code.
BE IT FURTHER RESOLVED, That no outdoor storage/display of any kind shall be allowed.
BE IT FURTHER RESOLVED, That a copy of said plans be kept on file in the Building Department and that all aspect of this plan shall be maintained in perpetuity unless otherwise authorized
by the Plan Commission.
BE IT FURTHER RESOLVED, That failure to comply with the approval contained in this resolution shall result in the imposition of fines of $100 per day, the initiation of legal action,
or both.
