PCR2006065 ./PCR2006065_files/filelist.xml RESOLUTION #PC 065-2006 Print 89 6 pt 6 pt 0 AMENDED RESOLUTION #P.C.065-2006 APPROVAL OF AN AMENDED BUILDING SITE AND OPERATION PLAN FOR WAUKESHA STATE BANK LOCATED IN THE SW ¼ OF SECTION 2 (S69 W15273 JANESVILLE ROAD / TAX KEY NO. 2167.995.013) WHEREAS, On April 5, 2006 plans were submitted by Electrical Concepts Inc. for an amended Building, Site and Operation Plan for Waukesha State Bank located in the SW ¼ of Section 2, and   WHEREAS, The petitioner has requested to be allowed to install two (2) pulse start metal halide fixtures to illuminate a flag at the Waukesha State Bank property, and   WHEREAS, The proposed fixtures will be pointed upward at the flag and are narrow parabolic floodlights that can have an optional internal louver installed, and   WHEREAS, The fixtures are proposed to be located along Janesville Road, 2 feet away from each side of the flag pole to the west and to the east, and   WHEREAS, On July 15, 2005 the original Building, Site, and Operation Plan was approved by the Planning Commission for this property under #P.C. 084-2005, and   WHEREAS, That approval stated that the site lighting must be high pressure sodium, except for some carefully designed building accent lighting that was allowed to be metal halide, and   WHEREAS, The petitioner has stated that use of a high pressure sodium light, rather than the metal halide light could alter the appearance of the flag according to CRI (Color Rendering Index) for each type of fixture, and   WHEREAS, There could be some possible concerns that the metal halide fixtures could be excessively bright or bothersome to the area since it is pointing straight upward.   THEREFORE BE IT RESOLVED, That the Plan Commission approves of the Building, Site and Operation Plan Amendment submitted May 23by Electrical Concepts Inc. for Waukesha State Bank located in the SW ¼ of Section 2.   BE IT FURTHER RESOLVED, That the fixtures must be screened at the ground level with landscaping so that fixtures are not directly visible.   BE IT FURTHER RESOLVED, That the fixtures must have the optional louvers installed as to help direct the light path.   BE IT FURTHER RESOLVED, That all conditions of the original Building, Site, and Operation Plan are still is full effect for this property.   BE IT FURTHER RESOLVED, That a copy of said plans be kept on file in the Building Department and that all aspects of this plan shall be maintained in perpetuity unless otherwise authorized by the Plan Commission.   BE IT FURTHER RESOLVED, That failure to comply with the approval contained in this resolution shall result in the imposition of fines of $100 per day, the initiation of legal action, or both.   BE IT FURTHER RESOLVED, That if any issues arise petitioner would be required to install extra shielding.    Plan Commission City of Muskego   Adopted:    April 18, 2006 Defeated: Deferred:    Introduced: April 18, 2006 ATTEST: Sandi Asti, Recording Secretary
