PCR2006071a ./PCR2006071a_files/filelist.xml RESOLUTION #PC 071-2006 Print 89 6 pt 6 pt 0 AMENDED RESOLUTION #P.C.071-2006 APPROVAL OF BUILDING SITE AND OPERATION PLAN AND CONDITIONAL USE GRANT FOR A GASOLINE SERVICE STATION LOCATED IN THE NE ¼ OF SECTION 25 (NORTH CAPE ROAD / TAX KEY NO. 2167.995.011) WHEREAS, On April 12, 2006 plans were submitted by Zabest Commercial Group for a Building, Site and Operation Plan and Conditional Use Grant for a gasoline service station located in the NE ¼ of Section 25, and WHEREAS, Said property is currently zoned B-4 Highway Business District, and said use is a permitted use by Conditional Use Grant, and WHEREAS, Said parcels will be serviced by public sewer and water facilities, and WHEREAS, Said property is subject to the design standards outlined in the City of Muskego’s Durham Hill Design Guide, and WHEREAS, The petitioner requests approval for a 3,000 square foot principal structure housing a convenience store, a gasoline pump canopy with five pumps, and a 990 square foot 1-bay car wash, and said structures meet the floor area and height requirements of the zoning ordinance, and WHEREAS, Said structures are proposed to be constructed with rural and agrarian architectural influences, and are proposed to be constructed with exterior materials which include a standing seam roof, standing seam awnings, 8” Hardiplank trim, 6” Hardiplank siding, cultured stone, anodized aluminum store fronts, corrugated metal accents, and treated architectural wood elements, and WHEREAS, The canopy elevations are also shown in the supplement matching the architecture and style of the principal structure with masonry product and a cupola, and WHEREAS, All Building mechanicals, including HVAC units, are proposed to be screened from view, and WHEREAS, Twenty (20) parking stalls are proposed around the main structure, and said number of parking stalls conforms to zoning requirements, and the stall size is indicated to be 10’ x 20’, and WHEREAS, Twelve (12) vehicles are shown around the gas dispensing units which allows for stacking of more than one vehicle at a time, and WHEREAS, Access is restricted to this property by Waukesha County to the point directly across from the Champion’s Village Subdivision entrance and no access is permitted to STH 36, and WHEREAS, The location of the main gas tanks may impede traffic flow on the site, and WHEREAS, Signage specs have not been submitted but will have to receive the proper approvals and meet ordinances before building permits are approved, and WHEREAS, With regards to specific operations, the Moorland Corridor South Design Guide places great emphasis on exterior appearances, and that the Plan Commission has prohibited outdoor sales and storage of goods in past approvals of a similar nature, and WHEREAS, Lighting details have now been provided in the plan set in the form of a photometric plan and lighting specifics and the photometric plan shows conformance to the City’s guideline of 0.5 foot-candles at the property lines with minor interruptions, and WHEREAS, The lighting is discussed to be the following: ·         6 15-foot high Lumec Domus Series, 150 watt, 120-volt High Pressure Sodium ballast pole lights containing a total of eight fixtures are found illuminating the site; The light will have a trim with a teardrop bulb; ·         27 Exceline architectural 150-watt tungsten halogen lamps are found along the roofline illuminating the roof pitches; ·         20 Kichler Outdoor architectural Wall Sconces are found along the outside of the main structure; ·         One wallpack metal halide light is found illuminating a service door on the south elevation; ·         5 400 watt recessed lamps will supply light to the canopy area.  The lights are metal halide but will restrict light to the canopy area only, and WHEREAS, A landscaping plan has been submitted and approved by the City Forester, and WHEREAS, The station would be open from 5 am to 12 am daily with 3-4 employees at any one time and the developer requests that if business demands, they would like to have the ability to extend hours as need be, and WHEREAS, With regards to specific operations, the Plan Commission has historically limited car wash operations, and WHEREAS, A dumpster enclosure is proposed to house all refuse containers in an area screened from view along the north side of the main structure, and said enclosure is proposed to be constructed with materials compatible with the design of the building. THEREFORE BE IT RESOLVED, That the Plan Commission approves of the Building, Site and Operation Plan and Conditional Use Grant by Zabest Commercial Group for a gasoline service station and car wash located in the NE ¼ of Section 25. BE IT FURTHER RESOLVED, That the developer install traffic improvements to North Cape Road as recommended by the City Engineer and Waukesha County.  Any Developer’s Agreements must be executed before this may begin and occupancy may not be given to the development until all road improvements are complete. BE IT FURTHER RESOLVED,  This resolution approves the Conditional Use Grant for the property to operate a gasoline service station and any new approvals for the site may include further Conditional Use Grant public hearings as determined by the Planning Director. BE IT FURTHER RESOLVED, That the Plan Commission finds the proposed architecture to conform to requirements outlined in the Durham Hill Design Guide North. BE IT FURTHER RESOLVED, That all rooftop and ground mechanicals shall be screened from view. BE IT FURTHER RESOLVED, That a semi-fueling plan be delivered to the Planning Department for review and approval before building permits are given as the gas tank areas may have to be moved to accommodate better traffic flow. BE IT FURTHER RESOLVED, All handicap signage shall be bored into the curb and any bollards supporting the signs shall be painted to match the structure. BE IT FURTHER RESOLVED, That all bollards or other miscellaneous equipment on the site shall be painted to match the structure. BE IT FURTHER RESOLVED, There is one area of interruption in the photometric plan along North Cape Road over 0.5 foot-candles, but the right-of-way will be unaffected by this. BE IT FURTHER RESOLVED, All pole lights will be required to only have a 6-inch bollard base exposure as per the design guides. BE IT FURTHER RESOLVED, That outdoor sales shall be expressly prohibited on the property; including, but not limited to, vending machines, LP, and palettes of various products (water softener salt, soda, etc.).  BE IT FURTHER RESOLVED, That due to the location along a major highway and the extensive shielding of the business activities the site plan shows, Plan Commission will not regulate the hours of operation of the facility unless problems arise.  However, the carwash operation shall be prohibited between the hours of 11 10 pm and 6 am and the carwash doors must be closed during any operation.BE IT FURTHER RESOLVED, That all car wash operations shall occur with all doors closed during wash and blower operatio BE IT FURTHER RESOLVED, That a copy of said plans be kept on file in the Building Department and that all aspect of this plan as they relate to landscape areas and drainage shall be maintained in perpetuity unless otherwise authorized by the Plan Commission. BE IT FURTHER RESOLVED, That if occupancy is requested prior to the completion of landscaping and/or asphalting, a bond, letter of credit or cashiers check equal to the value of said costs must be submitted to the Planning Department and the fees can be used to have the installation of the landscaping take place if the developer defaults. BE IT FURTHER RESOLVED, That failure to comply with the approval contained in this resolution shall result in the imposition of fines of $100 per day, the initiation of legal action, or both.
