APPROVAL OF BUILDING SITE AND OPERATION PLAN AMENDMENT AND CONDITIONAL USE GRANT FOR R.D. MEYER & ASSOCIATES, INC. LOCATED IN THE NE ¼ OF SECTION 2
(W145 S6550 TESS CORNERS DRIVE / TAX KEY NO. 2165.998.012)
WHEREAS, Plans were submitted on April 6, 2006 by Steve Meyer of R.D. Meyer & Associates, Inc. for a Building, Site and Operation Plan Amendment and Conditional Use Grant for mini-warehouse
storage at the property located in the Tess Corners Industrial Park in the NE ¼ of Section 2 (W145 S6550 Tess Corners Drive / Tax Key No. 2165.998.012), and
WHEREAS, New elevation drawings of the proposed storage buildings and a revised site plan were submitted on August 3, 2006 per comments from the Fire Department and the Planning Department,
and
WHEREAS, There currently is an existing 17,500 square foot commercial/industrial building at the front of the property along with a large parking area, and
WHEREAS, Said property is currently zoned B-3 General Business District, and said use is a permitted use with the approval of a Conditional Use Grant for mini-warehouse storage, and
WHEREAS, The proposal appears to conform to the bulk requirements of the zoning district, and
WHEREAS, A Conditional Use Grant has been applied for the use of mini-warehouse storage units within the B-3 General Business zoning district and a public hearing was held before the
Planning Commission on May 16, 2006, and
WHEREAS, No comments where received at the Public Hearing, and
WHEREAS, The petitioner is proposing to construct two mini-warehouse storage buildings consisting of a 12,000 square-foot “U” shaped building on the rear (eastern) portion of the
property and a 2,800 square-foot building within the center of the “U” shaped building, and
WHEREAS, The 12,000 square-foot “U” shaped building will contain fifty-four (54) units measuring 10’ x 20’, one (1) unit measuring 30’ x 20’, and one (1) unit measuring 20’ x 27’,
and
WHEREAS, The 2,800 square-foot center building will contain fourteen (14) units measuring 10’ x 20’, and
WHEREAS, The existing structure is comprised of a light blue painted cinder block band on the bottom of the building with light gray metal on the upper portion of the walls and with
a low pitched metal roof, and
WHEREAS, The west exterior elevations of the proposed buildings are shown to have a 4 foot high band of stone face CMU block painted to match the existing building along the bottom
of the elevation along with 26 gauge Dura-Rib metal wall system on the remainder of the elevation that must match the color of the existing building, and
WHEREAS, About 44%-47% of the western exterior elevations are comprised of masonry products, and
WHEREAS, The north, east, and west exterior elevations along with all of the interior elevation, are comprised of all the 26 gauge Dura-Rib metal wall system, and
WHEREAS, The new buildings do not meet the 50% masonry requirement for a commercial structure per the City’s General Design Guide and the Tess Corners Design Guide, and
WHEREAS, Parking is ample since the nature of the business will not require many designated parking stalls and there is enough parking existing on the site, and
WHEREAS, There are two existing light poles on site and the petitioner is proposing to remove one of the light poles and relocate the other light pole to the center of the “U” shaped
building, and
WHEREAS, No specific signage changes are proposed at this time and any future changes need the approval of the Planning Department, and
WHEREAS, A landscape plan has been submitted showing the removal of the scrub shrubs and tree and the addition of grass and some new shrubs and trees, and
WHEREAS, The petitioner has indicated that they will be repairing and sealing the existing asphalt areas on the site and they will be asphalting the new travel surfaces of the site
as well.
WHEREAS, The petitioner is proposing a six (6) foot high chain link fence without slatting to enclose the storage area, and
WHEREAS, One section of the fence will include a thirty (30) foot automatic gate for access to the storage area, and
WHEREAS, No outdoor storage is being proposed with the exception of the existing vehicles related to the former food business, and
WHEREAS, There was miscellaneous debris around the dumpster on the north side of the building, and
WHEREAS, No new dumpster are proposed at this time, and
WHEREAS, Stormwater management may need to occur if more than half an acre of impervious surfaces are added and the petitioner may have to install a stormwater pond or possibly buy
into the pond to the east of this property.
THEREFORE BE IT RESOLVED, That the Plan Commission approves of the Building, Site and Operation Plan Amendment and Conditional Use Grant for R.D. Meyer & Associates, Inc, for mini-warehouse
storage units at the property located in the Tess Corners Industrial Park in the NE ¼ of Section 2 (W145 S6550 Tess Corners Drive / Tax Key No. 2165.998.012).
BE IT FURTHER RESOLVED, That the north, east, and south exterior elevation should have a four (4) foot masonry band along the base of the building to match the existing building and
the western elevation of the new buildings.
BE IT FURTHER RESOLVED, That the interior elevation can be allowed to remain all metal due to the limited surface area and the limited visibility.
BE IT FURTHER RESOLVED, That all colors of the new buildings must match the colors of the existing building.
BE IT FURTHER RESOLVED, The Engineering Department should be contacted to help determine the need for stormwater management for the site before the time of building permits and may
require the petitioner to install a stormwater facility or to buy into the existing pond to the east of this site.
BE IT FURTHER RESOLVED, That additional landscaping should be added to the landscape plan for the eastern part of the site and the revised plan must be approved by the City Forester
prior to the issuance of Building Permits, and
BE IT FURTHER RESOLVED, If the storage area is going to have any operating hours when it is dark outside, then proper lighting meeting the design guide requirements will be required
for the redeveloped area of the site and the lighting details along with a photometric plan will need to be submitted to the Planning Department for review before building permit
can be issued.
BE IT FURTHER RESOLVED, That all tenants or customers should use the main entry driveway, not the northern entry driveway.
BE IT FURTHER RESOLVED, That if any new/additional dumpsters are sought, plans will need to be submitted to and approved by the Planning Department and/or Plan Commission to have their
location and elevations approved.
BE IT FURTHER RESOLVED, That if any problems or concerns arise regarding the dumpsters, they then may be required to be screened.
BE IT FURTHER RESOLVED, That no mechanicals are shown to adorn the roof and if any are required they must be screened from view and colored to match the principal structure.
BE IT FURTHER RESOLVED, That no businesses should be run from the mini-storage units.
BE IT FURTHER RESOLVED, That occupancy of the new buildings may still be granted if the asphalting has not yet been completed due to seasonal concerns and then the asphalting must
be completed as soon as the climate allows.
BE IT FURTHER RESOLVED, That the final site layout is subject to review and approval by the Fire Department before any building permits can be issued.
BE IT FURTHER RESOLVED, That a yearly review be held no later than the second meeting in March of every calendar year.
BE IT FURTHER RESOLVED, That a copy of said plans be kept on file in the Building Department and that all aspect of this plan as they relate to landscape areas and drainage shall
be maintained in perpetuity unless otherwise authorized by the Plan Commission.
BE IT FURTHER RESOLVED, That if occupancy is requested prior to the completion of landscaping and/or asphalting, a bond, or cashiers check equal to twice the value of said costs must
be submitted to the Planning Department.
BE IT FURTHER RESOLVED, That failure to comply with the approval contained in this resolution shall result in the imposition of fines of $100 per day, the initiation of legal action,
or both.
