APPROVAL OF AN AMENDMENT TO THE BUILDING SITE AND OPERATION PLAN FOR THE MUSKEGO GATEWAY CENTRE ENTERTAINMENT COMPLEX
LOCATED IN THE SE ¼ OF SECTION 5
(TAX KEY NO. 2180.994.001 / S67 W19491 TANS DRIVE)
WHEREAS, On March 2, 2006 plans were submitted by Torke, Wirth, Pujara Ltd. for The Muskego Gateway Centre Entertainment Complex for an amendment to the Building, Site and Operation
Plan for property located in the SE ¼ of Section 5 (S67 W19491 Tans Drive / Tax Key No. 2180.994.001), and
WHEREAS, Said property is zoned B-2 Local Service Center District, and said use is a permitted use by right subject to Building, Site, and Operation Plan approvals, and
WHEREAS, There is an existing former movie theater building on this site that is about 15,782 square feet in area, and
WHEREAS, Petitioner proposes to reuse and remodel the current structure to now house a multi-use entertainment complex, and
WHEREAS, The four (4) former theater rooms are proposed to now house a bar, a billiards room, an arcade, and an indoor volley ball court, and
WHEREAS, The lobby and storage areas will be converted into a food service area, a sports gift shop, and an internet café, and
WHEREAS, The site contains 273 parking stalls which is ample for the proposed use, and
WHEREAS, The parking lot markings are light and faded, and
WHEREAS, The exterior alternations include the placement of two (2) new window units on the western elevation, three (3) new window units on the southern elevation, and one (1) new
window unit on the northern elevation, and
WHEREAS, No other alteration to the buildings exterior are proposed at this time, and
WHEREAS, The existing lighting on the site is in need of repair and cleanup, and
WHEREAS, No new lighting or lighting changes are proposed at this time, and if any new lighting is needed in the future, Planning Commission and/or Planning Department approvals will
be needed, and
WHEREAS, No outdoor recreation facilities (volleyball courts, etc.) are allowed or approved for this site at this time since conditional use grants are required for such facilities,
and
WHEREAS, The doors of the existing trash enclosure are in poor condition and are going to be repaired according to the plans submitted, and
WHEREAS, No new signage is proposed at this time and Plan Commission and/or staff approval will be needed when signage is requested, and
WHEREAS, A landscape plan is depicted within the submittal and updates may be required by the City Forester, and
WHEREAS, The existing landscaping on the site is in need of general updating and cleanup, and
WHEREAS, The Planning Department received a phone call regarding a concern about adequate screening of headlights to the east, which will be handled by an updated landscape plan, and
WHEREAS, The site currently is served with municipal sewer and a private water well, and
WHEREAS, Access is provided to the site with two existing entrances, one off of Racine Avenue, and the other off of Tans Drive, and
WHEREAS, Stormwater management will not be needed per the Engineering Department since no new impervious surfaces are being added to the site.
THEREFORE BE IT RESOLVED, That the Plan Commission approves of an amended Building, Site and Operation Plan for the Muskego Gateway Centre Entertainment Complex located in the SE ¼
of Section 5 (S67 W19491 Tans Drive / Tax Key No. 2180.994.001).
BE IT FURTHER RESOLVED, That all parking stalls and site markings must be re-striped before occupancy can be granted for the use of the building.
BE IT FURTHER RESOLVED, That all existing lighting on the site must be in good working order and all lighting that is in disrepair must be reconditioned.
BE IT FURTHER RESOLVED, That the doors of the trash enclosure need to be completely repaired before occupancy can be granted for this building.
BE IT FURTHER RESOLVED, That no mechanicals are shown to adorn the roof and if any are required they must be screened from view and colored to match the principal structure.
BE IT FURTHER RESOLVED, That there shall be no ancillary signage or temporary signage unless specifically regulated by Section 17:6.09 of the Municipal Code.
BE IT FURTHER RESOLVED, Any outdoor recreational facilities will require a separate conditional use grant that will need to be approved by the Planning Commission, and
BE IT FURTHER RESOLVED, That no outdoor storage of any type is allowed on site unless approvals from Plan Commission are sought.
BE IT FURTHER RESOLVED, That existing landscaping needs to be cleaned up on the site including, but not limited to, new mulch within all planted areas, new topsoil and grass in all
disturbed areas, general weeding of the site, etc.
BE IT FURTHER RESOLVED, That the landscape plan shall be enhanced according to any comments from the City Forester and submitted for re-approvals prior to the issuance of occupancy
for the building.
BE IT FURTHER RESOLVED, That general clean up of the entire site and all of the repairs/updates listed above, will need to completed before occupancy can be granted for the use of
the building.
BE IT FURTHER RESOLVED, That if any additions or new buildings are added to the site, municipal water infrastructure improvements may be needed at the landowner’s expense.
BE IT FURTHER RESOLVED, That a copy of said plans be kept on file in the Building Department and that all aspect of this plan shall be maintained in perpetuity unless otherwise
authorized by the Plan Commission.
BE IT FURTHER RESOLVED, That failure to comply with the approval contained in this resolution shall result in the imposition of fines of $100 per day, the initiation of legal action,
or both.
BE IT FURTHE RESOLVED, That an annual review will be held in the month of March of every year until the Plan Commission agrees to waive the requirement.
