PCR2006007 ./PCR2006007_files/filelist.xml RESOLUTION #PC 007-2006 Print 86 6 pt 6 pt 0 AMENDED RESOLUTION #P.C.007-2006 APPROVAL OF AN AMENDMENT TO A BUILDING SITE AND OPERATION PLAN FOR OLSON’S OUTDOOR POWER LOCATED IN THE NE ¼ OF SECTION 2 (TAX KEY NO. 2165.998.005 / S63 W14323 COLLEGE AVENUE) WHEREAS, On January 3, 2006 plans were submitted by Design Build Group for a Building, Site and Operation Plan amendment for Olson’s Outdoor Power located in the NE ¼ of Section 2 (Tax Key No. 2165.998.005 / S63 W14323 College Avenue), and   WHEREAS, Said use is a permitted use in the I-1, Industrial Park District by right with the approval of a Building, Site and Operation Plan, and   WHEREAS, The existing site consists of an industrial/commercial building along with parking areas, and   WHEREAS, The petitioner is going to relocate the existing front entry door and replace it with an aluminum frame glass door, and   WHEREAS, Aluminum windows are going to be added to the front (north side) of the building, and   WHEREAS, An overhead door will be added to the east side of the building that will match the existing overhead doors, and   WHEREAS, The existing guard rail in front of the building will be removed and replaced with bollards that will be colored to match the building, and   WHEREAS, The entry approach, the proposed fenced area, and the parking areas are all currently paved, and   WHEREAS, There will be thirteen (13) customer parking stalls (two of which are handicap stalls) located in front of the building, and   WHEREAS, All parking stalls are 10’ x 20’ and will need to be striped, and   WHEREAS, There will be a 60’ x 85’ fenced area to enclose any outdoor storage and any crated equipment, and   WHEREAS, An eight (8) foot high chain link fence with privacy slats and a three strand barded wire top is being proposed surrounding the outdoor storage area, and   WHEREAS, The dumpsters will be housed within the screened/fenced area, and   WHEREAS, The petitioner has illustrated a large area as general outdoor display/sales on the northeastern portion of the site, and   WHEREAS, The petitioner has not requested a specific number of pieces of equipment for outdoor display/sales, and   WHEREAS, Said parcel will be serviced by municipal sanitary sewer and private well water, and   WHEREAS, No stormwater facilities will be needed since there are no added impervious surfaces.   THEREFORE BE IT RESOLVED, That the Plan Commission approves of an amended Building, Site and Operation Plan submitted by Design Build Group for Olson’s Outdoor Power located in the NE ¼ of Section 2 (Tax Key No. 2165.998.005 / S63 W14323 College Avenue).   BE IT FURTHER RESOLVED, That any new signage will require Plan Department and/or Plan Commission approval.   BE IT FURTHER RESOLVED, That the parking lot must have striped parking stalls measuring 10’ x 20’.   BE IT FURTHER RESOLVED, That the privacy slats within the fence must be colored to match the main building.   BE IT FURTHER RESLOLVED, That any equipment, storage, crates, etc. stored within the fenced area must not be stacked past the top of the fence.   BE IT FURTHER RESOLVED, That the outdoor display/sales area will be allowed to have up to twenty-four (24) be limited to twelve (12) pieces of equipment at a time.   BE IT FURTHER RESOLVED, That a specifically defined outdoor display/sales area will have to be presented to and approved by the Planning Department in order to reduce clutter and to add to the aesthetics of the this area.   BE IT FURTHER RESOLVED, The pieces of equipment that are to be displayed in the front of the property will be brought in and enclosed when the business closes daily.   BE IT FURTHER RESOLVED, That the outdoor display/sales area must be located on the property, not within the public right-of-way.   BE IT FURTHER RESOLVED, That the petitioner must get a landscape plan approved by the City Forester by the end of February 2006 that will incorporate the outdoor display area, landscaping around the display area, and general landscaping on the site.   BE IT FURTHER RESOLVED, That other ancillary signage on the property is expressly prohibited unless specifically regulated by Section 17:6.09 of the Municipal Code.   BE IT FURTHER RESOLVED, That no other outdoor storage/display of any kind shall be allowed other than in the defined areas noted above.   BE IT FURTHER RESOLVED, That a copy of said plans be kept on file in the Building Department and that all aspect of this plan shall be maintained in perpetuity unless otherwise authorized by the Plan Commission.   BE IT FURTHER RESOLVED, That failure to comply with the approval contained in this resolution shall result in the imposition of fines of $100 per day, the initiation of legal action, or both.   BE IT FURTHER RESOLVED, No outside storage would exceed height of the chain-link fence not including the barbed wire.    Plan Commission City of Muskego
