PCR2006068 ./PCR2006068_files/filelist.xml RESOLUTION #P.C. 068-2006 Print BestFit 6 pt 6 pt 0 RESOLUTION #P.C. 068-2006 APPROVAL OF A TWO (2) LOT CERTIFIED SURVEY MAP AND RECOMMENDATION TO COUNCIL FOR A REZONING FROM EA/OD EXCLUSIVE AGRICULTURAL DISTRICT WITH A DUPLEX OVERLAY DISTRICT TO A AGRICULTURAL DISTRICT FOR THE LANG PROPERTY LOCATED IN THE NW ¼ OF SECTION 29 (PARKER DRIVE / TAX KEY NO. 2270.999) WHEREAS, On April 20, 2006 a Certified Survey Map for a two (2) lot land division and a petition for a rezoning was submitted for the Lang property located in the NW ¼ of Section 29, (Parker Drive / Tax Key No. 2270.999), and WHEREAS, The proposed land division would create two (2) lots meeting the A Agricultural zoning requirements of 2.75 acre minimums and 300 foot width minimums, and WHEREAS, Said property is zoned EA/OD Exclusive Agricultural District with a Duplex Overlay District, requiring minimum lot sizes of 35 acres and average minimum widths of 1275 feet and requires a rezoning for a land division to A Agricultural, requiring a minimum lot size of 2.75 acres and an average minimum width of 300 feet to permit said land division, and WHEREAS, The 2010 Comprehensive Plan depicts this area as being set aside for Rural Density Residential land use consistent with the proposed rezoning and land division, and WHEREAS, Said parcels will be serviced by private sanitary sewer and private water, and   WHEREAS, No right of way dedications are required as part of this CSM, and   WHEREAS, A Public Hearing for the rezoning was held in front the Common Council on May 23, 2006.   THEREFORE BE IT RESOLVED, That the Plan Commission approves of a Certified Survey Map being submitted creating two (2) parcels and recommends approval to the Common Council for a rezoning from EA/OD Exclusive Agricultural District with a Duplex Overlay District to A Agricultural District on the Lang property located in the NW ¼ of Section 29, subject to resolution of technical discrepancies as identified by the City Planning Department and City Engineers, and payment of all applicable fees in Section 18.14(3) of the Land Division Ordinance and outstanding assessments if applicable.   BE IT FURTHER RESOLVED, That the existing duplex is now allowed by Conditional Use Grant as per Resolution #P. C. 080-2006.   BE IT FURTHER RESOLVED, That all technical corrections will need to be addressed before the Certified Survey Map will be signed and recorded.   BE IT FURTHER RESOLVED, That a digital file of this Certified Survey Map shall be submitted to the City in accordance with Common Council Ordinance No. 1118 and Resolution 196-2002.    Plan Commission City of Muskego   Adopted:    June 6, 2006 Defeated: Deferred:    Introduced: June 6, 2006 ATTEST:  Sandi Asti, Recording Secretary
