PCR2006042 ./PCR2006042_files/filelist.xml RESOLUTION #P.C. 042-2006 Print 86 6 pt 6 pt 0 AMENDED RESOLUTION #P.C. 042-2006 APPROVAL OF AN ANNUAL REVIEW FOR THE RUSDAHL PROPERTY FOR A RUSTIC STRUCTURE AT THE PROPERTY LOCATED AT W135 S8266 DURHAM DRIVE   WHEREAS, The Plan Commission approved a rustic structure Conditional Use Grant for the Rusdahl property barn at the property located at W135 S8266 Durham Drive on January 4, 2005, and   WHEREAS, Conditions of approval included the following: 1.     That a rustic structure designation be allowed for the property as long as an annual review is held by the City’s Planning Commission and Conservation Commission yearly and that the annual review is to make certain the barn stays in good repair, and   WHEREAS, The Conservation Commission reviewed the structure at their April 12, 2006 meeting and recommended the continuation of the Rustic Structure designation based upon the owners plans for upkeep and maintenance as provided at the Conservation Commission meeting, and   WHEREAS, The items that the petitioner stated, at the Conservation Commission meeting, that they would be working on this summer are as follows: ·    Window and door trim in disrepair will be replaced, and ·    The upper access door will be repaired to match the building, and ·    Painting will occur on any repaired areas of the building, and   WHEREAS, Some of the needed repairs have begun on the barn, and   WHEREAS, A Planning Department March 8, 2006 site inspection revealed certain items falling into disrepair.   THEREFORE BE IT RESOLVED, That the Plan Commission approves of the Annual Review of the Rusdahl property barn as a rustic structure at the property located at W135 S8266 Durham Drive.   BE IT FURTHER RESOLVED, That repairs should be made to the barn including repairing the holes on the barn façade, repainting any repaired areas, replacing any window/door trim in disrepair, and repairing the upper access door and that the boarded up window should be restored by July 31, 2006 within 1 month from the date of this approval or Planning Commission removal of the CUG could be enforced.   BE IT FURTHER RESOLVED, That the yearly review be held no later than the second meeting in March of every calendar year.    BE IT FURTHER RESOLVED, That failure to comply with the conditions of this Building, Site and Operation Plan shall result in the imposition of fines of $100 per day per violation, the initiation of legal action, or both.   Plan Commission City of Muskego   Adopted:            April 18, 2006 Defeated:        Deferred:            March 21, 2006;  April 4, 2006 Introduced:             March 21, 2006 ATTEST:            Sandi Asti, Recording Secretary
