RESOLUTION #P.C.055-2006
APPROVAL OF AN AMENDED BUILDING SITE AND OPERATION PLAN
FOR THE PIONEER INN LOCATED IN THE NW ¼ OF SECTION 16
(TAX KEY NO. 2196.983 / W180 S7808 PIONEER DRIVE)
WHEREAS, On March 27, 2006 plans were submitted by Mark Sobczak for an amendment to a Building, Site and Operation Plan for the Pioneer Inn located in the NW ¼ of Section 16 (Tax Key
No. 2196.983 / W180 S7808 Pioneer Drive), and
WHEREAS, The petitioner is proposing to add a deck off the rear of the building, construct a dumpster enclosure, and install lattice screening on the underside of the existing front
deck, and
WHEREAS, The site currently consists of an asphalt parking lot and limited landscaping, and
WHEREAS, Said property is zoned RS-3 Suburban Residence District although is currently used commercially, and the use is grandfathered in as it existed prior to zoning code and comprehensive
plan being in affect, and
WHEREAS, The proposed rear deck will contain one set of stairs to grade and one large ramp to grade, as well as one ramp to the rear building door, and
WHEREAS, The underside of the rear deck will contain lattice type screening, and
WHEREAS, There appears to be enough clearance between the rear deck and the parking spots that should allow for the proper two-way traffic flow through out the site, and
WHEREAS, The petitioner would like to serve food and liquor on the rear deck, which will require an amendment to the liquor license for this property, and
WHEREAS, The petitioner is requesting to be allowed to have small speakers on the deck for music for deck patrons, and
WHEREAS, The dumpster enclosure is proposed to be located towards the southeast corner of the parking lot and will be constructed out of board-on-board cedar fencing with a gate on
the west side of the enclosure, and
WHEREAS, The enclosure will measure 20 feet wide by 10 feet deep and will be no taller than 6 feet in height, and
WHEREAS, The area on the existing front porch will be screened with lattice work to screen the supports and the old brick staircase, and
WHEREAS, A formal landscape plan has not yet been formally submitted for the site, and
WHEREAS, An annual review is required for this property that shall occur no later than the second meeting in March of every calendar year until Plan Commission waives the requirement.
THEREFORE BE IT RESOLVED, That the Plan Commission approves of an amended Building, Site and Operation Plan for the Pioneer Inn located in the NW ¼ of Section 16 (Tax Key No. 2196.983
/ W180 S7808 Pioneer Drive).
BE IT FURTHER RESOLVED, That the lattice work under the front deck must span the entire vertical distance from the ground all the way up to the underside of the decking so that all
of the supports and the old brick stairs are covered completely.
BE IT FURTHER RESOLVED, That an amendment to the liquor license for this property must be applied for and approved by the Finance Committee before the deck can be used for the sale
of liquor.
BE IT FURTHER RESOLVED, That the sale of liquor shall only be allowed on the deck until 11:00 PM and that if any complaints or concerns arise due to the sale of liquor on the deck,
the liquor license for the deck may be removed by the Finance Committee.
BE IT FURTHER RESOLVED, That the music on the rear deck is only allowed until 11:00 PM and it must be kept at a level that is quiet enough so that it can not be heard off of the rear
deck and that if any complaints or concerns arise due to the music, the allowance of the outdoor music may be removed.
BE IT FURTHER RESOLVED, That the enclosure area needs to be hard surfaced (asphalt or concrete).
BE IT FURTHER RESOLVED, That a formal landscape plan must be approved by the City Forester.
BE IT FURTHER RESOLVED, No outdoor storage of materials is allowed unless first approved by Plan Commission.
BE IT FURTHER RESOLVED, Any other exterior modifications to the site or structure requires Plan Commission approval.
BE IT FURTHER RESOLVED, That a yearly review be held no later than the second meeting in March of every calendar year until Plan Commission waives the requirement.
BE IT FURTHER RESOLVED, That a copy of said plans be kept on file in the Building Department and that all aspect of this plan shall be maintained in perpetuity unless otherwise authorized
by the Plan Commission.
BE IT FURTHER RESOLVED, That failure to comply with the approval contained in this resolution shall result in the imposition of fines of $100 per day, the initiation of legal action,
or both.
BE IT FURTHER RESOLVED, That the volleyball court lighting will be turned off by 10:30 p.m.
