RECOMMENDATION TO COMMON COUNCIL TO REPEAL AND RECREATE PARTS OF CHAPTER 14 (FLOODPLAIN ORDINANCE) AND AMEND SECTION 17:3.08(4) OF THE MUNICIPAL CODE RELATING TO THE BOARD OF APPEALS
VOTING
WHEREAS, Chapter 14 regulates floodplain regulations within the City of Muskego and Chapter 17:3.08(4) establishes voting procedures for the City’s Board of Appeals, and
WHEREAS, Chapter 14 needs to be recreated according to current State standards in order for the City to be eligible for new floodplain mapping upcoming in late 2006, and
WHEREAS, The State has concurred with the proposed changes to the floodplain ordinance, and
WHEREAS, Chapter 17:3.08(4) requires updating to current State standards as only a majority of a quorum is needed to accept an appeal by the City’s Board of Appeals.
WHEREAS, A public hearing has been scheduled to consider the matter on February 14, 2006.
THEREFORE BE IT RESOLVED, That the Plan Commission recommends the attached recreation to Chapter 14 and the amendment to Chapter 17:3.08(4) to the Common Council.

Required Vote: A majority The concurring vote of 4 members of the Board shall be necessary to reverse any order, requirement, decision or determination of any such administrative
official, or to decide in favor of the applicant on any matter upon which it is required to pass under this ordinance, or to effect any variation therefrom. The grounds of every
such determination shall be stated.
