RESOLUTION #P.C. 045-2006
RECOMMENDATION TO COMMON COUNCIL TO REZONE LANDS WITHIN THE OLR LAKESHORE RECREATIONAL OVERLAY ZONING DISTRICT AND TO REMOVE CERTAIN LANGUAGE FROM THE OLR DISTRICT TEXT
WHEREAS, The Planning Commission directed Planning staff to investigate changes to the OLR Lakeshore Recreational Zoning District at their February 21, 2006 meeting, and
WHEREAS, The Planning Commission requested this investigation as they believed the OLR zoning district was unused in many locations and the removal of the district may be better for
the community in many respects, and
WHEREAS, The Planning Commission also requested that staff investigate the history and overall need for the following zoning ordinance text found in the OLR zoning district as a use
permitted by Conditional Use Grant:: “Multifamily use of an existing structure,” and
WHEREAS, Plan Department staff has found that 24 parcels have the OLR zoning district upon them and that 8 of those 24 parcels are utilizing the zoning directly or indirectly, and
WHEREAS, Zero parcels with the OLR zoning district are utilizing the “Multifamily use of an existing structure” zoning ordinance text, and
WHEREAS, The 2010 Comprehensive Plan promotes all the parcels currently with the OLR zoning designation as for future single-family residential uses.
THEREFORE BE IT RESOLVED, That the Plan Commission recommends that the Common Council initiate the process to remove the OLR Lakeshore Recreational Zoning District from the following
properties (Properties currently not utilizing the uses of the OLR district):

BE IT FURTHER RESOLVED, That the Planning Commission recommends this rezoning as the properties with the zoning do not currently utilize the permitted uses of the OLR zoning district.
Further the Planning Commission believes that the many properties surrounding the lakes are residential in nature and the removal of the OLR district is better for the community and
more in lines with the objectives and goals of the Comprehensive Plan.
BE IT FURTHER RESOLVED, That the Planning Commission also recommends that the Council begin the process to remove the following zoning ordinance text found in the OLR zoning district
as a use permitted by Conditional Use Grant:: “Multifamily use of an existing structure.” The language is not utilized by any parcels in the City and the Planning Commission doesn’t
see this use as bettering the overall community. Further, the change is more in lines with the objectives and goals of the Comprehensive Plan
