RESOLUTION #P.C. 043-2006
APPROVAL OF AN ANNUAL REVIEW FOR MARX PIONEER INN
LOCATED IN THE SE ¼ OF SECTION 9
(W180 S7808 PIONEER DRIVE / TAX KEY NO. 2196.983)
WHEREAS, On October 18, 2005 the Plan Commission adopted a Building Site and Operation Plan through Resolution #P.C. 124-2005, and
WHEREAS, The BSO approval allowed a paved parking lot with striping and the addition of new landscaping, and
WHEREAS, The petitioner was allowed to construct the northern edge of the parking lot three (3) feet off of the northern lot line, and
WHEREAS, Resolution #P.C. 124-2005 also stipulated the following:
1. That there shall be no outdoor storage on site.
2. That if any building or site alterations are to take place, they must first receive Plan Commission approvals.
3. That if a refuse enclosure is needed, it must first be approved by the Planning Department for location and type, and
WHEREAS, A site inspection on March 8, 2006 revealed that the parking lot has been paved, and
WHEREAS, A landscape plan has not yet been submitted to or approved by the City Forester, and
WHEREAS, There are dumpsters on site that are not enclosed or screened, and
WHEREAS, At the Plan Commission agenda meeting held at the staff level, concerns arose regarding the look of the old exposed brick staircase under the front porch/deck and it was
recommended that some type of screening or lattice be installed to screen the old brick staircase, and
WHEREAS, No complaints were received by the Planning Department during the past year.
THEREFORE BE IT RESOLVED, That the Plan Commission approves the annual review for Marx Pioneer Inn, located at W180 S7808 Pioneer Drive (Tax Key No. 2196.983).
BE IT FURTHER RESOLVED, That a formal landscape plan must be submitted to and approved by the City Forester within two (2) weeks of this approval or citations could be issued in the
amount of $100 a day per violation.
BE IT FURTHER RESOLVED, That a plan must be submitted to and approved by the Planning Department showing what the refuse enclosure will look like, what it will be constructed out
of, and where it will exactly be placed within two (2) weeks of this approval or citations could be issued in the amount of $100 a day per violation.
BE IT FURTHER RESOLVED, That a plan must be submitted to and approved by the Planning Department showing the lattice/screening that will be used to cover the exposed old brick stairs
under the front porch/deck within two (2) weeks of this approval.
BE IT FURTHER RESOLVED, That all aspects of this building, site and operation plan shall be maintained in perpetuity unless otherwise authorized by the Plan Commission.
BE IT FURTHER RESOLVED, That failure to comply with the conditions of this approval shall result in the imposition of fines of $100 per day per violation, the initiation of legal
action or both.
