PCR2006012 ./PCR2006012_files/filelist.xml RESOLUTION #PC 108-2005 Print 104 6 pt 6 pt 0 RESOLUTION #P.C. 012-2006 RECOMMENDATION TO COUNCIL TO REZONE THE DHILLON PROPERTY FROM THE A AGRICULTURAL DISTRICT TO B-4 HIGHWAY BUSINESS DISTRICT AND APPROVAL OF A CONCEPTUAL CONDITIONAL USE GRANT FOR A GAS STATION/CONVENIENCE CENTER LOCATED IN THE NE ¼ OF SECTION 34 (TAX KEY NO. 2293.996.001 / LOOMIS DRIVE) WHEREAS, On December 13, 2005 a petition for rezoning was submitted by Baljit Dhillon to rezone a property from the A Agricultural District to B-4 Highway Business District, and WHEREAS, The submittal for the rezoning provided a narrative stating that the petitioner intends to develop the property into a future gas station/convenience center and wishes that the Planning Commission addresses the possibility of allowing this by issuing a conditional use grant for the aforementioned use in conceptual form, and   WHEREAS, The petitioner currently owns the gas station on the southwest corner of Muskego Dam Road and Loomis Drive (Known as Frey Auto) and wishes for that gas station use to cease in the future if new approvals are received for a gas station on the petitioned site, and   WHEREAS, A Public Hearing for the rezoning was heard before the Common Council on January 24, 2006, and WHEREAS, The petition would permit a variety of commercial uses on the property, and   WHEREAS, The future possible use of a gas station/convenience center would require future Building, Site and Operation  and Conditional Use Grant approvals in front of the Planning Commission, and   WHEREAS, The property is currently served by private sewer and water, and   WHEREAS, The 2010 Comprehensive Plan depicts the property for commercial uses consistent with the B-4 zoning district and the rezoning is consistent with this goal. THEREFORE BE IT RESOLVED, That the Plan Commission does hereby recommend approval to the Common Council for the rezoning from the A Agricultural District to B-4 Highway Business District and for the approval of a conceptual conditional use grant to allow a future gas station/convenience center for the Dhillon property (Tax Key No. 2293.996.001 / Loomis Drive).   BE IT FURTHER RESOLVED, That any future commercial use on the property will require Building Site and Operation and possibly Conditional Use Grant approvals in front of the City’s Planning Commission.   BE IT FURTHER RESOLVED, That contingencies may be required if a future BSO/CUG proposal comes to Planning Commission for a gas station/convenience center use from the petitioner.  Further those contingencies of the BSO/CUG approvals may include removing the CUG for the existing gas station in the area while also requiring remediation of the current gas station site, which may or may not include removing structures, gas storage tanks, and contaminated soils.   Plan Commission City of Muskego Adopted:    February 7, 2006 Defeated:   Deferred: Introduced:  February 7, 2006 ATTEST: Sandi Asti, Recording Secretary
