PCR2006025 ./PCR2006025_files/filelist.xml RESOLUTION #P.C. 025-2006 Print BestFit 6 pt 6 pt 0 RESOLUTION #P.C. 025-2006 APPROVAL OF A TWO (2) LOT CERTIFIED SURVEY MAP AND RECOMMENDATION TO COUNCIL FOR A PARTIAL REZONING FROM R-2 COUNTRY HOME TO RSE SUBURBAN ESTATE LOCATED IN THE SW ¼ OF SECTION 24 (S91 W13851 BOXHORN DRIVE / TAX KEY NO. 2255.994.006) WHEREAS, On February 1, 2006 a Certified Survey Map for a two (2) lot land division and a petition for a partial rezoning was submitted by Christine McIntyre for a property located in the SW ¼ of Section 24, (S91 W13851 Boxhorn Drive / Tax Key No. 2255.994.006), and WHEREAS, The proposed land division would create two (2) lots with minimum areas of 43,094 square feet and 65,513 square feet, and WHEREAS, Said property is zoned R-2 Country Home District, requiring a minimum lot size of 60,000 square feet and an average minimum width of 175 feet and requires a rezoning for Lot 2 of the proposed CSM to RSE Suburban Estate District, requiring a minimum lot size of 40,000 square feet and an average minimum width of 150 feet to permit a land divisions, and WHEREAS, The 2010 Comprehensive Plan depicts this area as being set aside for Low Density Residential land use consistent with the proposed rezoning and land division, and WHEREAS, Said parcels will be serviced by municipal sanitary sewer and private water, and   WHEREAS, No right of way dedications are required as part of this CSM, and   WHEREAS, A Public Hearing for the rezoning was held in front the Common Council on February 28, 2006.   THEREFORE BE IT RESOLVED, That the Plan Commission approves of a Certified Survey Map being submitted creating two (2) parcels and recommends approval to the Common Council for a rezoning of Lot 2 of the proposed CSM from R-2 Country home district to RSE Suburban Estate District on the McIntyre property located in the SW ¼ of Section 24, subject to resolution of technical discrepancies as identified by the City Planning Department and City Engineers, and payment of all applicable fees in Section 18.14(3) of the Land Division Ordinance and outstanding assessments if applicable.   BE IT FURTHER RESOLVED, The Engineering Department requires that both parcels will have to connect to Municipal Sanitary Sewer as part of this land division.   BE IT FURTHER RESOLVED, That all technical corrections will need to be addressed before the Certified Survey Map will be signed and recorded.   BE IT FURTHER RESOLVED, That a digital file of this CSM shall be submitted to the City in accordance with Common Council Ordinance No. 1118 and Resolution 196-2002.    Plan Commission City of Muskego   Adopted:    March 7, 2006 Defeated: Deferred:    Introduced: March 7, 2006 ATTEST:  Sandi Asti, Recording Secretary
