PCR2006023a ./PCR2006023a_files/filelist.xml RESOLUTION #P.C. 023a-2006 Print BestFit 6 pt 6 pt 0   AMENDED RESOLUTION #P.C. 023-2006 RECOMMENDATION TO COUNCIL FOR A REZONING FROM EA EXCLUSIVE AGRICULTURAL DISTRICT, A AGRICULTURAL, AND SW SHORELAND WETLAND TO RS-2 SUBURBAN RESIDENCE DISTRICT AND SW SHORELAND WETLAND DISTRICT LOCATED IN THE NW ¼ AND NE ¼ OF SECTION 21 (RACINE AVENUE / TAX KEY NO. 2241.999) WHEREAS, On January 25, 2006 a petition for a rezoning was submitted by Alesci Enterprises for the Stefaniak property located in the NE ¼ of Section 5, (Racine Avenue / Tax Key No. 2241.999), and WHEREAS, Said property is currently zoned EA Exclusive Agricultural District requiring a minimum lot size of 35 acres per lot and an average minimum width of 1275 feet per lot, A Agricultural District, requiring a minimum lot size of 120,000 square feet per lot and an average minimum width of 300 feet per lot and SW Shoreland Wetland District, requiring no lot size requirement, just restricted uses, and is proposing a rezoning to RS-2 Suburban Residence District and SW Shoreland Wetland District to permit land divisions with minimum lot sizes of 20,000 square feet per lot and an average minimum width of 110 feet, and WHEREAS, A public hearing was heard before the Common Council for the rezoning on February 28, 2006 and then a new public hearing was heard on March 28, 2006 due to changes in the current zoning, and   WHEREAS, The 2010 Comprehensive Plan depicts this area as being set aside for Medium density residential uses consistent with the RS-2 and RS-3 zoning districts (1.6 – 2.99 units an acre), and   WHEREAS, The proposed zoning change will not require an amendment to the 2010 Comprehensive Plan, and   WHEREAS, As required in the SW Shoreland Wetland zoning ordinance, the WDNR was notified of the proposed rezoning and the WDNR has issued a letter concurring with the wetland delineations that the developer’s have shown on their conceptual plat and a letter stating that the rezoning is acceptable for residential development of this parcel as long as the main wetland delineations that they have concurred with are now zoned as SW Shoreland Wetland District, and   WHEREAS, As stipulated in the SW Shoreland Wetland zoning ordinance if no disapproval is received from the DNR by the time of the public hearing, the municipality may proceed on a determination of the rezoning as normal, and   WHEREAS, No notification of disapproval was received from the WDNR by the public hearing time, and WHEREAS, Said parcels will be serviced by municipal sanitary sewer and City water upon future approvals.   THEREFORE BE IT RESOLVED, That the Plan Commission recommends approval to the Common Council for a rezoning from EA Exclusive Agricultural District, A Agricultural and SW Shoreland Wetland to RS-2 Suburban Residence District and SW Shoreland Wetland District on the Stefaniak property located in the NW ¼ and NE ¼ of Section 21, (Racine Avenue / Tax Key No. 2241.999).   Plan Commission City of Muskego   WITHDRAWN APRIL 4, 2006 Adopted:    Amended April 4, 2006 Defeated: Deferred:   March 7, 2006 Introduced: March 7, 2006 ATTEST:  Sandi Asti, Recording Secretary
