PCR2006064 ./PCR2006064_files/filelist.xml RESOLUTION #PC 064-2006 Print 86 6 pt 6 pt 0 RESOLUTION #P.C. 064-2006              APPROVAL OF AN AMENDMENT TO THE BUILDING SITE AND OPERATION PLAN FOR RALPH RAUSH FOR A PROPERTY LOCATED IN THE SW ¼ OF SECTION 16 (TAX KEY NO. 2223.003 / S83 W18550 SATURN DRIVE)   WHEREAS, On May 2, 1989 the Plan Commission, adopted a Building Site and Operation Plan through Resolution #P.C. 65-89, and amended that Plan through Resolutions #P.C. 199-90 and Resolution #P.C. 201-93, and   WHEREAS, Currently only five (5) wheeled vehicles (vehicles, trailers, boats) may be stored at this location and must be located along the north lot line, parallel parked and no higher than six (6) feet with an annual review in the March Plan Commission meeting, and   WHEREAS, The March 2006 annual review revealed that there were vehicles, some over six (6) feet in height, parked along the western lot line and the petitioner was required to move such vehicles to the approved location along the northern lot line, and   WHEREAS, The property owner would now like to amend the current outdoor parking (storage) location and requirements on their site, and   WHEREAS, The property owner requests to be allowed to store up to eight (8) vehicles (vehicles, trailers, boats) along the western lot line and also be allowed vehicles up to nine (9) feet in height, and   WHEREAS, The petitioner has stated that the amount of clearance along the northern lot line is about 25 feet while there is about 30-32 feet along the western lot line, and   WHEREAS, With the vehicles parked/stored along the northern lot line and loading/un-loading along the northern facing rental units, the northern portion of the site could become nearly impassable, and   WHEREAS, There is more space for site traffic along the western portion of the site, even with stored vehicles and loading/un-loading along the western facing rental units, and   WHEREAS, In the past no complaints have been received by the Planning Department in regards to this property.   THEREFORE BE IT RESOLVED, That the Plan Commission approves of an amendment to the Building, Site and Operation Plan for Ralph Raush for a property located in the SW ¼ of Section 16 (Tax Key No. 2223.003 / S83 W18550 Saturn Drive).   BE IT FURTHER RESOLVED, That the amended approval will allow up to eight (8) wheeled vehicles (vehicles, trailers, boats) to be stored along the western lot line and vehicles up to nine (9) feet in height, subject to Fire Department approval as listed below.   BE IT FURTHER RESOLVED, That the petitioner must seek Fire Department review and approval for the proposed parking change to the western lot line to ensure that proper fire protection can occur.  The petitioner must then provide the Planning Department with such written approval before any vehicles can be allowed along the western lot line.       BE IT FURTHER RESOLVED, That no vehicles can be parked along the western lot line until the Planning Department has acknowledged the Fire Department’s approval, if such approval is granted.   BE IT FURTHER RESOLVED, That if the Fire Department does not approve the change in stored vehicle placement, then the vehicles must stay within the original approval, which state that the vehicles must be stored/parked along the northern lot line.   BE IT FURTHER RESOLVED, That this property will continue to have an annual review.   BE IT FURTHER RESOLVED, That all aspects of this building, site and operation plan, as they relate to the building, parking and drive areas, landscaped areas and signage shall be maintained in perpetuity unless otherwise authorized by the Plan Commission.   BE IT FURTHER RESOLVED, That failure to comply with the conditions of this approval shall result in the imposition of fines of $100 per day per violation, the initiation of legal action or both.                                                                           Plan Department                                                                         City of Muskego     Adopted:            April 18, 2006 Defeated:        Deferred:         Introduced:             April 18, 2006 ATTEST:            Sandi Asti, Recording Secretary
