PCR2006014 ./PCR2006014_files/filelist.xml RESOLUTION #P.C. 014-2006 Print BestFit 6 pt 8.15 pt 2 2 RESOLUTION #P.C. 014-2006 APPROVAL OF CONCEPTUAL SUBDIVISION PLAT FOR CRYSTAL LAKE ADDITION 1 LOCATED IN THE SE ¼ OF SECTION 32 (TAX KEY NO. 2287.999 / MUSKEGO DAM ROAD) WHEREAS, On January 23, 2006 a conceptual subdivision plat was submitted by Kalvin Klimeck and Tracy Weber for Crystal Lake Addition 1 located in the SE ¼ of Section 32 (Tax Key No. 2287.999 / Muskego Dam Road), and WHEREAS, The plan consists of 31 single-family parcels and 2 outlot, and WHEREAS, Said property is zoned RS-2 Suburban Residence District and will be developed as an unsewered subdivision, and WHEREAS, The RS-2 Suburban Residence District requires unsewered lots to have a minimum of 40,000 square feet and a minimum of 220 feet in width and the parcels depicted appear to meet these requirements, and WHEREAS, The 2010 Comprehensive Plan depicts this area for rural density residential development consistent with RCE zoning and an amendment to the Comprehensive Plan to low density residential is required, and   WHEREAS, Said parcels will be serviced with private on-site sewage systems, and   WHEREAS, The development will need to have a determination made by the Public Utilities Committee to see if private individual wells will be allowed or if a private community water trust is needed, and   WHEREAS, Access is depicted to derive from Muskego Dam Road/Kelsey Drive and possibly from a connection to the Crystal Lake Subdivision to the southwest of this development and the Public Works Committee may require improvements to the intersection of Muskego Dam Road/Kelsey Drive as part of the proposed development, and   WHEREAS, Internal connectivity is found throughout all the parcels in the sketch but a wetland crossing permit will be required by the DNR or a reconfiguration of the roadways may be needed to ensure internal connectivity, and   WHEREAS, Access is shown connecting to the Crystal Lake Subdivision at the southwest corner of the plat and to achieve this, land may need to be purchased from the land owner to the south, and   WHEREAS, Wetlands are found on two specific areas of the plat on individual parcels and changes may be needed to better protect these wetlands, and   WHEREAS, The Park and Open Space Plan depicts no recommendations for this piece of property, and   WHEREAS, The Conservation Plan depicts a small area of Medium Management Priority area on the northeastern portion of this site and a High Acquisition Priority area located near Crystal Lake at the southwest corner of the plat, and   WHEREAS, The Plat is required to provide on-site stormwater management as required by Chapter 34, and stormwater is depicted to be handled in detention facilities within the outlot. THEREFORE BE IT RESOLVED, That the Plan Commission approves of a sketch preliminary plat as proposed by Kalvin Klimeck and Tracy Weber for Crystal Lake Addition 1 located in the SE ¼ of Section 32 and will be receptive to the submittal of a preliminary plat. BEIT FURTHER RESOLVED, That an amendment to the Comprehensive Plan from rural density residential to low density residential is required. BE IT FURTHER RESOLVED, That improvements to Muskego Dam Road/Kelsey Drive intersection may be required since this intersection will contain the main entry to the proposed subdivision and Public Works Committee will have to review the plan to determine if any upgrades will be necessary.   BE IT FURTHER RESOLVED, That Public Works Committee will need to review the plat to determine the need and best placement for a road stub/extension to the western plat boundary to ensure proper connectivity and ingress/egress for possible future developments to the west.   BE IT FURTHER RESOLVED, That depending on the recommended location of the western right-of-way stub from the Public Works Committee, a direct connection to Racine Avenue may be needed since that is the only current direct right-of-way access to this parcel.   BE IT FURTHER RESOLVED, That if a connection to Racine Avenue is found to be necessary, a concept plan of the entire parcel may be needed before approval of the Preliminary Plat to ensure the proper placement of the right-of-way.   BE IT FURTHER RESOLVED, That Public Utilities Committee will need to review the plat to determine if private individual wells will be allowed or if a private community water trust is needed.   BE IT FURTHER RESOLVED, The Preliminary Plat should show all environmentally delineated areas within Preservation Easements.  Further, all wetlands shall be in outlots and those wetlands unable to be put into outlots shall show innovative ways of further protecting them (Fencing installed by developer around the wetlands that is maintained by homeowner or other methods).   BE IT FURTHER RESOLVED, That DNR concurrence on the delineation of all wetlands and navigable waterways within the platted area must be delivered to the Planning Department before approvals of the Preliminary Plat.   BE IT FURTHER RESOLVED, The property to the southwest is a previously approved development (Crystal Lake Subdivision) and the developer has shown on the plans the intension to connect to this development and in order to achieve this, an additional piece of land would need to be acquired to the south to make a connection to the existing subdivision.   BE IT FURTHER RESOLVED, That if a connection is achieved to Crystal Lake Subdivision, there cannot be a right-of-way immediately along side of Lot 5 of Crystal Lake Subdivision because this would create a front yard setback along this parcel.   BE IT FURTHER RESOLVED, The Park and Conservation Boards will review the proposal at the time of Preliminary Plat to determine dedication fee needs and preservation plan and easement needs.   BE IT FURTHER RESOLVED, That If a wetland-crossing permit is not issued by the DNR, then the roadway may have to be reconfigured around the wetlands.   BE IT FURTHER RESOLVED, All environmental features will need to be delineated before Preliminary Plat time including high water marks of navigable streams, any wetlands, floodplains, and forested areas.   BE IT FURTHER RESOLVED, That this approval is granted in concept only and final action is only an indication of the current intent of the Plan Commission; Final submittals are subject to future review and consideration by the Plan Commission, municipal committees of jurisdiction, and other agencies, and approval of final plans is not guaranteed by this action of the Plan Commission.   Plan Commission City of Muskego   Denied Without  Prejudice:  October 3, 2006 Adopted:    Defeated: Deferred:    February 7, 2006;  February 21, 2006;  March 7, 2006;  March 21, 2006;       April 4, 2006;  April 18, 2006;  May 2, 2006;  May 16, 2006;  June 6, 2006;  June 20, 2006;  July 18, 2006;  August 15, 2006; September 5, 2006;  September 19, 2006 Introduced: February 7, 2006 ATTEST: Sandi Asti, Recording Secretary
