PCR2006053 ./PCR2006053_files/filelist.xml RESOLUTION #P.C. 053-2006 Print 86 6 pt 8.15 pt 2 2 MicrosoftInternetExplorer4 RESOLUTION #P.C. 053-2006 APPROVAL OF CONCEPTUAL SUBDIVISION PLAT FOR A FUTURE SUBDIVISION KNOWN AS HERON SPRINGS LOCATED IN THE SW ¼ OF SECTION 26 (TAX KEY NOS. 2263.998 & 2263.999 / THODE DRIVE) WHEREAS, On March 15, 2006 a sketch preliminary plat was submitted by MLG for a property located in the SW ¼ of Section 26 (Tax Key Nos. 2263.998 & 2263.999 / Thode Drive), and WHEREAS, The plan consists of approximately 106.5 acres, proposes 106 single-family parcels and a variety of outlots for wetland preservation and stormwater purposes, and WHEREAS, The plan shows an average lot size of 23,526 square feet and the overall open space total is approximately 38.4 acres or 36% of the development, and WHEREAS, The land currently consists of open farm land and some wetlands, and WHEREAS, The proposed lots would all be internal with no lots having direct Thode Drive access, and WHEREAS, Many of the proposed lots would abut open space and landscaped areas, and WHEREAS, Said properties are zoned EA Exclusive Agriculture District and A Agriculture District and the plat will require a rezoning to a sewered RS-2 Suburban Residence District, and WHEREAS, The RS-2 Suburban Residence District requires lots to have a minimum of 20,000 square feet and a minimum of 110 feet in width and the parcels depicted meet these requirements, and WHEREAS, The 2010 Comprehensive Plan depicts this area for Agriculture and Open Space consistent with a low density residential and a future 2010 Comp Plan amendment to medium density residential would be required upon formal rezoning approvals, and WHEREAS, Said parcels will be serviced by City sanitary sewer and water extended down the STH 36 right-of-way from the southwest corner of the Champions Village Subdivision, and WHEREAS, The MMSD Sewer District is currently being amended to include the whole western parcel shown in the conceptual plat and this must be completed before the subdivision would receive final approvals, and   WHEREAS, Access is depicted to derive from a main intersection on going to parcels east and west of Thode and another access is shown along Henrich Drive to the southwest of the conceptual plat, and   WHEREAS, The Park and Open Space Plan depicts no recommendations for this piece of property, and   WHEREAS, The Conservation Plan depicts a small sliver of Medium Management Priorities that all appear to be contained in the shown wetlands located on the west central portion of the plat, and   WHEREAS, The Plat is required to provide on-site stormwater management as required by Chapter 34, and stormwater is depicted to be handled in detention facilities within the outlots. THEREFORE BE IT RESOLVED, That the Plan Commission approves of a sketch preliminary plat as proposed by MLG for the future subdivision known as Heron Springs located in the SW ¼ of Section 26 and will be receptive to the submittal of a preliminary plat. BE IT FURTHER RESOLVED, That a conceptual rezoning from EA Exclusive Agriculture District and A Agriculture District to a sewered RS-2 Suburban Residence District and a Comp Plan amendment from Agriculture and Open Space to Medium Density Residential is looked upon fondly at this time, although a future public hearing could bring out further details that the Planning Commission may review.   BE IT FURTHER RESOLVED, That upon formal rezoning requests, the developers should show what connections will be made at the developer’s expense for sewer/water.   BE IT FURTHER RESOLVED, Emergency access stubs may be required by the Public Works Committee in certain areas upon final approvals.   BE IT FURTHER RESOLVED, The Preliminary Plat should show all environmentally delineated areas within Preservation Easements.    BE IT FURTHER RESOLVED, That DNR concurrence on the delineation of all wetlands and navigable waterways within the platted area must be delivered to the Planning Department before approvals of the Preliminary Plat.   BE IT FURTHER RESOLVED, The Park and Conservation Boards will review the proposal at the time of Preliminary Plat to determine dedication fee needs and preservation plan and easement needs.     BE IT FURTHER RESOLVED, All environmental areas will need to be delineated before Preliminary Plat time including high water marks of navigable streams, any wetlands, floodplains, and forested areas. BE IT FURTHER RESOLVED, A small portion of the property is not within the current sewer service area and the sewer service area must be amended and fully approved before the plat receives final approvals. BE IT FURTHER RESOLVED, That this approval is granted in concept only and final action is only an indication of the current intent of the Plan Commission; Final submittals are subject to future review and consideration by the Plan Commission, municipal committees of jurisdiction, and other agencies, and approval of final plans is not guaranteed by this action of the Plan Commission.
