PCR2006008 ./PCR2006008_files/filelist.xml RESOLUTION #PC 008-2006 Print BestFit 6 pt 6 pt 0 RESOLUTION #P.C. 008-2006 RECOMMENDATION OF APPROVAL TO REZONE A PROPERTY FROM RSE/OWP SUBURBAN ESTATE DISTRICT WITH A WELLHEAD PROTECTION OVERLAY AND R-2/OWP COUNTRY HOME DISTRICT WITH A WELLHEAD PROTECTION OVERLAY TO ALL RSE/OWP SUBURBAN ESTATE DISTRICT WITH A WELLHEAD PROTECTION OVERLAY LOCATED IN THE SW ¼ OF SECTION 24 (TAX KEY NOS. 2255.979 AND 2255.998 / RYAN ROAD) WHEREAS, On January 17, 2006 a petition for rezoning was submitted by Brian Schoenleber to rezone properties from RSE/OWP Suburban Estate District with a Wellhead Protection Overlay and R-2/OWP Country Home District with a Wellhead Protection Overlay to all RSE/OWP Suburban Estate District with a Wellhead Protection Overlay located on Ryan Road (Tax Key Nos. 2255.979 and 2255.998), and   WHEREAS, A Public Hearing for the rezoning has been scheduled before the Common Council on February 14, 2006, and WHEREAS, The petition would permit sewered residential development allowing single-family residential uses on 40,000 square foot lots with 150 feet of width, and   WHEREAS, The OWP Wellhead Protection Overlay District restricts certain uses that may affect groundwater quality in the area, and   WHEREAS, The 2010 Comprehensive Plan currently depicts the property for low-density residential uses consistent with the RSE District, and this proposal is consistent with this goal, and   WHEREAS, Plan Commission previously recommended approval of a conceptual plan for these properties to allow 11 parcels consistent with the current zoning of R-2 and RSE districts and the petitioners have since removed this previous request due to new evidence of the parcels inclusion in the sanitary sewer district for MMSD.   THEREFORE BE IT RESOLVED, That the Plan Commission does hereby recommend approval to the Common Council for the rezoning from the RSE/OWP Suburban Estate District with a Wellhead Protection Overlay and R-2/OWP Country Home District with a Wellhead Protection Overlay to all RSE/OWP Suburban Estate District for properties located Ryan Road (Tax Key Nos. 2255.979 and 2255.998).
