PCR2006037 ./PCR2006037_files/filelist.xml RESOLUTION #P.C. 037-2006 Print 104 6 pt 6 pt 0 RESOLUTION P.C. 037-2006 APPROVAL OF AN ANNUAL CONDITIONAL USE GRANT REVIEW TO ALLOW MINI-STORAGE WAREHOUSES AND AUTO REPAIR FOR GEORGE ALEX FOR THE PROPERTIES LOCATED ON LOOMIS DRIVE AND LOOMIS COURT (TAX KEY NOS. 2257.984 & 2257.973.001)   WHEREAS, Formal Building, Site and Operation Plans and Conditional Use Grant applications were approved for George Alex for two (2) different properties, one for mini-storage warehouses (Tax Key No. 2257.984) and the other for mini-storage warehouses and auto service (Tax Key No. 2257.973.001), and   WHEREAS, The parcel with a tax key number of 2257.984 contains a Conditional Use Grant and Building, Site and Operation plan that was adopted by the Plan Commission for two mini-storage warehouses for the property located on Loomis Drive for George Alex under Resolution #P.C. 227-94 on December 20, 1994, and   WHEREAS, The parcel with a tax key number of 2257.973.001 contains a Conditional Use Grant and Building, Site and Operation plan that was adopted by the Plan Commission for one mini-storage warehouse building with office space and for a building with mini-storage warehouses and an auto repair business for the property located on Loomis Court and on North Cape Road (USH 45) for George Alex, most recently under Resolutions #P.C. 053a-2003, #P.C. 067-2004, and #P.C. 050-2005, and   WHEREAS, The site on Loomis Road (Tax Key No. 2257.984) conditions of approval included:   1. Beginning in March of 1996, an annual review shall be conducted to ensure the development is maintained. 2. No outside storage of vehicles, equipment, goods or materials. 3. No vehicle repair or restoration activities. 4. No manufacturing, assembly or materials and goods distribution operations, and   WHEREAS, A site inspection was completed on March 8, 2006 for the Loomis Road property (Tax Key No. 2257.984) and it was in compliance with the conditions of the approved BSO and CUG, and   WHEREAS, The site on Loomis Court and North Cape Road/USH 45 (Tax Key No. 2257.973.001) conditions of approval included:   1.  An auto repair business may operate out of the northern building on the site. 2.  There can be no cars for sale on this property. 3.  The southern building’s office area is limited to only have five (5) small motor vehicles for outdoor display.  These displays can only be out during business operating hours. 4.  All other outside storage (other than noted above) of vehicles, materials, and/or other miscellaneous objects are prohibited at all times. 5.  There shall be an enclosed gravel storage area with an asphalt approach on the northeastern portion of the site.  The fencing of this area must include brown colored privacy slats. 6.  There shall be no unapproved ancillary signage on the property for any reason. 7.  All rental vehicles, including but not limited to trucks, trailers, etc., must be stored at all times within the fenced area at the northeastern part of the site.  They can not be stored anywhere else on the property, and   WHEREAS, A site inspection was completed on March 8, 2006 for the Loomis Court and North Cape Road (USH 45) property (Tax Key No. 2257.973.001) and there were numerous items that were not in compliance with the conditions of the approved BSO and CUG, and   WHEREAS, There are still numerous outstanding issues relating to the final occupancy of the northern building on this site (Tax Key No. 2257.973.001).   THEREFORE BE IT RESOLVED, That the Plan Commission approve of the Annual Review for the Conditional Use Grant and the Building, Site, and Operation plan for the George Alex properties subject to all of the above conditions being met within three (3) weeks of the March 21, 2006 Plan Commission meeting.   BE IT FURTHER RESOLVED, The following items relating to final occupancy requirements and/or the approved BSO and CUG must be brought into compliance:   1.  The rest of the landscaping along with the sodding of all disturbed areas needs to be completed according to the approved landscape plan. 2.  Parking lot markings need to be completed along with stall and arrow (One-Way) markings. 3.  A refuse enclosure needs to be installed if any outdoor refuse storage is needed. 4.  The outdoor fenced area on the northeastern part of the site needs privacy slates as approved in the site/building plans. 5.  The non-approved outdoor storage sign near the outdoor storage area needs to be removed since it is without approvals. 6.  The gravel area between the new building and the retaining wall should be asphalted or green space by the time that the rest of the landscaping is completed.   BE IT FURTHER RESOLVED, The following items relating to the approved BSO and CUG requirements must be brought into compliance:   1.  All outdoor storage must be removed from the site.  Specifically there were stone slabs on pallets and tires to the north side of the auto business building, bricks piles and pallets behind the telephone company shelter at the southern portion of the site, a large enclosed trailer between the two buildings, and a trailer and tractor on the north side of the auto business building. 2.  All of the U-Hauls (rental type vehicles) including trucks, trailers, etc. must be stored only and always within the fenced area on the northeastern part of the site. 3.  The fenced area on the northeastern part of the site must have brown colored privacy slats installed according to the approved plans. 4.  All temporary and all un-approved signage must be removed (any outdoor U-Haul signs and the outdoor storage sign near the fenced area).   BE IT FURTHER RESOLVED, That the yearly review be held no later than the second meeting in March of every calendar year.   BE IT FURTHER RESOLVED, That all of the above mentioned items relating to requirements for final occupancy and the conditions of the BSO and CUG must be completely corrected/finished within three (3) weeks of the March 21, 2006 (which is April 11, 2006) Plan Commission meeting or citations of $100 per day per violation, the initiation of legal action, or both will have to occur.   BE IT FURTHER RESOLVED, That the only item that can be completed in the spring, past the April 11, 2006 deadline, is the installation of the landscaping and sod, due to seasonal concerns.   Plan Commission City of Muskego Adopted:            March 21, 2006 Defeated:         Deferred:         Introduced:            March 21, 2006 ATTEST:            Sandi Asti, Recording Secretary
