Plan Commission Supplement PC 029-2026
For the meeting of: May 5, 2026
REQUEST: Building, Site and Operation (BSO) Plan Amendment for Sobek's.
S79 W16419 Woods Road / Tax Key No. 2218.999
NW '/4 of Section 15
PETITIONER: Mark Moczynski
INTRODUCED: May 5, 2026
LAST AGENDA: N/A
PREPARED BY: Adam Trzebiatowski, AICP
BACKGROUND PC 029-2026
The petitioner is seeking a Building, Site and Operation (BSO) Plan Amendment approval to pave the
gravel parking lot area around the bar with asphalt. More specifically, the petitioner is requesting to
expand the parking area to include parking between the bar and the pole barn behind the bar.
CONSISTENCY WITH ADOPTED PLANS 029-2026
The 2035 Plan depicts the property as Medium Density Residential uses.
Comprehensive Plan: This proposal is not consistent with the plan. However, this property has
been continually used as a bar and the continued use of this property would
be permitted.
Zoning: The property is zoned BL-2 Lakeshore Business District. This proposal is
consistent with the Code.
STAFF DISCUSSION PC 029-2026
As mentioned above, currently there is a narrow drive along the east side of the building with an
unmarked gravel parking area on all three other sides of the bar used by the employees and patrons of
Sobek's bar. The petitioner is seeking approval to pave the parking lot and expand the parking lot toward
the south to where a pole barn stands. The petitioner will be striping the parking stalls meeting the 9' x
18' minimum stall standards.
This typically wouldn't be much discussion with the paving improvements to a business operation
however there are three waivers from the standard guidelines that the petitioner is seeking.
First, the petitioner is seeking approval to pave right up to the eastern property line. The code states that
`In any off-street parking area for a commercial use, no vehicle shall be allowed to park closer nor shall
any drive be permitted closer than 10 feet to an abutting residential lot line (subject to Plan Commission
discretion for unique situations)." The petitioner explains that the driveway known as Sobek Lane that
has existed in the current location for over 100 years is right up to the eastern property line and where the
building is situated there is not enough room to have a ten or even a three-foot offset. Additionally, the
petitioner states that the City has a deeded access on Sobek Lane to access the lift station located near
the water directly south. The drive aisle would have signage added to note that the drive aisle is one way
(exit only). Staff will require additional signage and pavement markings to be reviewed during permitting.
3
Next, the petitioner is requesting the ability to pave within the right-of-way from the driveway (Sobek Ln.)
to the western edge of the parking area. The code states, `In any off-street parking area no parking
surface shall be placed to permit vehicle parking closer than 10 feet to the existing street line (subject to
Plan Commission discretion for unique situations)." If this request is approved by the Plan Commission,
the Public Works & Safety Committee will need to approve this proposal prior to permitting. There are no
parking stalls identified between the drive
aisles, therefore there is no parking allowed in
this area including in front of the building. '
Further, because no parking would be allowed -
in front of the building, staff would encourage opOSR°
the Plan Commission to limit the paving in the
right-of-way to the drive aisle and parking area. ,
Between the two drive aisles in front of the
structure could be landscaped with grass, a .
walkway to the front door and possible
plantings/planter bed to improve the aesthetics
of the front of the building in a residential area
as stated in the next request. This would also
eliminate vehicular travel where not intended.
A similar request was presented in 2017 for
allowable parking in the right-of-way at another
site within the City and a Public Works &
Safety Committee approval was sought and
granted. L 7°
Lastly, the petitioner is seeking a waiver to the
concrete curb and gutter policy and have stated that Sobeks resides in a residential area and not having
curbing would be consistent with other businesses in the area. Concrete curb and gutter is typically
required for all new or replaced non-residential parking areas based on Plan Commission policy and past
projects. Plan Commission has granted waivers in the past to sites similar to this where there is no other
curb and gutter in parking areas. In lieu of the concrete curb and gutter, a parking stop fastened to the
paving surface is required at the front of any parking stalls that abut grass areas. The Resolution is
drafted as such.
Overall, Staff recommends approval of the paved parking area as the Code requires paved off-street
parking for commercial uses. The parking stalls and drive aisle around the structure (south and west
sides) meet the minimum size requirements of 9' x 18' for the parking stalls and 24' width for drive aisles.
The reduced offset on the east side of the building has been used in the current condition for many years
without another option other than removing the access drive altogether. With the thought that in a
residential area that no curb and gutter be used, the same residential aesthetic should be used to add
open space in the form of a grass lawn and plantings at the base of the building on the front (north) side
of the building. The Resolution is drafted as approval of the BSO Amendment with a waiver to the offset
to the neighboring property line, paving within the right-of-way with greenspace in front of the building and
without curb and gutter.
STAFF RECOMMENDATION PC 029-2026
Approval of Resolution PC 029-2026, if the Plan Commission agrees upon granting the three
waivers and approval of greenspace in front of the building.

BE IT FURTHER RESOLVED, The exterior edge of all new parking stalls, where adjacent to grass,
must include a parking stop fastened to the paving surface at the front of the stall.

Sobeks Request:
We are requesting to blacktop the entire existing gravel portion of the bar parking lot,
including area surrounding the bar and part of the existing Sobek Ln located to the East of
the bar structure from Woods Road to the backside of the pole barn building located
behind the bar.
Parking stalls would be lined and conforming to the 9' X 18' minimum size.
We are requesting the following variances:
1. The existing Sobek Lane runs right up to the lot line on the East side of the property.
Currently, there is not enough space between the existing bar structure and lot line
to the East to change or modify the existing Sobek Ln (that has been in place for over
100 years) to comply with the 3' lot line set back while maintaining the minimum 12'
width required. The City of Muskego currently has deeded access on Sobek Lane to
access the lift station located near the lake and regularly brings large trucks down
Sobek Lane. We would add signage that indicates Sobek Lane is exit only.
2. We are requesting the blacktop run all the way to the Woods Road curb for the
length of the parking lot area to the East lot line including Sobek Ln, or over all the
existing gravel lot and drive. Not only will this improve aesthetics and be consistent
with other businesses in the area.
3. We are requesting no curbs required as Sobeks resides in a residential area to
maintain. This is consistent with other businesses in the area.

Plan Commission Supplement PC 030-2026
For the meeting of. May 5, 2026
REQUEST: Approval of the Temporary Sale of Fireworks at the Basse Farm
S70 W16050 Janesville Road / Tax Key No. 2172.999
SE '/4 of Section 3
PETITIONER: Dustin Hein, Freedom Fireworks, LLC.
INTRODUCED: May 5, 2026
LAST AGENDA: N/A
PREPARED BY: Adam Trzebiatowski, AICP
BACKGROUND PC 030-2026
Petitioner proposes to operate a temporary fireworks sales stand on the southwest side of the property along the
west side of the parking area and drive aisle. A 20' x 60' tent will be erected for product display and retail sales
along with a 40' x 8' metal storage container stored immediately adjacent to the tent for all storage. An existing
fence along the side of the drive aisle that will separate vehicles from patrons in the sales tent. Parking will be on
the asphalt lot adjacent to the building.
Signage has been indicated as a 5' x 40' banner and a 3' x 20' temporary banner that will be hung from the south
and east sides of the tent. A new 8' x 8' single sided temporary sign is proposed along Moorland Road on the
property fifteen (15) feet from the property line identical to the last couple years. Lastly, the unused monument sign
will have signage applied to either side. No other road signs will be on the property or right-of-way.
Operations are proposed from June 18th 2026 to July 8th 2026 from 9:00 am to 9:00 pm daily. The property will be
canvased daily for trash and debris. The tent and container must be completely removed from the site by July 12,
2026. Permission has been received from the property owner to use the site and a portable restroom will be onsite.
DISCUSSION PC 030-2026
The proposal is consistent with operations conducted on this site the past few years and of other vendors in
Muskego. The petitioner notes that all fireworks on -site and for sale will be in accordance with all City and State
ordinances.
It has been brought to the City's attention that at least one of the multiple fireworks stands in the City last year was
selling fireworks that are not allowed pursuant to Section 263-4 of the Municipal Code. Therefore, there will be
random inspection(s) to ensure that all City Codes are being followed. If found to be in violation of said codes, the
petitioner will be required to shut down until such time that those fireworks in violation are removed from the
premises and after a reinspection has occurred. If violations are found a second time, then this approval will be
revoked by staff for the remainder of the year and the vendor will be required to remove all products and operations
from the site within five (5) days of notification of revocation. The Resolution is drafted as such.
A transient merchant license must be obtained from the City Clerk's Office.
As allowed with other firework sales locations, a storage container may be on site. There have been no problems
11
with the storage container in years past when the applicant operated at several locations throughout the City.
Because there are no other operations at the site, staff is amenable to the monument sign being used as well as a
temporary sign along Moorland Road. These two signs will also need a temporary sign permit to allow staff to
review the content and exact location of the signs. The Resolution is drafted as such.
No drive aisles can be blocked anywhere on site.

Plan Commission Supplement PC 031-2026
For the meeting of. May 5, 2026
REQUEST: Approval of the Temporary Sale of Fireworks at Lakepoint Church
S63 W13694 Janesville Road / Tax Key No. 2162.997.001
NE'/4 of Section 2
PETITIONER: Dustin Hein, Freedom Fireworks, LLC.
INTRODUCED: May 5, 2026
LAST AGENDA: N/A
PREPARED BY: Adam Trzebiatowski, AICP
BACKGROUND PC 031-2026
Petitioner proposes to operate a temporary fireworks sales stand within the existing parking stalls on the south side
of the property along Janesville Road. A 30' x 60' tent will be erected for product display and retail sales along with
two 20' x 8' metal storage containers immediately adjacent to the north side of the tent for all storage. A safety
barrier will be in place to separate the patrons from vehicles in the drive aisles.
Signage has been indicated as two 3' x 20' temporary banners that will be hung from the south side of the tent and
the east side of the storage container.
Operations are proposed from June 18th 2026 to July 5th 2026 from 9:00 am to 9:00 pm daily. The property will be
canvased daily for trash and debris. The tent and container must be completely removed from the site by July 12,
2026. Permission has been received from the property owner to use the site and the restrooms at Lakepoint
Church.
DISCUSSION PC 031-2026
The proposal is consistent with operations conducted on this site the past few years and of other vendors in
Muskego. The petitioner notes that all fireworks on -site and for sale will be in accordance with all City and State
ordinances
There have been no problems
with the storage container in years past when the applicant operated at several locations throughout the City.
25
No drive aisles can be blocked anywhere on site.
During the April 8, 2026 Plan Commission meeting a Building, Site and Operation Plan Amendment was approved
for Lakepoint Church who offered to limit its total capacity of the three event spaces to 600 people to ensure there
was enough parking on the site for not only for their needs but also Better Together and Leah's Italian Restaurant.
Plan Commission should discuss adding another use, albeit temporary, that will utilize twenty stalls for the tent and
storage containers in addition to employee and patron parking spaces.

Plan Commission Supplement PC 033-2026
For the meeting of. May 5, 2026
REQUEST: Metal Accessory Structure
W218 S10451 Calvin Court / Tax Key No. 2282.996.006
NW '/4 of Section 31
PETITIONER: Joshua Sowden
INTRODUCED: May 5, 2026
LAST AGENDA: N/A
PREPARED BY: Adam Trzebiatowski, AICP
BACKGROUND PC 033-2026
The petitioner proposes to construct a new accessory structure to replace an older detached garage on site that
measures 40' x 72' (2,880 square foot total). This building will be clad in metal with a metal roof. Plans are
attached for your review.
Plan Commission may waive the architectural requirements for accessory structures when any of the following are
met:
1. The structure is screened from view,
2. The principal structure is composed of materials, colors, or styles that are inappropriate in their applications
to an accessory structure,
3. The Plan Commission finds other circumstances to be present which would result in no undue harm to the
property or its surroundings,
4. When the area is found not to be predominately residential.
Plan Commission may approve the materials as submitted or require modifications prior to release of building
permits.
PLAN CONSISTENCY PC 033-2026
Comprehensive Plan: The 2035 Plan depicts the area for rural density residential land use. The
proposal for this residential outbuilding is consistent with the Plan.
The property is zoned A-1 Agricultural District. Accessory structures up to
Zoning: 2,993 square feet are permitted on the subject property based on the size of the
property. The current proposal measures 2,880 square feet in area. The
proposal meets the bulk requirements of the Zoning Code.
STAFF DISCUSSION PC 033-2026
The petitioner is seeking approval of a metal accessory structure to store recreational and personal vehicles. The
structure will be for personal use. The architectural requirements in the Code state that the accessory structure
should have similar materials and colors as the principal residence. The petitioner is proposing a steel siding and a
steel roof on the accessory structure with colors to match the house being a bronze siding with a light stone colored
roof. The structure will include wainscoting that would also match the colors and characteristics of the house.
Three windows are located on the side of the structure with an overhead door and service door on the end wall to
offer a residential feel of the structure. Additionally, overhangs are included to match those of the house. Planning
Commission approval is being sought due to the difference of materials.
40
The accessory structure would be located to the side of the house on the wooded lot. The structure will be
approximately 85 feet from the front property line abutting the cul-de-sac of Calvin Court and approximately 40 feet
to the side property line meeting the setback and offset requirements. The proposed height of the building to the
midpoint is just below 20 feet as measured by the Code, which is within the allowable height of an accessory
structure with a property this size.
As this is a residentially zoned property, this structure and/or the property cannot be used for any business or
commercial storage or use. Per the Code, the structure must have a finished floor of concrete or asphalt.
The Resolution states the following items:
BE /T FURTHER RESOLVED, The colors of the proposed building must be similar to the colors of the home.
BE /T FURTHER RESOLVED, That the building and lot cannot be used for the operations of any business activities
or for business storage.
BE IT FURTHER RESOLVED, That the floor of the entire building must be concrete or asphalt.
BE IT FURTHER RESOLVED, The depth of the over hangs on all sides of the building must at least be equal to
those on the main home.
BE /T FURTHER RESOLVED, That the existing accessory structure will be removed completely upon the
completion of the new accessory structure, within one month of completion.
STAFF RECOMMENDATION PC 033-2026
Approval of Resolution #PC 033-2026, if the Plan Commission feels the proposal metal structure meets the
typical waiver requirements to allow metal siding and roofing.

Our property and proposed building site is located approximately one -quarter mile off
Kelsey Drive and is heavily wooded, resulting in very limited visibility between neighboring
properties.
I am requesting approval to construct a 40' x 72' metal -sided pole building for personal use,
primarily to store recreational and personal vehicles. This structure will help protect these
assets from weather -related damage while also contributing positivelyto the overallvalue
and functionality of the property.
Due to the dense tree coverage surrounding the proposed location, the building will be
effectively screened from view along Kelsey Drive and will have minimal visibility from
neighboring properties.
In addition, I am committed to ensuring the structure is visually consistent with our existing
home. The design will incorporate complementary color tones, as well as features such as
a service door, multiple windows, and wainscoting to enhance its appearance and
maintain the property's curb appeal.
I respectfully request your consideration of this proposal and am committed to ensuring
the structure aligns with the character and standards of the surrounding area.
